COVID – 19 The safety of our customers and our staff is our highest priority and all visitors to the Cattle Market

are expected to comply with any notices and follow any guidance issued by the government, our

auctioneers and staff. Failure to do so may result in a refusal to accept bids or result in being asked to

leave. Following the government's easing of restrictions on Monday the 19th of July, Kivells would like

to reassure our customers and clients that we will continue to operate safely and navigate the future

with caution. Social distancing and face coverings are no longer mandatory at any of our sites,

however we encourage all of our customers to continue wearing face coverings and maintain social

distancing where possible. We will continue to limit the number of clients entering our property,

professional and market offices and physical screens will remain in place between customers and

members of staff, signage will remain advising people to socially distance and to wear masks.

Customers are reminded not to attend appointments, viewings, markets or any of our Kivells locations

if they are experiencing any symptoms of COVID-19. We hope that this is the beginning of our journey

Auction Sale Rules

*In Milk / In Calf dairy cattle sold through the dairy ring at £500 or less per head

DO NOT carry the usual National Sales Conditions warranty*

(All cattle sold by Kivells are sold under the Livestock Auctioneers Association Conditions of Sale)

Maiden heifers stated to be sold for breeding purposes.

The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be sold for breeding

purposes to be free from any malformation which would render the animal incapable of breeding. The warranty is a

5 day warranty if the malformation is patent or a 6 month + 5 day warranty if the malformation is latent.

If the purchaser proves a breach of warranty the purchaser may return the animal to the vendor. Notice of claim

must be supported by a veterinary surgeon’s certificate.

Cows or heifers sold as being in milk and/or in calf.

The vendor warrants a dairy cow or heifer in calf and/or in milk: (a) To be correct in the udder and teats; (b) Not

to be infected with clinical mastitis; (c) Not to suck any other animal or herself; and (d) To be quiet to milk.

The warranties in conditions (a) & (b) is an after sale warranty which shall run from the close of the day’s sale or

until the animal is removed from the sale premises, whichever is sooner. The warranty in conditions (c) & (d) is a

5+5 day warranty.

Cleansing The vendor warrants that all newly calved cows and heifers have cleansed satisfactorily before the

sale. This warranty is a 3 day warranty in which any claim made by the purchaser must be supported by a

veterinary surgeon’s certificate. The vendor is obliged to pay for the cost of one wash out.

Cows or heifers sold as served or guaranteed in calf: When an animal stated to have been served less than

10 weeks prior to the sale and is pregnancy diagnosed positive, this is given as guidance only and carries no

warranty. If a cow or heifer has been positively diagnosed as 10 weeks or more in calf at the time of sale and

thereafter is proved to be not in-calf, and a Veterinary Surgeon’s certificate to that effect is produced there is

a 38 + 5 day warranty. Where a cow or heifer is sold as ‘having run with a bull’ no warranty as to the animal

being in calf at the time of sale is given.

Breeding Stock bulls The vendor warrants that any bull 10 months or over sold as a stock bull is capable of and

effective at natural service. This warranty is a 16 week warranty.

Please note Milk yields are given as a guide but carry no warranty. The descriptions are supplied by the vendor

and whilst they are believed to be correct this catalogue in no way shall guarantee their accuracy. Antibiotics –

Please would all vendors inform the Auctioneers if any animal has been treated with any antibiotics. There are

serious penalties incurred to milk producers for antibiotic contamination.

Livestock Notice to Purchasers

Viewing – Wednesday 20th October - 8am onwards.

Health & Safety - Kivells accept no liability for any damage or injury to persons, livestock, vehicles or

plant not arising out of their negligence. Any person entering the livestock market premises does so at

their own risk and must comply with the requirements of any Health and Safety notices. All persons

entering the livestock markets premises are hereby given notice that there are potential hazards due

to the type, penning, herding, loading and unloading of livestock and vehicle movement. Caution should

be exercised and children must be fully supervised at all times. Kivells reserve the right to refuse

admission to any person or vehicle into the livestock market premises without giving reason. Kivells

strongly advise that no persons access the sale ring, pennage or livestock passageways during the sale

or whilst animals are being moved through passageways. Should any person decide to enter these

aforementioned areas they do so entirely at their own risk. Any incidents or accidents in the livestock

market premises should be reported to Kivells market office immediately.

Biosecurity and Livestock Welfare - All persons entering Kivells livestock market premises must comply

with all current Biosecurity legislation, rules and conditions. All persons should be in clean clothing and

disinfect footwear upon entry and exit from the livestock market premises. Hand wash facilities,

disinfectant boot dips and brushes are available and should be used. Vehicles used to transport animals

to or from the livestock market premises must comply with current cleaning and disinfection legislation.

All vendors, purchasers, agents and hauliers must comply with all current legislation governing the

welfare of livestock whilst at Kivells livestock market premises or in transport to or from the livestock

market premises. Any concerns over Biosecurity and Animal Welfare should be reported to Kivells

Biosecurity and Animal Welfare officers, whose details are located in the Kivells market office.

Registration - In order to bid, all new Buyers are required to register before the auction, at the Kivells

market office or as otherwise advised by the Auctioneers. All such Buyers will be asked for two forms

of identification and a credit reference will be required. Acceptable identification includes Driving

Licence/Passport together with a Utility Bill/Proof of Address/Business Letter Heading/Business Card.

The Auctioneers reserve the right to request a deposit ahead of any purchase or during sale proceedings

and to refuse registration or any bid or bidder without giving reason. New Buyers are strongly advised

to contact the Auctioneers well in advance of the sale.

Payment - All Lots must be paid for on the day of the Sale by the Buyer prior to any removal or

consolidation, unless alternative arrangements have been agreed with the Auctioneers. At the fall of

the hammer the highest bidder will be deemed to be the Buyer and transfers of purchases will only be

permitted with prior approval from the Auctioneers. Any payment is to be by a means approved by the

Auctioneers. Our preferred payment terms are debit card or cash and Kivells reserve the right to

stipulate payment by these methods. Kivells may also accept bank transfers and cheques with prior

approval. Our Bank Account details are: Sort Code 56-00-49 Account Number 32376359. Payment in

Cash - In order to comply with money laundering regulations we cannot accept Cash payments above

the maximum permitted at the time of sale. The maximum varies according to exchange rates and

currently it is circa £9,000. Buyers are advised to check with the Auctioneers ahead of the sale.

Conditions of Sale - It is strongly recommended that Bidders and Buyers visit Kivells.com and read the

full Conditions of Sale produced by the Livestock Auctioneers Association (LAA) ahead of the sale. Unless

advised otherwise you will be bidding and buying under these Conditions and you will be obligated to

abide by these Conditions and these Notice to Purchasers. The LAA Conditions of Sale are also displayed

in Kivells market office. Clauses 12 to 19 inclusive relate mainly to the Purchaser. This catalogue may

also contain reference to Warranties as defined by the LAA Conditions of Sale. Warranty issues will not

be considered if payment in full has not been received.

Risk - All livestock are at the risk of the Vendor before they are sold and at the risk of the Buyer when

they are sold (fall of the hammer). It is strongly advised that Vendors and Buyers ensure that their

insurance policies cover livestock at market premises and that Buyers have immediate cover for animals

purchased.

Removal of Lots - Lots can only be removed once payment has been made in full and/or a pass issued

by the Auctioneers. All Lots need to be cleared from the sale premises by 5pm on the day of sale unless

otherwise agreed with the Auctioneers.

Descriptions of Lots - Buyers should satisfy themselves prior to making bids as to the condition of any

Lot and should rely on their own judgement as to whether the Lot accords with its description. All Lots

are sold under the Livestock Auctioneers Association Conditions of Sale as referred to above to include

the following two clauses:

Statements of Fact - Unless otherwise announced all statements of fact made in any sale catalogue or at

the time of sale regarding the breeding of any animal, its health status or other tests carried out on any

animal are statements of fact made by the Vendor and not the Auctioneer and the Auctioneer accepts no

responsibility for any misstatement nor does he nor the Vendor accept any responsibility for any

subsequent reaction by an animal sold to any relevant test administered after the sale.

Liability of The Auctioneer - The Auctioneer acts in all respects only as agent for the Vendor and no

warranty is given by the Auctioneer or his employees or contractors, and none shall be implied, as to title,

description or the quality of any Lot. Neither the Auctioneer nor his employees or contractors shall be

liable to the Purchaser in any respect for any defect of title, error of description or imperfection or for

any announcement or statement concerning any Lot offered for sale whether made orally or in writing

(whether in a sale catalogue, order of sale, advertisement for the sale or otherwise) and whether given

before, during or after the sale, nor shall he incur any liability in relation to any dispute between a Vendor

and Purchaser.

Bidding Form - The Auctioneers will bid on your behalf if written instructions are received on the form

supplied, or an email or text has been received confirming instructions and acceptance of the terms set

out in the form, and adequate time is available to enter such bids. The Auctioneers reserve the right to

request a deposit as part of the instruction process. It is entirely at the discretion of the Auctioneers

whether other forms of bids are acceptable however in every case there is no liability on the

auctioneers.

FOREWORD Kivells are delighted to have received instructions to disperse the milking portion of

the dairy herd on behalf of Andrew and Sarah Foote of Worthen Farm, Pyworthy

Holsworthy. The herd will be removed to Holsworthy Livestock Market on

Wednesday 20th October for convenience of sale and sold at 11am.

This is a genuine dispersal sale brought about by the decision to cease milk

production and sell the farm. The cows are farmed on a robotic milking system and

have an all year round calving pattern with 34 cows calved since the start of July 2021

and over 50% of the cows have calved in the Summer and Autumn months. The cows

have either been served to AI BB or a well-bred Holstein Friesian Stock Bull from the

renowned ‘Sherdon’ herd and all the cows have recently been PD’d with the dates

being a result of a confirmed service. The cows are cubicle housed all year round and

fed grass silage only and blend behind a feed barrier with concentrates to yield in

the Lely 43 classic robots.

The cows have been recently recorded with the most recent yields, fats, proteins

and cell counts included in the catalogue.

Latest Milk Statement showing 4.40%BF 3.23%PTN

Herd costings show an average of 7500Kgs & the cows are currently

averaging 26Kgs per day.

The cows have excellent cell counts and the average for the cows being sold is cc81

which is extremely low for a herd housed all year round.

The cows are medium sized Friesian type and contain some cross bred cows, the

cows are not vaccinated but are regularly monitored via milk testing for BVD, Lepto

and IBR and are showing very low levels and have been regularly screened and

Johnes. The herd was TB tested on 13.09.2021.

Auctioneers comments:

Andrew, Sarah and family moved from Somerset to Worthen Farm in 2006 and have

been loyal regular clients selling surplus dairy cattle and beef calves throughout this

period. The herd of cows which will be sold in Holsworthy Market on Wednesday

20th October are a commercially managed robotically milked herd of cows. They are

medium sized British Friesian type with some cross breeding, they have good chest

width, udders and sound legs and feet. We wish the Foote family all the best with

their future plans and Kivells have enjoyed working with genuine dairy farmers who

have always sold well reared and well farmed stock. The cattle included in this sale

would adapt to all dairy farming systems.

PD+ Due Date Warranty:

Due to the use of natural service stock bulls in addition to AI bulls all due dates and

PD results are the veterinary surgeons best estimate and should be treated as

estimates. We recommend that you check PD due dates with your own vet as soon

as possible after the sale and certainly within 7 weeks of the sale (the warranty

period). All claims for incorrect due dates must be made within 7 weeks of the sale

date. Claims outside of the 7 week warranty cannot be considered.
