Mayor Magdits called the Fiscal Year 2019 budget workshop to order at approximately5:42 p.m. and then turned the floor over to City Administrator John Butz.
(A) Review of the Proposed FY 2018/2019 Budget: Mr. Butz began by detailing the“FY 2019 Budget Summary” document. distributed to the Council at the onset of themeeting.
Mr. Butz pointed out the proposed fiscal year 2018/2019 budget. which begins October1, 2018. represents a total yearly program of 528.908.103 in anticipated revenues offsetby 529,380.187 in expenses. He noted this year’s budget is again “cry tight.
Mr. Butz continued by providing an overview of each of the individual budgets/fi.indsand entertained questions from the Council.
Mr. Butz referred the Council to the City’s organizational chart and the EmployeeTurnover Analysis. He also provided an overview of the City’s compensation system.
Mr. Butz commented on the City’s outstanding debt chart.

(A) Ordinance Considering the City of Rolla Fiscal Year 2018/2019 Budget: CityAdministrator John Butz said the proposed budget is of about $29.4 million and hasincreased slightly from what the Council saw during the recent budget workshop. Herecalled that Councilwoman Eberly discovered a 560.000 error, which has been correctedand incorporated in the agenda materials. Mr. Butz indicated staff projects rcvenuegrowth (taxes) predominantly in the one and one-half to two percent range.
Mayor Magdits opened the public hearing to anyone wishing to address the Counci]concerning the proposed fiscal year 2018/2019 budget. No one present responded.Mayor Magdits closed the public hearing.
City Counselor Carolyn Buschjost read the following proposed ordinance for its firstreading, by title. ORDINANCE: AN ORDINANCE ADOPTING AN ANNUALBUDGET FOR THE FISCAL YEAR BEGINNING ON OCTOBER 1, 2018 ANDAPPROPRIATING FUNDS PURSUANT THERETO.

(A) Celebration of Nations 2018 Update: Mr. Richie Myers, Program Coordinator forInternational and Cultural Affairs at Missouri S&T, expressed appreciation to the City ofRolla for its unending support of the Celebration of Nations event. Mr, Myers reportedthey are stiLl looking for volunteers to work at tlus year’s event, which is scheduled forSeptember 29, 2018.
(B) Rolla National Airport Fly-In. Sept. 15, 8:30 a.m. to 2:00 p.m.: Rolla NationalAirport Manager Darrin Bacon provided an overview of the events that would be takingplace during the Rolla National Airport Fly-In at the Rolla National Airport on Saturday.September 15. He said the Experimental Aircraft Association (FAA) would be ondisplay and flying, and free Young Eagles flights would be offered.

(A) Ordinance Amending Chapter 33 of the Rolla City Code Pertaining to thePolice Personnel Board: City Administrator John Butz stated the subject ordinance ispart of the update of the personnel rules and regulations and provides consistency withother provisions of the City Code. He noted that during the last meeting, Mayor Magditssuggested that Section 33-21 be consistent with the wording regarding the hearingofficer. Mr. Butz said three or four sentences from the personnel rules have beenrepiicated in the proposed ordinance.
City Counselor Carolyn Buschjost read the following proposed ordinance for its finalreading, by title. ORDINANCE NO. 4439: AN ORDINANCE REPEALINGSECTIONS 33-21. 33-22. 33-30. AND 33-36 OF THE GENERAL ORDINANCES OFTHE CITY OF ROLLA. MISSOURI. KNOWN AS THE CODE OF THE CITY OFROLLA, MISSOURI. PERTAINING TO THE POLICE PERSONNEL BOARD ANDENACTING NEW SECTIONS 33-2 1, 33-22, 33-30, AND 33-36 IN LIEU THEREOF.A motion was made by Williams and seconded by Woolley to approve the proposedordinance. (A) Ordinance Changing Name of Part of Eagleson Drive to Silverstone Drive: CityPlanner James Shields explained the subject street is located at the intersection of VichyRoad and thc area between the northeast sides of Lots 1 and 2 of the Arwood Hills No. ISubdivision. It ends at the rim of the cul-de-sac that connects Lots 1,3 and 4 of the RollaSkilled Nursing Home Facility Plat No. 2 from Eagleson Drive to Silverstone Drive. Atthe recommendation of the City, Mr. Greg Spence, owner of Rolla SNF LLC, and whoowns the facility and property, agreed to apply for the street name change in order toprevent confusion for emergency first responders and others turning down the street andcausing unnecessary traffic. Mr. Shields recalled the Council approved Resolution No.1929 that authorized the City to initiate the process of changing the subject-street’s name.He reported no written petitions were submitted to the City; therefore. the City has theauthority to change the name of the street through ordinancc.

(B) Motion Appointing Employer Delegate for the Annual LAGERS Meeting: CityAdministrator John Butz noted the City is a member of the Local Government EmployeesRetirement System (LAGERS). The City spends about $700,000 a year for employeecoverage of their pension. Mr. Butz explained the LAGERS annual meeting is scheduledfor October 25 and 26 in St. Louis, Missouri. In the past, either the Council has avolunteer attend as the employer representative or the Council authorizes him to appointsomeone to serve as the employer representative.
A motion was made by Williams and seconded by Ebery to appoint City AdministratorJohn Butz as the employer representative or authorize him to appoint an alternate toattend the LAGERS annual conference. A voice vote on the motion showed ten ayes.zero nays, and two absent. Motion carried.
(C) Ordinance Amending Sec. 4-4 of the Code — Purchase/Possession of Alcohol by aMinor: Police Chief Sean Fagan told the Council the City’s culTent ordinance states theviolation of this ordinance is up to $500. He noted, however, the State of Missouri hasmandated the fine can he no more than $300 for this charge. Secondly, Chicf Faganrecommended the City’s Code be amended to mirror State Statute regarding purchase orpossession by a minor. He told the Council the Police Department can charge minorswith iurchase or possession, but currently it must be charged under State Statute, whichrequires the officer to appear in Phelps County Court rather than Rolla Municipal Court.Chief Fagan said it is easier for the Rolla officers to go to Rolla Municipal Court ratherthan the County.
City Counselor Carolyn Buschiost read the following proposed ordinance for its firstreading, by title, ORDINANCE: AN ORDINANCE AMENDING SECTION 4-4 OFTHE CODE OF THE CITY OF ROLLA. MISSOURI, PERTAINING TO PURCHASEOR POSSESSION BY A MINOR — PROHIBITED; PENALTY PROVISIONS.
(B) Review Certificate of Substantial Completion — Westside Market Place: CityAdministrator John Butz explained that this item does not require Council action. Henoted Mayor Magdits was authorized to sign this document as part of the developmentagreement. Mr. Butz reported the project is coming in at just over $3 million under whatwas going to be the maximum TIF (Tax Increment Financing) allocation. He said thiswould allow the TIF bond to be paid off early.

(A) Motion Awarding Health Insurance Excess Coverage: Finance DirectorSteffanie Rogers asked the Council to consider a motion awarding the L’itys HealthInsurance Excess Coverage to QBE Renewal and to remain at the current deductible of$75,000. A motion was made by Williams and seconded by Schott to award the bid forthe City’s Health Insurance Excess Coverage to OBE Renewal with a deductible of$75,000. A voice vote on the motion showed ten ayes, zero nays, and two absent.Motion carried.

(A) Open Citizen Communication: Mayor Magdits opened the floor to anyonewishing to address the Council. No one prescnt responded.
IX. MAYORJCITY COUNCIL COMMENTS
(A) Resolution Supporting Missouri Proposition D Pertaining to Fuel Tax: MayorMagdits asked the Council to consider two things before discussing this item. First, heasked thc Council if they wanted to take action at this meeting or wait until they have anopportunity to attend the public presentation by the Missouri Department ofTransportation, which is scheduled for tomorrow. Secondly, he asked the Council if theywant to consider a resolution in the form included in the agenda packets. Mayor Magditssaid he does not personally believe in endorsements, particularly when it comes to a taxincrease. He noted there are communities that will just acknowledge the need for a taxwithout “endorsing” it. The Council would have the flexibility of either endorsing it oracknowledging it. Mayor Morgan informed the Council that the presentation on thisissue would be held tomorrow at 3:30 pin, at Columbia College locatcd on Blues LakeParkway.
The Council’s consensus was to wait until after the presentation to make a decision.
(B) Motion Appointing Councilman Daniel Jones to the Refuse Review Committee:A motion was made by Schott and seconded by Hines to appoint Councilman DanielJones to the Refuse Review Committee. A voice vote on the motion showed ten ayes,zero nays, and two absent. Motion carried.

(E) High Grass; Councilman Williams reminded residents to mow their lawns.mentioned he reported 80 high grass properties to the Codes Department.

(F) Opioid Overdoses: Councilman Jones noted that since thethere have been some incidences of overdoses and opioids in thefirst responders for taking care of those issues because theyfrequently and more than we have ever had to deal with in Missouri

Mayor Magdits called the meeting to order at approximately 6:02 p.m. and then turnedthe floor over to Mr. Jeff Meadows with Archer-Elgin Engineering.
Mr. Meadows explained the scheduled public hearings are required as part of the SRF(State Revolving Loan Fund) financing package. He said he and Public Works DirectorSteve Hargis would be reading verbatim from the prepaied documents. which areincluded in the Council agenda packets. Mr. Meadows told the Council they will hear afew changes in numbers from what is included in the packet, but those will bedocumented before being presented to the Department of Nalural Resources (DNR).
Councilman Crowell questioned why the meeting is being transcribed because it is veryexpensive to do so.

(A) Rolla Fire & Rescue Department Recognition: Warrant Chief Officer—ForensicScientist Kelly Jameson, Fort Leonard Wood, Missouri, recognized the City of Rolla Fireand Rescue Department. the Missouri Division of Fire Safety, and the Rolla Rural FireProtection District for their leadership and assistance in providing arson investigationinstruction to over 120 military warrant officers.

(B) Missouri S&T Homecoming Parade and Pep Rally: Ms. Heather Reynolds withMissouri S&T, informed the Council that the Miner Fest Homecoming Parade wouldheld on October 13, 2018, at 11 am. The parade will take the same route as in the past.She said that this year they are bringing back the tradition of the Homecoming Pep Rally,which will be held on October 12, 2018, in front of the Hasselmann Alumni House from3 p.m. to 5 p.m.
(C) Dog Park Update: Mr. Kent Bagnall, a member of the Dog Park Committee.updated the Council on the flindraising efforts for a dog park in Buehler Park. Heinformed the Council that to date, the Committee has raised $35,359.70 exceeding theirgoal of S30.000. Mr. Bagnall said any fttnds received beyond the cost of fencing wouldbe used for signing, benches, waste stations, watering stations and other dog parkequipment and accessories. The Committee will partner with the City Engineering andParks Department to make these things happen. Mr. Bagnall told the Council the publicfund raising has stopped in deference to the animal shelter project.
111. OLD BUSJNESS
(A) Ordinance Considering the City of Rolla Fiscal Year 2018/2019 Budget: CityAdministrator John Butz said staff is submitting for Council’s consideration, the finalreading of the ordinance approving the $29.4 million expenditure plan with a revenueplan of $28.9 million, with about $500,000 coming from reserves. Mr. Butz indicated a2% growth in sales tax has been budgeted.
City Counselor Lance Thunnan read the following proposed ordinance for its finalreading, by title. ORDINANCE NO. 4440: AN ORDINANCE ADOPTING ANANNUAL BUDGET FOR THE FISCAL YEAR BEGINNING ON OCTOBER 1, 2018AND APPROPRIATING FUNDS PURSUANT THERETO. A motion was made byWilliams and seconded by Jung to approve the proposed ordinance. (C) Ordinance Changing Name of Part of Eagleson Drive to Silverstone Drive: CityPlanner James Shields explained the subject property is the 240-foot stretch of right-of-way that connects Vichy Road to the Rolla Skilled Nursing Home Facility Plat No. 2.The City Council approved Resolution No. 1829, which was posted in the newspaper fora week and no objections to the change were received. The ordinance would change theportion of Eagleson Drive to Silverstone Drive.

(A) Ordinance Amending Sec. 27-89 of the Code Pertaining to Stop Intersections:City Engineer Darin Pryor told the Council that staff has been reviewing the currentordinance to make it in compliance with the signs in the field and to address changes dueto the new Highway 72 extension.
City Counselor Lance Thurman read the following proposed ordinance for its firstreading, by title. ORDINANCE: AN ORDINANCE AMENDING SECTION 27-89 OFTHE GENERAL ORDINANCES OF THE CITY OF ROLLA, MISSOURI, KNOWNAS THE CODE OF THE CITY OF ROLLA, MISSOURI, PERTAINING TO STOPINTERSECTIONS.
(B) Ordinance Amending Sec. 27-66 of the Code Pertaining to Regulation of Speed:City Engineer Darin Pryor said the subject ordnance was spurred due to the setting of thespeed limit for the new Highway 72 extension. At the same time, the entire ordinancewas amended to make the ordinance match signs that are already in place.

(C) Ordinance Amending Sec. 27-88 of the Code Pertaining to Turns: City EngineerDarin Pryor explained the intersection of Salem Avenue and Holmes Lane has a signindicating “no left turn” between 7:45 n.m. and 8:15 am. and 2:45 pm. and 3:45 p.m.He noted this is located near Mark Twain School. Mr. Pryor reported the City received arequest from the school administration and the Police Department to enact an ordinancefor those signs so they begin enforcement.

V. CLAIMS and/or FISCAL TRANSACTIONS
(A) Motion Awarding Bid for Project #476 Dog Park Fencing; Resolution toEnter into a Contract with Robinson Fence Company: Public Works Director Steve1-largis reported staff received bids for the fencing of the Buehler Dog Park. Four bidswere received and All-Type Fence. Inc. was the apparent low hid at S25,616.80.However, the bid bond from All-Type Fence was in the form of a business check. Mr.Hargis told the Council the bid documents require bid bonds be submitted from a suretycompany. Therefore, staff deemed the submittal as non-responsive and cannotrecommend award to All-Type Fence. Mr. Hargis said staff is therefore recommendingthe bid be awarded to the lowest responsive bidder, Robinson Fence Company,Springfield, Missouri, for $27,256.92.
Mr. Hargis indicated that Mr. Brad Cape with All-Type Fence is present to address theCouncil.
Mr. Brad Cape, Alt-Type Fence. Steelville. Missouri. said he submitted a business checkas the bid bond because that is what they have always submitted. He said he has donenumerous jobs and has never obtained a bonding company. Mr. Cape said he has noproblem acquiring a performance and payment bond as the specifications state. He askedthe Council to consider waiving the formality of a bid bond.

(B) Motion Awarding Bid Award for Four 2019 Police Interceptor Utility Vehicles:Police Chief Sean Fagan explained the Police Department obtained bids this year beforethe FY 2019 budget was approved. He told the Council the Police Department received alettcr from Ford. which stated they were discontinuing the Ford Police Interceptorvehicles, which were the cheapest vehicles they could get. Chief Fagan said the reasonfor the discontinuation is that they are going to be making hybrid Ford policeinterceptors. He indicated Ford initially said the Police Department had until September21, 2018. to place the vehicle orders for the Ford vehicles. Chief Fagan stated he hadplanned to ask the Council at this meeting to place the orders. However, a Letter wasreceived saying they were only going to accept orders until September 14. 2018. Sincethat time, the Police Department received a letter from Ford saying the deadline wasmissed. Although, the order was placed, Chief Fagan said there is a 98% chance thevehicles will not be received.
Chief Fagan said he is now recommending purchasing the 2019 Dodge Durango Pursuitvehicles. They are S 1,294 more than the Ford vehicles. However, if the City waits to gowith the new Ford model, it will be $3,000 more each. Chief Fagan said he personallydoes not want to go with a brand new, untested vehicle in our fleet. The City will knowby Thursday if they able to obtain the Fords.

(B) Motion Awarding Bid Award for Four 2019 Police Interceptor Utility Vehicles(continued): A motion was made by Hines and seconded by Jones to award the bid tothe low bidder Lou Fusz Ford (State bid) for $131,912 for four new 2019 Ford PoliceInterceptors, but if in the absence of that award within the next two weeks, the bid wouldbe awarded to Lou Fusz Dodge (State bid) for $137,088 for four new 2019 DodgeDurango Pursuit vehicles. A voice vote on the motion showed twelve ayes, zero nays,and zero absent. Motion carried.
VI. MAYOR/CITY COUNCIL COMMENTS
(A) Consider Resolution Acknonledging/Supporting Prop. D (Nov. 6th)— NIoIJOT
Transportation Funding: Mayor Magdits recalled the Council discussed Prop. Dduring its last meeting and last week the Missouri Department of Transportation(M0DOT) conducted a presentation on Prop. D. He noted two resolution options areincluded in the agenda materials and they are similar in the way they are written. Oneresolution indicates support for Prop. D and the other resolution acknowledges that ifProp D passes, there is a benefit to Rolla, Missouri.
Councilman Woolley also commented a third option would be to do nothing.
After discussion, a motion was made by Schott and seconded by Jones to approve theSample 1 (supporting) resolution. A hand count on the motion showed six ayes, six nays,and zero absent. Mayor Magdits broke the tie by voting “nay.” Motion failed.

VIII. COMMENTS FOR THE GOOD OF THE ORDER
(A) Constitution and Citizenship Day: Mayor Magdits noted that today. September17. is Constitution and Citizenship Day. Today marks the 231 anniversary of thedrafting of the U.S. Constitution and its signing. Mayor Magdits said Constitution Daywas first recognized by an Iowa school district in 1911. In 2004, Congress passed a lawadding to it and detennining it to be Constitution and Citizenship Day. He stated that oneof the things the act has mandated is that all public education institutions and federalagencies provide educational programs on the history of the constitution. Mayor Magditstold the Council the Daughters of the American Revolution each year request aproclamation.
(B) Boo-Palooza: Councilwoman Henry asked for volunteers from the Council to helppass out candy at City Hall during Boo-Palooza, the downtown festival on Halloween.
(C) Rolla National Airport Plane: In response to a question from CouncilmanWilliams, City Administrator John Butz said the issue with the plane a few days ago wasnothing more than a problem with the landing gear. No injuries were reported.

(D) Rolla National Airport Fly-In: Mayor Magdits reported there was tremendousgroup of people at the Airport on Saturday, September 15, during the Fly-In.
City Administrator John Butz added that over 1.000 people attended. The City is hopingto sponsor this event every year.

II. REPORT ON RECENT CITY COUNCIL ACTIONS:1. A request to rezone a 0.99-acre portion of Tract A of the Joyner Estates Subdivision,
which is also known as 1335 Thomas Drive, from the Rural Residential District (R-R)to the Single-Family District (R-l). On August 6,2018, the City Council conductedthe final reading of this ordinance and approved it.
(Moutray)2. A request to, through the subdivision process, reconfigure the boundary lines of the
four deeded parcels, one of which is located in Joyner Estates Subdivision and two ofwhich are within the Wild Horse Run Plat No. I Subdivision, that are identified by theirPhelps County Assessor Account Numbers of 10954.01, 10654.47, 10954.20. and10954.19, On August 6, 2018, the City Council conducted the final reading of thisordinance and approved it.

35 feet of Lot 4 of Block 5 of the Frisco Subdivision into one 0.29-acre lot. On August6, 2018, the City Council conducted the final reading of this ordinance andapproved it.
(Equinox)4. A resolution to initiate the process by which the City of Rolla would change the name
of the street that begins at the intersection of Vichy Road and the area between thenortheast sides of Lot 1 and Lot 2 of the Arwood Hills No. 1 Subdivision and ends atthe rim of the cul-de-sac that connects Lot 1, Lot 3, and Lot 4 of the Rolla SkilledNursing Home Facility Plat No. 2 from Eagleson Drive to Silverstone Drive. On July16, 2018, the City Council conducted the fInal reading of this resolution andapproved it.

III. PUBLEC HEARING:
1. A request to approve the Declaration ofCovenants and Restrictions and the PreliminaryPlat ofSt. Maria’s Tatandra. which is a plat that divides an approximately 42-acre tractof land (AKA parcel 12081) that is located in Rolla, Missouri. and is a fractional partof the west half of Lot I of the Northwest Quarter of Section 6. Township 37, Range?West, into 58 lots and 4 outlots.

James Shields explained the subject property is located Phelps County. approximately250 feet north of the intersection of Liberty Drive and McCutchen Drive. The applicantis St. Maria’s LLC. The registered agent is Mike Woessner. This piece of land wasrecently annexed, zoned R-3, and a Development Agreement was approved. It will hea 58 residential lot subdivision with a maximum of 4 units per lot. The maximumnumber of lots is 232, which is about 5.5 units per acre in gross density.
It includes commonly-owned property that will be maintaincd by a homeowner’sassociation. Amenities include a clubhouse, a dog park, and open space. TheDevelopment agreement defines developer’s costs and limits density
The application was checked for complcteness and the Preliminary Plat was reviewedby City Departments and utility entities. The Development Review Committee meetingwas held and plat reviews were requested and a revised Preliminary Plat was submitted.The Planning and Zoning Commission will review the Preliminary Plat and makerecommendations to the City Council where there will be a Public Hearing. The CityCouncil will review the Preliminary Plat and decide through a Resolution to approve,deny, or conditionally approve it. The applicant has one year to submit a Final Plat.When submitted, the Community Dcvelopment Director will determine SubstantialConformity. If Substantial Confonnity exists the Final Plat will go to City Council forPublic Hearing and 1St Reading. The Final Reading will be conducted at the followingmeeting. If Substantial Conformity does not exist the Final Plat must be reviewed againby P&Z before going to City Council for Public Hearing and l1’Final Readings.
Covenants & Restrictions must be approved before any Final Plat is recorded. St.Maria’s has submitted the revisions that have been made, and no more revisions arerequested. Development Plans have been submitted for review, comments have beenmade and we are awaiting revised plans. Development plans must be accepted byPublic Works and RML before City CounciL Approves. Parkland Fees must be paidbefore recording Plat.
STREETSProjection of Streets, Dead-Ends: While the development only has one pointof ingress/egress using a public street, with the approval of the Fire Chief, itwas agreed that a secondary fire access will be permitted to connect the dead-end to Liberty Drive. This provision is detailed in item 8(A) of the Development

Agreement. A Variance for the line item in the development agreement has beenrequested.Subdivision into Tracts Larger than Ordinary Building Lots: While largetracts were created, these tracts are not to be developed as residential lots. Thesetracts are to be used for either natural areas, a dog park, or a communitycenter/clubhouse.Street Grades: On Road Profile A of the first draft of the Development Plans,there is a 400-foot stretch of road that exceeds the nine percent maximum gradefor minor roads (approx. 11%). The Engineer and Fire Department are okaywith granting variance.
• Street Names: The street names will be St. Maria, St. Mathew, and St. Michael.No such names exist in Rolla.
LOTS• Dimensions: A new drafl of the plat that was submitted shows the correct
setbacks. However, the applicant would like to be adjust which street-facingside of the lot is the front and which is the side as the buildings are constructed.A variance is requested for this. Section 42-210.4(c) states that “Where anirregularly shaped lot has more area than required for its particular district, lotwidth may he computed at the most usable porlion of the lot”. There are six culdc-sac lots that have only 50-foot frontages and in R-3 there should be 75 footminimum.
• Location: As one can see, the original Outlot C was dissolved into thebackyards. The only landlocked lot on the revised plat is Outlot C, the dog parklot. There are two 15-foot wide sidewalk and utility easements and one 15-footsidewalk casement into this lot. The sidewalks will be paved. The Fire Chiefwas satisfied with access to lots. Notes on plat, as indicated in report. are nolonger needed.
UTILITIES• Revised Covenants and Restrictions: Section 8.9 was slightly altered to
clarify who will be providing the water. RMU is still discussing the necessarysize of the easements that will be needed to accommodate water infrastructureand the water main layout. The size of the utility easements may change on theFinal Plat. The water main layout will be approved through the acceptance ofthe Final Development Plans.
SUBDIVISION IMPROVEMENTS:• Streets and Alleys: The City will construct a roundabout and improve
McCutchen Drive along the development, except that the Developer willreimburse the City for such improvements with a $44,040 payment for curb andsidewalk and a payment of $4,497 for storm sewer.
• Sidewalks: Sidewalks are being provided in excess of minimum requirements(e.g. provided on cul-de-sac streets, 5-foot sidewalks instead of 4-footminimum).
• Fire Hydrants: The location of Fire Hydrants is still being discussed with theDeveloper.

o In actuality, they are asking for the front lines of corner lots to be definedin an alternative way and that this determination be made by thedeveloper at the time of application for building pennits. Section 42-26.6 (1). Lots, Dimensions: “.. Building area lines shall be shown toestablish required setback distances”.
o Staff asks that if a variance is given to the applicant to choose whichside of the lot is the front that a condition be that the building area linesbe left off of the preliminary Plat for corner lots.
• A variance from the requirement for all subdivisions of 25 lots or more toprovide two means of egress!‘ingress with a public street. Instead, the developerwill provide a secondary access to the development through a private, gated 20-foot gravel secondary emergency access road.
o Section 42-26.2(3). Streets, Projection of Streets. In the DevelopmentAgreement

Man Crowell said Sec. 42-24, states “No application for preliminary plat would createconditions requiring a variance or exception from zoning regulations by the Board ofAdjustment. shall be submitted to the Commission unless and until the applicant’s

petition for a variance or exception shall have been first approved by the Board ofAdjustment”. He asked if these variances have been approved by the Board ofAdjustments. J. Shields told him Sec. 42-24.2 talks about building lines and similarstandards. “No application for preliminary plat would create conditions requiring avariance or exception from zoning regulations by the Board of Adjustment” that means,at the time building permit application would there be anything on this plat that wouldrequire going to the Board of Adjustments. If you give them the variance for thebuilding setbacks for the corner lots, that would not require them to go to the Board ofAdjustments. Board of Adjustment is for individual tracts: this is for a whole area ofthe City. Adjusting the setback lines would not cause them to go to the Board ofAdjustments. Mr. Crowell asked if the Board of Adjustment has seen this. J. Shieldsanswered no. Mr. Brown stated the Planning and Zoning Commission has the abilityto approve, deny or approve with conditions. He would think this is approving withconditions. J. Shields said he is asking for the condition they remove the building linesbefore it gets approved because, they don’t want the setback lines to he contradictoryto the building permit application. Russell Schmidt asked if the City is authorizing thecovenants or is the developer. J. Shields answered they are approving it, but the Cityis not forcing them into a contract. Mr. Brown added it also says, “The City of Rollashall assume no responsibility for the enforcement of private covenants”. Mr. Schmidtasked if someone builds a four plex at the end of the cul-de-sac where there is only 50feet, how would it affect the number of vehicles and the access into that. Mr. Schmidtreplied only ten feet is required for each car. There will only be two garages. If it is 50feet then only two ten foot spaces are needed.

He is the Civil Engineer on the project. The necessary reasons for the request are:• The first variance was for the maximum street grade. This is dictated by the
topography in the NE corner of the side. There is approximately 2,500 linearfeet of public roads in this development. Because of the topography there areseveral hundred feet that are currently wooded. These will be individuallyowned lots. Maximum grade is just under 12%.
• The second variance is the definition or the applicability of the front yard andside yard setback. There are some lots that are relatively square and thedifference between the front and side yards is just a few feet. The buildingorientation has always defined what the front yard is. The short side would bethe front yard. In the case of Lot 26, for example, it doesn’t make sense for afront yard to be on a dead end street. The reason they left that open ended andallow individual lot owners to define that is because there are some cases wherethe topography to the side would lend itself pretty well for the front yard to face

either the cul-de-sac or the main street. By approving the variance the setbackswould be removed on the individual lots on the final pInt.
• There will be a Knox Box at the secondary access and the Fire Department willhave a key to that for emergency purposes.
• Most of the time Board of Adjustment takes issues with previously platted lotsthat have previously defined setbacks and conditions associated with them.They are looking at a case by case hardship rather than a new subdivision that’sbeing platted for the first time.
Mr. Brown asked for any questions. Seeing none he officially closed the PublicH earing.
J. Shields asked that the variance be stated on the plat and the building setback linesbe removed. The City Council may elect to conduct an independent review of anyvariance request, and may grant, reverse, modify, or affinn the decision of theCommission based on the conditions for variance approval. Mr. Brown asked if thiswould apply to the whole project. J. Shields replied only the corner lots.
lIr. Crowell said he is supportive of what they are doing and he thinks it’s a goodproject. He doesn’t want to unreasonably delay it. but he feels the way the Ordinanceis written it should first go to Board of Adjustment even though it’s not what we feel itshould do. He doesn’t feel they arc abiding by the requirements of Sec. 42-24 as itrelates to variances. He doesn’t see how they can get around the words “...shall havebeen first approved by the Board of Adjustment”. J. Shields replied it wouldn’t createconditions requiring a variance. Mr. Brown stated he doesn’t see why you would needa variance for something that is nonexistent. Mr. Crowell told him he doesn’t disagree,but he thinks this is a problematic law. Mr. Shields informed them they could do a textamendment. Maybe corner lots shouldn’t be defined in that way when you doing awhole new subdivision. Mr. Crowell said he thinks that would be a good idea.

J. Shields explained administration recommends that the City of Rolla adopt an entirelynew Official Zoning Map that locates any section of rights-of-way (ROW) that is within250 feet of an existing restdential zoning district in the single-family. The percentageof ROW being zoned R-l (approx. 58%) is similar to the percentage of land zonedresidential in Rolla (approx.51%). This action is being proposed to address thenumerous changes in law that affect use of the ROW. The most recent change willftirther affect the use of the City’s ROW in certain areas on August 28. Through theCity’s zoning regulations. the City has in place use. bulk, and height restrictions thatcould be used to preserve the residential character of the City’s neighborhoods byensuring that ROW that are near those neighborhoods reflect their residential character.
There have been no comments on this request. The action requested from the Planning& Zoning Commission is to recommend the approval, denial, or conditional approvalof the applicant’s proposal to designate sections of the City of Rolla’s rights-of-way asthe Single-Family (zoning) District (R-l) by adopting the attached version of theOfticial Zoning Map.
Mr. Schmidt asked for an example of where this is going to have an effect. J. Shieldstold him along Hwy. 72 there is a lot of residential houses in between some of thecommercial areas, such as the Dollar General Store, and Hwy. 63. This will helpregulate what is in the ROW. a little more. He doesn’t understand why they need zoning in ROW’s. because theycannot build in them. J. Shields told him they can’t build in them. but they can controlthe height of structures, the appearance, etc. All we can do right now is limit the heightof structures, hut in the future the City can put in additional regulations that can regulatethe appearance of an object. Mr. Anderson asked what object would be in the ROW.J. Shields told him things like small cell antennas, communication towers, mailboxes.etc.

They are doing it to ensure zoning the ROW does not unnecessarily affect otherzoning regulations and the proper use of the ROW. staff recommends adding thefollowing language to Section 42-142(j) of the Rolla City Code:

Zoned Rights-of-Way: No use otherwise authorized in the respective zoning districtshall be permitted in the rights-of-way that is not specifically authorized by the City’srights-of-way regulations, specifically Chapter 36 of the Rolla City Code. Anyprovision of this Article that refers to being adjacent to, abutting, or within a certaindistance of a residential zoning district or property zoned residential does not apply ifthe adjacent, abutting, or nearby zoning district or property is the City’s rights-of-way.
There have been no comments or any protest petitions filed. The action requested fromthe Planning & Zoning Commission is to recommend the approval, denial, orconditional approval of the applicant’s proposal to amend Article III of Chapter 42,which is known as the Rolla Planning and Zoning Code, by adding language thatpertains to the use of rights-of-way that are located within a zoning district.
Mont Jordan asked if the new language will help with the changes coming to Chapter36. J. COMMENTARY:
Fees for services provided by the Environmental Services Department were last adjusted in2014 (effective Jan. 1,2015). Prior to that, rates had not been increased since 2002. Since the timeof the last increase, almost every aspect of operations has increased in cost. In addition to increasesin general operating costs overall, a couple of current issues will cause budgetary concern. Theseinclude the need for additional manpower (two new positions added for FY20 18-19) andsignificant revenue loss from recyclables sales (due to market conditions).
The possibility of a rate increase was discussed with the Refuse Service Review Committeeprior to approval of the new budget and the Committee was supportive of moving forward.Operating as an enterprise thnd requires a sufficient revenue stream and a stable find balance. Assuch, periodic rate increases are to be expected.
An increase in primary services for residential and commercial customers is being proposedwith an effective date ofjanuary 1,2019. Proposed increases are within the 5%-lO% range. Acopy of the proposed changes and accompanying ordinance are attached.

NOW. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFROLLA, MISSOURI AS FOLLOWS:
Section 1: That Section 18-16(a) of the Code of the City of Rolla. Missouri. is herebyrepealed and a new section enacted in lieu thereof as follows:
Sec. 18-6. Service charge rates for residential refuse collection.
(a) Each residential refuse customer shall pay to the City a service charge of$ 12.75per month for the weekly collection of the contents of each 35-gallon container, allacceptable yard wastes in biodegradable bags. and all specified recyclables. Eachresidential refuse customer shall pay to the City a service charge of S 15.25 permonth for the weekly collection of the contents of each 90-gallon container, allacceptable yard wastes in biodegradable bags, and all specified recyclables.
Section 2: That Section 18-25 of the Code of the City of Rolla, Missouri, is hereby repealedand a new section enacted in lieu thereof as follows:
Sec. 18-25. Service charge rates for commercial refuse collection.
Each commercial refuse customer shall pay to the city a service charge forcollection as follows:
(a) Each commercial refuse customer shall subscribe to one of the following servicelevels and pay monthly to the City the following service charge(s) for thecolTesponding container and frequency of service:

(c) Customers utilizing the Citys construction/demolition container service shallpay to the City a rental charge of $5.00 per day (Monday through Friday) plus acharge of $100.00 per pull plus appropriate landfill or transfer station tipping feesfor each open top roll-off container. There shall be a minimum of one pull chargedper month per box.

(d) Each customer shall pay to the City, a rental charge of $5.00 per day (Mondaythrough Friday) for use of each 4-yard container, plus a charge of$80.00 each timea 4-yard container is emptied. and, each customer shall pay to the City, a rentalcharge of $5.00 per day (Monday through Friday) for use of each 6-yard container.plus a charge ofSl 10.00 each time a 6-yard container is emptied. There shall be aminimum of one empty service charged per box per month.
(e) Each customer shall pay to the City a service charge of $115.00 per pull forstandard units, and SI 30.00 per pull for units requiring double handling to turn theunit around, plus appropriate landfill or transfer station fees for each hydraulicallyoperated roll-off compactor.
(f) Each customer requesting to have the City haul regulated waste shall pay theestablished container fees as specified in Section 18-25 herein as well as all otherapplicable disposal fees in addition to a 5250 per mile transportation fee.
(g) Each customer shall pay to the City a fee of $50.00 to have a roll-off orconstruction/demolition container relocated at the customer’s request.
Section 5: That this ordinance shall be in fill force and effect with the billing on or afterJanuary 1, 2019.

Whereas, the City of Rolla is submitting an application for 2018 Missouri TransportationAlternatives Program funds for Rolla ADA Accessibility Improvements, Phase III with an estimated totalcost of $132,000.00; and,
Whereas, the City of Rolla is requesting Missouri Transportation Alternatives Program funds inthe amount of$105,600.00 representing 80% of total estimated project costs; and,
Whereas, the City of Rolla acknowledges availability of the required local match of 20% and theavailability of ftmds to pay all costs up front, as Transportation Alternative Program is a costreimbursement program; and,

2. Laterals, if encounterd, that can be positively identified (with the camera) as plugged,will not be reinstated. All other laterals will be opened unless otherwise directed inwriting by the owner.
3. To the extent permitted by law and in accordance with the terms of this contract,Contractor shall indemnify and hold harmless the Owner, Architect/Engineer, andagents and employees of any of them from and against claims, damages, losses, andexpenses including but not limited to attorneys’ fees, arising out of or resulting front thework performed by Contractor, save and except any economic losses not related tobodily injury, sickness, disease or death, provided that such claim, loss or expense isattributable to bodily injury, sickness, disease, or death, or to injury to or destruction oftangible property excluding economic loss or use thereof (other than the work itself),but only to the extent caused in whole or in part by negligent acts or omissions ofContractor, anyone directly or indirectly employed by it or anyone for whose actsContractor may be liable, regardless of whether or not such claim, damage, loss orexpense is caused in part by a party indemnified hereunder.
In claims against any person or entity indemnified under this paragraph by anemployee of Contractor, anyone directly or indirectly employed by it or anyone forwhose acts Contractor may be liable, the indemnification obligation under thisparagraph shall be limited by a limitation on the amount or type of damages,compensation or benefits payable by or for Contractor or its subcontractors underworkers’ compensation acts, disability benefit acts or other employee benefit acts.
The obligations of Contractor under this paragraph shall not extend to the liabilityof the Owner, Architect/Engineer, Architect/Engineer’s consultants, and agents andemployees of any of them arising out of (1) the preparation or approval of maps,drawings, opinions, reports, surveys, change orders, designs or specifications, or (2) thegiving of or the failure to give directions or instructions by the Owner,Architect/Engineer, Architect/Engineer’s consultants, and agents and employees of anyof them.
4. LIMITED WARRANTY. IN LIEU OF ALL OTHER EXPRESSED, IMPLIEDAND/OR STATUTORY WARRANTIES, INCLUDING WARRANTIES OFMERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,CONTRACTOR AGREES TO CORRECT ANY DEFECTS IN THE MATERIALSOR SERVICES PROVIDED BY CONTRACTOR WHICH ARE BROUGHT TO THEATTENTION OF CONTRACTOR WITHIN ONE YEAR FOLLOWINGCOMPLETION OF CONTRACTOR’S WORK, PROVIDED OWNER AFFORDSCONTRACTOR SUITABLE ACCESS AND WORKING CONDITIONS TOACCOMPLISH SUCH CORRECTION.
5. MUTUAL RELEASE OF CONSEQUENTIAL DAMAGES. Neither party shall beliable to the other for consequential damages relating to or arising out of the Contract.
6. Any restrictions in onr normal weekday work hours required by local, state, and/orfederal authorities (due to noise restrictions or other reasons not known at the time ofthis proposal) will be an extra charge.

CONTRACT AGREEMENT
THIS AGREEMENT, made and entered into this

by andbetween the City of Rolla. Missouri, Party of the First Part and hereinafter called Owner, and
Pierce Asphalt, LLC Party of the second Part andhereinafter called the Contractor.
WITNESSETH:
THAT WHEREAS, the Owner has caused to be prepared, in accordance with law, specifications,plans, and other Contract Documents for the work herein described, and has approved and adoptedsaid documents, and has caused to be published and advertised for and in connection with theconstruction of: 2019 Phase I Asphalt Improvements, PROJECT #477, in complete accord withthe Contract Documents and the said plans and specifications; and
WHEREAS, the said Contractor, in response to such advertisement, has submitted to the Owner.in the manner and at the time specified. a sealed proposal in accordance with the terms of saidadvertisement; and
WHEREAS, the Owner, in the manner prescribed by law, has publicly opened. examined andcanvassed the proposals submitted in response to the published invitation therefore, and as a resultof such canvass has determined and declared the aforesaid Contractor to be lowest and best bidderfor the said work and has duly awarded to the said Contractor a contract therefore, for the sum orsums named in the Contractor’s proposal, a copy thereof being attached to and made a pail of thiscontract.
NOW THEREFORE, in consideration of the compensation to be paid to the Contractor and of themutual agreement herein contained, the parties to these presents have agreed and hereby agree, theOwner for itself and its successors, and the Contractor for itself, himself, or themselves, or its, hisor their successors and assigns, or its, his, or their executors and administrators, as follows:
ARTICLE I. That the Contractor shall (a) furnish all tools, equipment, supplies, superintendent,transportation, and other construction accessories, services and facilities; (b) furnish all materials,supplies, and equipment specified and required to be incorporated in, and form a pernmnent partof the completed work except the items specified to be furnished by the Owner; (c) provide andperform all necessary labor, and (d) in a good, substantial, and workmanlike manner. and inaccordance with the provisions of the General Conditions and the Special Conditions of theContract, which are attached hereto and made a part hereof, and in conformity with the ContractPlans and Specifications designated and identified therein, execute, construct, and complete allwork included in, and covered by the Owner’s official award of this Contract to the said Contractor.such award being based on the acceptance by the Owner of the Contractor’s proposal, for theconstruction of 2019 Phase I Asphalt Improvements, PROJECT #477.
EXHIBIT A
It is further stipulated that not less than the prevailing hourly rate of wages as found by theDepartment of Labor and Industrial Relations of the State of Missouri, or determined by the Courtof Appeal shall be paid to all workers performing work under this Contract.
ARTICLE II. Contractor acknowledges that Section 285,530. R.S.Mo, prohibits any businessentity or employer from knowingly employing, hiring for employment, or continuing to employan unauthorized alien to perform work within the State of Missouri. Contractor thereforecovenants that it is not knowingly in violation of Subsection 1 of Section 285.530, R.S.Mo, andthat it will not knowingly employ, hire for employment, or continue to employ any unauthorizedaliens to perfonn work on the Project, and that its employees are lawfully eligible to work in theUnited States.
ARTICLE III. Occupational Safety and Health Administration (OSHA)Safety Training:a. Contractor shall provide a ten (10) hour Occupational Safety and Health Administration
(OSHA) construction safety program for all employees who will be on-site at the project.The construction safety program shall include a course in construction safety and healththat is approved by OSHA or a similar program approved by the Missouri Department ofLabor and Industrial Relations which is at least as stringent as an approved OSHA programas required by Section 292.675, RS.Mo.
b. Contractor shall require its on-site employees to complete a construction safety programwithin sixty (60) days after the date work on the project commences.
c. Contractor acknowledges and agrees that any of Contractor’s employees found on theproject site without the documentation of the successful completion ofa construction safetyprogram shall be required to produce such documentation within twenty (20) days, or willbe subject to removal from the project.
d. Contractor shall require all of its subcontractors to comply with the requirements of thisSection and Section 292.675, R.S.Mo.
Notice of Penalties for Failure to Provide Safety Traininga. Pursuant to Section 292.675, R.S.Mo, Contractor shall forfeit to City as a penalty two
thousand five hundred dollars (S2,500.00). plus one hundred dollars (S 100.00) for each on-site employee employed by Contractor or its Subcontractor, for each calendar day, orportion thereof, such on-site employee is employed without the construction safety trainingrequired in Safety Training section of Article Ill above.
b. The penalty described in above subsection A of this section shall not begin to accrue untilthe time periods described in Sections B and C Safety Training of Article III above haveelapsed.
c. Violations of Article Ill — Safety Training above and imposition of the penalty describedin this Section shall be investigated and determined by the Missouri Department of Laborand Industrial Relations.
ARTICLE IV. That the Contractor shall construct and complete the work designated anddescribed in the foregoing proposal and attached specifications in accordance with the Notice toBidders, Instruction to Bidders. Proposal, Bond. General Conditions, Special Conditions,Technical Specifications, Drawings, Addenda, and other component parts of the Contract

ARTICLE V. That the Owner shall pay to the Contractor for the performance of the workdescribed as follows: Complete construction of the improvements in accordance with plans andspecifications; and the Contractor will accept as hill compensation therefore, the sum (subject toadjustment as provided by the Contract) of $200,740.90 for

ARTICLE VI. That the Contractor shall begin assembly of materials and equipment within ten(10) days after receipt from the Owner of executed copies of the Contract.
Liquidated Damages - Should the contractor fail to complete the work on or before the completiondate specified the contractor will be charged liquidated damages in the amount of $100.00 percalendar day for each full calendar day that the work is not hilly completed. Liquidated damageswill not he cliargcd for weekends and holidays.
ARTICLE VII. Beforc the final payment can be made to the Contractor on the project, theContractor must complete and return the Affidavit Compliance with the Prevailing Wage Lawform furnished at the end of the Special Conditions section.
ARTICLE VIII. Before the final payment can be made on the project to the Contractor, theContractor must complete and return the Contractor’s Affidavit Regarding Settlement of Claimsfonn furnished at the end of the Special Conditions section.
ARTICLE IX. This Contract will not be binding and effective until confirmed by the Owner.
