ACCOUNT BRANCH
Board approves the budget expenditure for the year 2017-18 as per figure /expenditure presented to the Board by the secretary / Branch subject to fulfillmentof following. However, board has following observations and Board directions:-
a. Observation regarding development projects as highlighted by wardmembers be rectified and briefed to the Board.
b. Necessary actions as per CB Rules be taken against contractors who havenot executed the development works as per standard.
c. Ground performance of Horticulture branch needs improvements.
d. The court of Inquiry to be initiated to find out cause of damage of 8 x newlypurchased bush cutters purchased vide CBR No. 13 dated 27-06-2017
e. Due taxes / charges to be recovered alongwith arrears.
f. Carried over development works to be completed on priority.

To consider an application dated 14-07-2018 submitted by Sheikh Zamir Hussain AdvocateSupreme Court of Pakistan regarding payment of Rs 3,50,000/- (Rupees three lacs fifty thousand only) onaccount of payment of professional fee and miscellaneous charges as his services have been hired by thisoffice for filing of review petition in Supreme Court of Pakistan against the orders passed by Lahore HighCourt Rawalpindi Region Rawalpindi in a case titled Cantt Board Wah Vs Malik Naseem Haider. The caserelates with Govt. land land grabbers situated Moza Wah (New Lala Rukh) and Ch. Muhammad YaqoobCLA CB Wah strongly recommended to file CPLA before Supreme Court of Pakistan.

To consider an application dated Nil submitted by Ch. Sarwar Mahmood, Assistant Secretary CantonmentBoard Wah for self-hiring of ground floor of House No. 6, Street No. 1, Sector C, DHA-II, Islamabadowned by his wife w.e.f 17th August 2018 to 31-08-2019.
In this connection, it is brought into the knowledge of the Board that Ch. Sarwar Mahmood AssistantSecretary is working in BS-18 and according to rates of rental ceiling for hiring of residentialaccommodation at Islamabad is 28,574/- per month fixed by the Government of Pakistan, Ministry ofHousing and Works, Islamabad vide O.M No. F.4(8)/92-Policy dated 05 th June 2018. The expenditure ofRs. 28,574/- per month will be met out of Budget Head A-5 for which provision exists.

It is pointed out that the contract for collection rights of Parking fee situated at POF Hospital, BarrierNo.2 and Nawababad (outside) was auctioned for a period of (10) Months w.e.f 01st September 2018 to30th June 2019 held in the office of Cantt Board Wah on 27 th August, 2018 in the presence of Mr. AmjadMehmood Kashmiri Vice President, Mr. Muhammad Kamran Akbar. Asstt Secretary and RevenueSuperintendent after wide publicity in daily “Express Rawalpindi and daily “Jang” Rawalpindi dated 14 th
August, 2018 and PPRA website as to ensure the transparency and healthy competition. The said auctionproceedings were attended by 9 x bidders / parties participated in the said auction proceedings out ofwhich following parties offered their bids as mentioned against each: -

REVISION OF RATES OF LAND TO DETERMINE VALUE OF PROPERTY FORCALCULATION OF TIP TAX
Reference CBR No. 04 dated 28-09-2017.
To consider and approve the revision of rates of land to determine value of property for calculation ofT.I.P Tax based on actual market value in different areas/localities of Wah Cantonment w.e.f. 1st July,2018 to 30th June, 2019. The DC Rates have been received from the Office of the District CollectorRawalpindi. The rates in Cantonments are to be revised minimum by 5% annually as per instructions ofML&C Deptt vide letter No. 55/11/Lands/ML&C/2003 dated 22-11-2003. Board has previouslyenhanced the rates of TIP Tax @ 5% on existing rates of CB for the year 2017-18 or 5% on the DC ratesfor the year 2017-18, whichever is on higher side.
It is recommended that the enhancement may be made @ 5% on existing rates of CB forthe year 2018-19. The proposed rates are as under: -

To consider and approve the lowest rates offered by Supply of medicines for CB dispensaries ondiscount-cum-rebate basis in retail prices of the medicines for which quotation were invited vide thisoffice letter No.VI/G-8-C/436/79 dated 23.07.2018. The said quotation letter was uploaded on PPRAwebsite and published in national dallies i.e Dawn Islamabad and Nawaiwaqt, Rawalpindi / Islamabad25.07.2018. The quotations were received and opened on 09-08-2018 in the presence of Mr. AmjadMehmood Kashmiri Vice President CB Wah , Maj. After completion of all codal formalities, the revised building planwas placed before the Board and the Board vide CBR No.06 dated 23-7-2005approved the revised building plan subject to payment of composition feeamounting to Rs.97,760/- . The decision of the Board was conveyed to thelessee vide this office letter No.IV/B-38/LR/xx dated 04-8-2005. But instead ofdepositing the composition fee, the lessee started to submit applications againand again for reduction / exemption of same. The case was again placed beforethe Board and the Board on recommendation of Technical Committee approvedthe revised building plan on payment of composition fee @ Rs.24,400/-vide itsCBR No.16 dated 20-10-2005.
During the course of audit for the year 2003-04 & 2004-05, the audit havepointed out less recovery on account of composition fee in different cases includedthe same case. In response of this office again placed the case before the Board andthe Board vide CBR No.29 dated 22-12-2005, imposed composition fee Rs.2,00,000/-in the light of ML&C Deptt. letter No.75/853/Lands/92/4970/D-12/ML&C/941 dated 06-4-1994 as the area of plot is more then 400 Sq.Yard.
The decision of the Board was accordingly been conveyed to the lessee videthis office letter No.IV/B-38/LR1/107 dated 24-3-2006, but the lessee again submittedapplication for reduction of composition fee. This office rejected her request anddirected to deposit the balance amount of Rs.175560/- on account of composition fee,but the lessee did not comply with the instructions of this office and proceeded intothe court and filed a civil suit on 16-11-2007 against Cantonment Board Wah and thesame was decided against CB Wah on 16-10-2010 by Malik Shahid HussainAwan,learned Civil Judge Taxila. CB Wah filed appeal against this judgment and same wasdecided as dismissed on 13-12-2015 by Mr. Zafar ullah Khan, learned AdditionalDistrict and Session Judge, Taxila. This office assail this order of AD&S Judge beforeHonorable High Court and the same was decided against CB Wah then this office filedappeal before Honorable Supreme Court of Pakistan and the same is still pending tillto date. After that Mst. Robina Majeed filed an execution petition before the Court ofMuhammad Ismail Jasra, Civil Judge Taxila for the implementation of Court decreedated 16-10-2010. In this case of execution petition honorable court strictly directedto implementation of court order and non- bail able arrest warrants has also beenissued for compliance of court order.In these circumstances, file may please bereferred to CLA of this office for legal opinion at this stage regarding conditionalapproval of building plan or otherwise. In this regard CLA of this office opined that:-
“In such eventuality it would be appropriate, to sanctionbuilding plan conditionally, subject to the final decision of HonorableSupreme Court of Pakistan.”
All relevant documents are placed on the table.
Recommendation of B&SC:- To be put up in Board meeting for necessary decision.
RESOLUTION Board conditionally approved subject to the final decision of Honorable Supreme Court of Pakistan.
