Violation & Elimination - Bright Star Ind~stries,600 Getty Avenue, Clifton, N.3.December 16, 1975 - July 3, 1976 (J. Parr)
On November 7, 1975, PVSC received notification fromNJDEP of their intention to certify the discharges from BrightStar Industries, Clifton, N.J., in conjunction with theirapplication for a NPDES Permit. Since PVSC routinely in~vestigates these discharges in order to comment on them ifnecessary, Inspector Parr was directed to check and samplethe outfa11s that discharge to Wabash Brook, a tributary ofthe Passaic River. On December 16 a sample was taken fromthe two lines. Outfall '001 was non-polluting, but Outfall#002 (boiler blowdown) had a pH of 11.6 and a C.O.D. of 284mg/l. On December 19, Mr. D'Ascensio called Mr. E. Weber, Vicepresident, Operations, who stated that his Maintenance super-intendent, Mr. V. Baksa, had the latest information but was onvacation until January 5, 1976.
since the volume of the discharqe from the outlet wasvery small (68 qal/day), the matter was held in abeyance untilthe return of Mr. Baksa and an appointaent was made to meet onJanuary 5, 1916. Meanwhile USEPA was requested to send a copyof the Draft Permit to PVSC.
On January 23, 1976, Mr. E. M. Weber, Vic~ President ofOperations, wrote to PVSC informing that they intended to con-nect Oischarge 1002 into the sanitary sewer. He stated thatthey intended to complete this by July 23, 1976. Although thiswas a small pollution, PVSC felt that this could be done soonerand had so informed Bright Star.
On March 12, Mr. Weber wrote to Mr. O'Ascensio and includedcopies of letters from Bright Star to USEPA and NJDEP. In theseletters Mr. Weber adaitted that a third occa_ional discharqe hadbeen discovered by PVSC and that Bright star felt the bestsolution was to eli.inate all three outlets to wabash Brook.They expected to have this work completed by May 24, 1976.
On April 29, 1976, Mr. Weber, Vice President of Bright Starinformed USEPA and PVSC that as of April 15, the steam condensatehad been routed back to the boiler room, eliminating outlet 001;the boiler b1owdown had been rerouted into the municipal sewerwith outlet 002 capped; and the third discharge had been sealedand is no longer discharging into Wabash Brook, thus eliminatingall three outlets.
However, the boiler b10wdown tank developed a leak whichpermitted about 5 to 7 gallons of liquid per day to seep into theground and presumably into Wabash Brook. Since the tank was buriedand, due to its aqe and condition, would be difficult to repair,it would be replaced. They estimated the installation of the newtank to be about June 21.

On June 28 Mr. Weber wrote to Mr. D'Ascensio and encloseda copy of a letter to USEPA wherein he stated that the vendordid not deliver the new tank on time and they were unable tomeet the June 21 date for elimination of the pollution. Hestated that Bright Star anticipated that the tank would be in-stalled i~ early July.
Inspector Parr inspected the plant on July 3 and observedthat the new tank was being installed. By 3:45 p.m. the in-stallation was complete and the violation was eliminated.

On Saturday, February 21, 1976, a call was received fromthe Nutley Police Department about red dye in Nichols Pond.Operator Terry Richardson called Supt. L. Cuccinello at 12:30 p.m.,who contacted Inspector R. Goldstein, and both proceeded toNichols Pond, which they found to be bright red. Thev tracedthis upstream to Allwood Brook and a culvert coming from underAllwood Road, Clifton. They continued to trace the red colorpast a series of catch basins to the rear of the BrookdaleBeverage Co. They went to the office and found the buildingclosed. They then went to an outlet store of this company atIndustrial West and the manager called the owner, Mr. JosephPieretti, Sr., via the telephone, who stated he was bedriddenand requested the inspectors come to his house.

.nAt the home, his son, Mr. J. Pieretti, Jr., explained
that they had a laborator1 on the second floor with a largestainless steel sink which leads to a floor drain, thence to a6-inch pipe that eapti•• into the yard catch basin thence toAllwood Brook. When recent Federal Regulations banned the useof Red Dye .2, he told an employee to get rid of what he claimedwas about two pounds of Red Dye 12 in powder form. The employeeat 5:30 p.m. on Friday, February 20, 1976, mixed the powder with25 gallons of water and dumped it into the laboratory sink, andit went to the storm sewer system. They were informed that thiswas illeqal, and, in faet, the connection fro. inside the build-inq to the storm sewer was illegal, as it could carry pollutingmaterial and thus required a NPDES Permit which they didn'thave.
Supt. Cuccinello, Inspector Goldstein and Inspector Parrwent to the plant on Monday, February 23, and they were shownby the General Manager, Frank Liscio, Jr., the sink and thepiping to the stor. sewer. Supt. Cuccinello directed BrookdaleBeverage Co. to reconnect the system into the sanitary sewer.
