REGARDING

THE IMPORTATION OF CARCASS, MEAT, AND/OR THE PROCESSED PRODUCT THEREOF INTO THE

TERRITORY OF THE REPUBLIC OF INDONESIA

BY THE GRACE OF GOD THE ALMIGHTY

MINISTER OF AGRICULTURE OF THE REPUBLIC OF INDONESIA

Considering: a. that by the Regulation of Minister of Agriculture Number

139/Permentan/PD.410/12/2014 as was amended by the Regulation

of Minister of Agriculture Number 02/Permentan/PD.410/1/2025,

the importation of Carcass, Meat and/or the processed product

thereof into the Territory of the Republic of Indonesia has been

stipulated;

b. whereas to accelerate the service of importation and to boost

national economy, Regulation of Minister of Agriculture regarding

the Importation of Carcass, Meat and/or the Processed product

thereof into the Territory of the Republic of Indonesia shall be

necessarily stipulated.

HAS DECIDED:

To Stipulate: REGULATION OF MINISTER OF AGRICULTURE REGARDING THE

IMPORTATION OF CARCASS, MEAT, AND/OR THE PROCESSED PRODUCT

THEREOF INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA

CHAPTER I

GENERAL PROVISION

Article 1

In this Ministerial Regulation the following terms shall be construed as follows:

1. Ruminant carcass is the body part of healthy ruminants that have been slaughtered in halal and

correct manner, skinned, eviscerated, decapitated, legs removed below tarsal/carpal joints, as

well as reproductive organs and udder, tail and excess fat.

2. Poultry carcass is the body part of healthy poultry that have been slaughtered in halal and

correct manner, feathers plucked, eviscerated, and head, neck and both legs removed.

3. Pig carcass is the body part of healthy pig that has been slaughtered, body hair scrapped, head

and legs removed, and eviscerated.

4. Meat shall be a part of skeletal muscles of ruminant carcass consisting of Prime Cut, Secondary

Cut, Variety/Fancy Meat, and Manufacturing Meat.

5. Prime Cut shall be the cuts of ruminant meat having the softness, juiciness and the best quality,

in the form meat cuts with bone and without bone originated from ruminant livestock either in

the form of fresh chilled and frozen meat.

6. Secondary Cut shall be ruminant meat cuts outside prime cut having the softness, juiciness and

quality below the quality of prime cut in the form of meat with bone and without bone

originated from ruminant livestock in the form of fresh chilled and frozen meat.

7. Variety/Fancy Meat shall be a part of meat other than Prime Cut, Secondary Cut and

Manufacturing Meat in the form of meat cuts with bone and without bone in the form of fresh

chilled and frozen originated from ruminant livestock, consisting of tail, tongue and other similar

cuts.

8. Manufacturing Meat shall be bulky part of Prime Cut, Secondary Cut and Variety/Fancy Meat

which are used for the industrial purposes.

9. Processed Meat shall be meat which is processed with certain way or method, with or without

additional material.

10. Importation shall be the activity of importation of carcass, meat, and/or processed product

thereof from foreign country to the territory of the Republic of Indonesia.

11. Recommendation of importation hereinafter referred to as Recommendation shall be the

technical description stating that carcass, meat and/or the processed product thereof comply

with the veterinary public health requirements.

12. World Organization for Animal Health/Office International des Epizooties hereinafter referred to

as WOAH/OIE shall be the organization having the authority to give information on event, status,

and animal disease situation in a certain country, and to give technical recommendation in the

sanitary measures in the field of animal health.

13. Contagious Animal Disease shall be contagious disease between animals, animal and human

being, and animal and other animal disease carrier media through direct or indirect contact with

mechanical intermediary media.

14. Zoonotic disease shall be the disease which is contagious from animal to human being or vice

versa.

15. Veterinary Public Health hereinafter referred to as Kesmavet shall be all affairs related to animal

and animal product which directly and indirectly affect human health.

16. Country of Import Origin hereinafter referred to as Country of Origin shall be a certain country

exporting carcass, meat and/or the processed product thereof into the territory of the Republic

of Indonesia.

17. Country of Import Origin Business Unit hereinafter referred to as Business Unit shall be a

Business Unit in the Country of Origin which runs regular and continuous production of carcass,

meat, and/or processed product thereof for commercial purposes.

18. Veterinary Control Number (Establishment Number) hereinafter referred to as NKV shall be the

certificate as the legal written evidence stating the compliance of hygiene and sanitation

requirements as the prerequisite of food safety guarantee system of food of animal origin

business unit.

19. Director General shall be the leader of First Echelon working unit in the Directorate General of

Livestock and Animal Health Services within the Ministry that conduct the duty and function of

Veterinary Public Health sector.

20. Veterinary Authority shall be the central or local governmental institution having the

responsibility and competency in the implementation of Animal Health.

21. Center for Plant Variety Protection and Agricultural Permits hereinafter referred to as PPVTPP

shall be the working unit in Ministry of Agriculture having the duty and function in agricultural

licensing.

22. Livestock Services Office shall be a regional government working unit which works on livestock

and/or animal health affairs.

23. Business Player shall be individual person or corporation, whether incorporated as legal entity or

not which/whose activities are in the sector of livestock and animal health.

Article 2

This Ministerial Regulation is intended to be the legal basis in the implementation of importation,

which purpose is to:

a. Protect public health and inner peace, animal health and environmental health;

b. To ensure the compliance of safety, healthy, wholesome and halal requirements whenever

required.

c. To guarantee that imported carcass, meat and/or the processed product thereof is free from

Zoonotic disease and contagious animal disease, chemical hazard, and physical hazard; and

d. To provide smoothness and certainty in the importation of carcass, meat and the processed

product thereof.

Article 3

The scope of this Ministerial Regulation includes import requirements, import procedures, and

supervision.

CHAPTER II

IMPORT REQUIREMENTS

Article 4

(1) Importation may be executed by Business Player, State-Owned Enterprise (SOE) Regional

Government-Owned Enterprise (ROE), Social Institution, or Foreign Country/International

Institution Representatives.

(2) Business Player, SOE, ROE, Social Institution and Foreign Country/International Institution

Representatives as referred to in paragraph (1) in conducting the importation, shall be obliged

to obtain import permit from the minister executing governmental affairs in trade sector.

(3) Minister executing governmental affairs in trade sector shall grants the import permit as

referred to in paragraph (2), after obtaining Recommendation from Director General on behalf

of Minister.

(4) Director General grants recommendation as referred to in paragraph (3) after obtaining

technical advice and consideration from Veterinary Public Health Director.

(5) Recommendation referred in paragraph (3) is an inseparable part of the import permit.

Article 5

(1) Business Player importing big ruminant meat as referred to in Article 4 is obliged to procure

local beef from animal slaughtering house that have obtained Veterinary Control Number.

(2) Local beef procurement as referred to in paragraph (1) shall be verified by provincial and/or

district/municipality livestock services office of the origin.

(3) Procurement of local beef as referred to in paragraph (1) shall be as much as 3 (three) percent

for general importer, and as much as 1.5 (one point five) percent for producer importer from

total quantity of the upcoming importation.

Article 6

(1) Business Player, SOE, ROE, or Social Institution as referred to in Article 4 must be incorporated

as business entity or legal entity established according to Laws of Indonesia and having domicile

in Indonesia.

(2) Foreign Country/International Institution as referred to in Article 4 shall have domicile in

Indonesia.

Article 7

In addition to the requirements referred in Article 4, Article 5, and Article 6, the importation of

carcass, meat and/or the processed product thereof must comply with the requirements of:

a. Type of carcass, meat and the processed product thereof;

b. carcass and meat period of storage upon arrival to the territory of the Republic of Indonesia;

c. Country and Business Unit of Origin; and

d. Packaging, labeling, and transportation.

Article 8

(1) Types of cattle meat as referred to in Article 7 letter a, are included in Attachment I which is an

inseparable part of this Ministerial Regulation.

(2) Types of non-cattle carcass and the processed product thereof as referred to in Article 7 letter

a, are included in Attachment II which is an inseparable part of this Ministerial Regulation.

Article 9

Carcass and meat period of storage as referred to in Article 7 letter b, for:

a. Carcass and frozen meat is 6 (six) months maximum since the time of slaughtering to the time

of arrival to the territory of the Republic of Indonesia, with maximum storage temperature of

minus 180C; and

b. Carcass and chilled meat is 3 (three) months maximum since the time of slaughtering to the

time of arrival to the territory of the Republic of Indonesia, with maximum storage temperature

of 40C.

Article 10

Country of Origin as referred to in Article 7 letter c, are required to be free from:

a. Foot and Mouth Disease (FMD), Rift Valley Fever (RVF), Contagious Bovine Pleuropneumonia,

and Bovine Spongiform Encephalopathy (BSE) for the importation of large ruminant meat;

b. Foot and Mouth Disease (FMD), Rift Valley Fever (RVF), Sheep and Goat Pox, Peste des Petits

Ruminants (PPR), and Scrappie for the importation of carcass and small ruminant meat;

c. Foot and Mouth Disease (FMD), Rift Valley Fever (RVF), Classical Swine Fever (ASF)/Hog Cholera

and African Swine Fewer (ASF) for the importation of pig carcass and pork; and

d. Highly Pathogenic Avian Influenza (HPAI), and within the period of the previous 90 (ninety) days,

at the least, in the radius of 50 (fifty) kilometers prior to the commencement of exportation, the

country of origin has been declared as not under Newcastle Disease (ND), Duck Viral Hepatitis

(DVH), and Duck Viral Enteritis (DVE) epidemic, for the importation of poultry carcass.

Article 11

(1) Country with the status of controlled BSE risk may be considered as the country of origin for

importation of large ruminant meat.

(2) Large ruminant meat from the country with the status of controlled BSE risk as referred to in

paragraph (1) shall be in the forms of:

a. boneless/deboned meat, with the exception for mechanically separated meat (MSM) and

mechanically deboned meat (MDM); or

b. bone-in meat.

(3) Bone-in meat as referred to in paragraph (2) letter b must be originated from:

a. livestock which was born and raised in the Country of Origin and during its lifetime has never

been fed with feed containing ingredients originated from ruminant.

b. livestock at the age of 30 (thirty) months maximum.

c. livestock which have passed ante mortem examination and it is not stunned by injection of

pressed air or gas to head cavity; and

d. carcass which have passed post mortem examination and underwent Specified Risk Material

(SRM) contamination prevention action.

Article 12

(1) Country which is not free from Foot and Mouth Disease (FMD) may be considered as Country of

Origin of processed beef and processed pork provided that the meat has been:

a. maturated with meat pH below 5.9, with lymph gland removed and deboned; and

b. Heated above 800C for 2 – 3 minutes.

(2) Processed pork that are not underwent heating as referred to in paragraph (2) letter b, may be

salted for at least 12 (twelve) months.

Article 13

Country of Origin animal disease status as referred to in Article 10, Article 11, and Article 12 is based

on WOAH/OIE declaration.

Article 14

(1) Business Unit as referred to in Article 7 letter c are required to:

a. Be under supervision and registered as exporting business unit by the veterinary authority of

the country of origin.

b. not accept livestock and/or not process animal product originated from countries contracted

with animal diseases as referred to in Article 10;

c. Apply food safety guarantee system in accordance with international regulation, proved by

certificate of food safety guarantee issued by an internationally acknowledged competent

authority.

d. Own and only implement halal guarantee system on the whole production process (fully

dedicated for halal practices), and shall have permanent employee who are responsible in

the implementation of halal manner in slaughtering, cutting, handling, and processing; and

e. Have halal-certified butchers for animal slaughterhouse other than swine slaughterhouse

and supervised by halal certification institution acknowledged by Indonesian halal authority.

(2) Implementation of halal guarantee system in poultry slaughterhouse as referred to in paragraph

(1) letter d must be accomplished by manual individual slaughtering of poultry by halal-certified

butchers as referred to in paragraph (1) letter e.

Article 15

(1) Country of Origin and Business Unit may be stipulated as Country of Origin and Business Unit

after fulfilling the requirements as referred to in Article 10, Article 11, Article 12 and Article 14.

(2) The stipulation of Country of Origin and Business Unit as referred to in paragraph (11) shall be

conducted by Director General on behalf of Minister in the form of Decree.

(3) Director General stipulate Country of Origin and Business Unit as referred to in paragraph (2)

based on the fulfillment of requirements as referred to in paragraph (1) by taking into account

risk analysis result.

Article 16

(1) Risk analysis as referred to in Article 15 paragraph (3) shall be conducted through these steps:

a. Determining acceptable level of protection in accordance with the type of disease.

b. Document checking (desk review) and verification (on site review) of animal health

administration system and animal product safety guarantee in the Country of Origin.

c. Document checking (desk review) and compliance audit (on site review) over the animal

product safety and halal guarantee system at the Business Unit.

(2) Risk analysis as referred to in paragraph (1) shall be conducted by Risk Analysis Team, which

membership consists of representatives from Directorate General of Livestock and Animal

Health Services, Animal Health and Veterinary Public Health Expert Commission, and experts

with related educational background.

(3) Compliance verification of animal health administration system and animal product safety

system in the Country of Origin as referred to in paragraph (1) letter b, shall be conducted by

State Evaluator Team, which membership shall consist of representatives from Directorate

General of Livestock and Animal Health Services, and Animal Health and Veterinary Public Health

Expert Commissions.

(4) Compliance audit on animal product security and halal guarantee system at the Business Unit as

referred to in paragraph (1) letter c shall be conducted by Business Unit Evaluator Team, which

membership shall consist of representatives of Directorate General of Livestock and Animal

Health Services, and Animal Health and Veterinary Public Health Expert Commissions.

(5) Risk Analysis Team as referred to in paragraph (2), State Evaluator Team as referred to in

paragraph (3), and Business Unit Evaluator Team as referred to in paragraph (4) shall be

stipulated by Director General of Livestock and Animal Health Services on behalf of the Minister

in the form of Decree.

(6) Stipulation of additional Business Unit from stipulated Country of Origin shall be conducted

through risk analysis steps as referred to in paragraph (1).

Article 17

(1) If based on the result of risk analysis of the Country of Origin, risk exceeds the acceptable level

of protection as referred to in Article 15 paragraph (1) letter a, Director General shall issue a

letter stipulating rejection to the Country of Origin.

(2) If based on the result of risk analysis of the Country of Origin, risk is lower or at the same level

with the acceptable level of protection as referred to in Article 16 paragraph (1) letter a, Director

General on behalf of Minister shall stipulate the Country of Origin as the Country of Import

Origin in the form of Decree.

Article 18

Packaging requirements as referred to in Article 7 letter d must be:

a. originated from the Country of Origin and shall have label; and

b. made of special material and safe for food (food grade), and is non-toxic.

Article 19

Labelling requirements of as referred to in Article 7 letter d shall use Indonesian and English

Language by including:

a. destination country is Indonesia

b. Veterinary Control Number (NKV)

c. date of slaughtering, cutting, and/or date of production;

d. quantity, type, and specification of carcass, meat, and/or the processed product thereof; and

e. Halal marking if required.

Article 20

Transportation requirements of carcass, meat and/or the processed product thereof as referred to

in Article 7 letter d shall be as follows:

a. Conducted directly from the Country of Origin to the port of discharge within the territory of the

Republic of Indonesia.

b. Animal quarantine measures must be performed at the Country of Origin to carcass, meat,

and/or the processed product thereof before being loaded to the conveyance.

c. Transit during importation shall be carried out pursuant to the animal quarantine laws and

regulations.

d. transportation of halal-certified carcass, meat, and/or the processed product thereof shall not

be in a same container with the non halal-certified carcass, meat, and/or the processed product

thereof; and

e. Upon arrival to the port of discharge, animal quarantine measures shall be performed to carcass,

meat, and/or the processed product thereof in accordance to animal quarantine laws and

regulations.

CHAPTER III

IMPORT PROCEDURES

Article 21

To obtain Recommendation as referred to in Article 4 paragraph (3), applicants shall submit an

online application to Director General through the Head of PPVTPP.

Article 22

(1) Business Player, State Owned Enterprise (SOE) and Regional Government Owned Enterprise

(ROE) must submit Recommendation Application on 1st -31st of December of the preceding year,

on 1st - 30th of April, and on 1st - 31st of August of the current year.

(2) Social Institution and Foreign Country Representative/International Institution may submit their

Recommendation Application at any time in accordance to the necessity.

(3) State Owned Enterprise (SOE) and Regional Government Owned Enterprise (ROE) as referred to

in paragraph (1) may at any time import cattle carcass and/or secondary cut beef in the event of

beef shortage due to animal disease outbreak and/or natural disaster, and anticipating beef

price fluctuation.

(4) In performing import as referred to in paragraph (3), State Owned Enterprise (SOE) and Regional

Government Owned Enterprise (ROE) must obtain assignment from:

a. Minister of State Owned Enterprise for State Owned Enterprise;

b. Governor for Regional Government Owned Enterprise.

(5) State Owned Enterprise (SOE) and Regional Government Owned Enterprise (ROE) Minister

Assignment as referred to in paragraph (4) shall be based on the recommendation from:

a. Minister, in the event beef shortage due to animal disease outbreak and/or natural disaster;

and/or

b. Minister administrating governmental trade affairs, in anticipating beef price fluctuation,

and/or to prevent the inflation.

(6) Import implementation as referred to in paragraph (3) shall be carried out based on the result of

coordination meeting result led by the minister conducting synchronization and coordination in

the field of economy.

(7) In anticipating beef price fluctuation, Minister administrating governmental trade affairs as

referred to in paragraph (4) letter b must base the reference price 30% above the production

cost.

(8) Cattle carcass and/or secondary cut meat as referred to in paragraph (3), shall be included in

Attachment III that is an inseparable part of this Ministerial Regulation.

Article 23

(1) Recommendation Application submitted by Business Player, State Owned Enterprise (SOE) and

Regional Government Owned Enterprise (ROE) as referred to in Article 22 paragraph (1) must be

completed with requirements as follows:

a. Identification Card (KTP) and/or company management identification;

b. Taxpayer Identification Number (NPWP);

c. Business and Trade License (SIUP);

d. Livestock and Animal Health Registration Certificate or Business License

e. Company’s deed of incorporation and the last amendment thereof;

f. Veterinary Control Number (NKV);

g. Importer Identity Number (API);

h. Statement Letter with stamp duty affixed accompanied with supporting document which

declare ownership of cold storage and refrigerated vehicle, with the exception of ready-to-

eat processed food that do not need cold storage facility as informed on the product label;

i. Letter of recommendation from provincial livestock services office;

j. Employing veterinarian with competency in the field of veterinary public health, proven by

an assignment letter or work contract from company management;

k. Report of import realization from the previous period;

l. Provide the evidence of local cattle procurement verified by provincial and/or

district/municipality livestock services offices of the origin of the cattle; and

m. Statement letter with stamp duty affixed declaring the document submitted is correct and

valid.

(2) Recommendation Application submitted by a Social Institution as referred to in Article 22

paragraph (2) must be completed with requirements as follows:

a. Identification Card (KTP) and/or Social Institution management identification;

b. Social Institution’s deed of incorporation and the last amendment thereof;

c. Stipulation as a Social Institution from the competent authority;

d. Grant statement from the Country of Origin;

e. Proof of NKV-certified cold storage ownership/rental and employment of a veterinarian as

the technical person-in-charge;

f. Statement declaring that carcass, meat, and/or the processed product thereof shall not be

commercially traded;

g. Description on potential recipients; and

h. Statement letter with stamp duty affixed declaring the document submitted is correct and

valid.

(3) Recommendation Application submitted by Foreign Country Representative/International

Institution as referred to in Article 21 paragraph (2) must be completed with requirements as

follows:

a. Management and/or assigned/authorized representative identification;

b. Proof of cold storage ownership/rental;

c. Statement declaring that carcass, meat, and/or the processed product thereof are for

internal need and shall not be distributed commercially; and

d. Statement letter with stamp duty affixed declaring the document submitted is correct and

valid

Article 24

(1) Upon receiving online application as referred to in Article 21, Head of PPVTPP shall perform

administrative requirements verification as referred to in Article 23, and provide the rejection or

acceptance response within 1 (one) working day maximum.

(2) Application shall be rejected as referred to in paragraph (1) if the administrative requirement as

referred to in Article 23 is incomplete and/or incorrect.

(3) Rejected application as referred to in paragraph (2) shall be notified online to the applicant by

the Head of PPTVPP along with the reason of rejection.

(4) Application shall be accepted as referred to in paragraph (1) if it has complied with the

administrative requirement as referred to in Article 23.

(5) An accepted application as referred to in paragraph (4) shall be forwarded online to Director

General.

Article 25

(1) Upon receiving online application as referred to in Article 24 paragraph (5), Director General

shall perform technical review, and provide the rejection or acceptance response within 3

(three) working days maximum.

(2) Application shall be rejected as referred to in paragraph (1) if it does not comply with the

requirements as referred to in Article 7.

(3) Rejected application as referred to in paragraph (2) shall be notified by Director General to the

applicant through the Head of PPVTPP in the form of online rejection letter.

(4) Application shall be approved as referred to in paragraph (1) if it complies with the requirements

as referred to in Article 7.

(5) For accepted application as referred to in paragraph (4), recommendation shall be issued by the

Director General

Article 26

(1) Recommendation as referred to in Article 25 paragraph (5) shall be delivered online by the

Director General to the Head of PPVTPP.

(2) Upon receiving recommendation as referred to in paragraph (1), Head of PPVTPP shall online

deliver it to the Minister administrating governmental trade affairs.

Article 27

Determination of the amount in Recommendation per Business Player, Social Institution, and

Foreign Country Representative/International Institution, shall be stipulated by the minister

administrating governmental trade affairs.

Article 28

The issuance of Recommendation as referred to in Article 25 paragraph (5) shall be performed 3

(three) times, namely on December of the preceding year, and April and August of the current year.

Article 29

Recommendation as referred to in Article 25 paragraph (5) shall at least contain:

a. Recommendation number;

b. name, Taxpayer Identification Number (NPWP) and the applicant’s address, as well as the cold

storage place address;

c. number and date of the application;

d. Country of Origin;

e. name and establishment number of the Business Unit;

f. type/category of carcass, meat, and/or the processed product thereof as well as the HS code;

g. veterinary public health technical requirement;

h. port of discharge;

i. validity period of the Recommendation; and

j. the intended use.

Article 30

(1) Validity period of the Recommendation as referred to in Article 29 letter i shall be performed in

three periods within one year as follows:

a. First period shall enter into force as of 1st of January up to 30th of April;

b. Second period shall enter into force as of 1st of May up to 30th of August;

c. Third period shall enter into force as of 1st of September up to 31st of December.

(2) Recommendation that have been issued shall be declared null and void in the event that an

animal disease outbreak as referred to in Article 10, Article 11, and Article 12 occur in the

Country of Origin listed in the Recommendation.

(3) Recommendation application for a country other than the one that is referred to in paragraph

(2) may be re-submitted before the end of Recommendation time limit as referred to in

paragraph (1).

Article 31

(1) Intended use, as referred to in Article 29 letter j, of carcass and meat, as referred to in Article 8,

is for hotels, restaurants, caterings, industries, and other particular purposes.

(2) Intended use, as referred to in Article 29 letter j, of the processed product is for hotels,

restaurants, caterings, industries, and other particular purposes, as well as for modern market.

(3) Other particular purposes as referred to in paragraph (1), includes:

a. Gift parcel or grant for the purpose of religious worship, charity, or disaster mitigation

management;

b. needs of foreign country representative/international institution and their officials serving

their duty in Indonesia;

c. science research and development purposes; or

d. samples that are not to be commercially traded ( for exhibition purpose) up to 200 (two

hundred) kilograms.

Article 32

Business Player, State Owned Enterprise (SOE) and Regional Government Owned Enterprise (ROE),

Social Institution, and Foreign Country Representative/International Institution, conducting

importation:

a. are not allowed to make any alteration to the Country of Origin, Business Unit of Origin, port of

discharge, type/category of carcass, meat, and/or the processed product thereof to a

Recommendation that has been issued;

b. are not allowed to import carcass, meat, and/or the processed product thereof other than those

listed in the Recommendation;

c. are obliged to carry out the prevent introduction and dissemination of contagious animal

diseases; and

d. are obliged to report import realization of the previous period when submitting a new

Recommendation application online.

CHAPTER IV

SUPERVISION

Article 33

(1) To carcass, meat, and/or the processed product thereof to which quarantine measures of

release have been imposed to, supervision on the compliance of veterinary public health

requirements shall be performed.

(2) Supervision as referred to in paragraph (1) shall be carried out by an authoritative veterinarian

having the competence as a Veterinary Public Health Supervisor in the Ministry, Province, and

District/Municipality in accordance with their authority.

(3) To carcass, meat, and/or the processed product thereof to which quarantine measures of

release have been imposed to, besides being supervised by a supervisor as referred to in

paragraph (2), supervision may also be conducted by the community.

(4) Supervision conducted by the community as referred to in paragraph (3) shall be in the form of

report of allegation of deviation of circulating carcass, meat, and/or the processed product

thereof.

(5) Report by the community as referred to in paragraph (4) shall be delivered to a local Veterinary

Public Health Supervisor.

Article 34

In the event that a province or district/municipality has not had Veterinary Public Health Supervisor

as referred to in Article 33 paragraph (2), the supervision shall be carried out by the neighboring

province or district/municipality Veterinary Public Health Supervisor.

Article 35

Supervision by an Authoritative Veterinarian as referred to in Article 33 paragraph (2) shall be

applied on:

a. physical condition of carcass, meat, and/or the processed product thereof;

b. packaging and label;

c. documents;

d. storage and transportation; and

e. Product display, particularly for processed products.

Article 36

(1) Examination on physical condition of carcass, meat, and/or the processed product thereof as

referred to in Article 35 letter a, shall be conducted using organoleptic test.

(2) In the event that it is found any deviation to the organoleptic examination result as referred to

in paragraph (1), sample must be collected to carry out further testing.

(3) Packing and label examination as referred to in Article 35 paragraph b, shall be performed

against the information conformity regarding the name of product, manufacturer, production

date, and/or expiry date, product type/category, as well as halal label for the required products.

(4) Document examination as referred to in Article 35 letter c, shall be performed by checking the

requirements that are veterinary certificate and halal certificate for the required product.

(5) Examination of storage and transportation equipment as referred to in Article 35 letter d, and

special product display for processed products as referred to in Article 35 letter e, shall cover the

compliance of sanitation hygiene requirement, and room temperature in accordance to the type

of carcass, meat, and/or the processed product thereof, as well as the separation of halal and

non halal products.

Article 37

(1) Supervision as referred to in Article 33 shall be performed at least once every 4 (four) months, or

at any time if any allegation of deviation against the compliance of veterinary public health

technical requirement is suspected.

(2) A Veterinary Public Health Supervisor as referred to in Article 32 (2) shall report the result of the

supervision periodically or at any time as referred to in paragraph (1) to the Director General,

and Head of Provincial or District/Municipality Livestock Services Office according to their

authority.

(3) Director General, Head of Provincial or District/Municipality Livestock Services as referred to in

paragraph (2) shall deliver report of supervision result regularly or at any time to Minister

through Director General, Governor or District Head/Mayor according to their authority.

CHAPTER V

PROVISION OF SANCTION

Article 38

Business Player, State Owned Enterprise (SOE) and Regional Government Owned Enterprise (ROE),

Social Institution, and Foreign Country Representative/International Institution that breaches the

provision of:

a. Article 4 paragraph (2) and paragraph (5);

b. Article 5;

c. Article 9;

d. Article 23 paragraph (1) letter k, letter l, letter m, paragraph (2) letter h, paragraph (3) letter d;

e. Article 31; and/or

f. Article 32,

shall be sanctioned by revocation of their recommendation, denial of their next recommendation

application, and propose to the Minister administrating governmental trade affairs to revoke the

Import Approval (PI).

CHAPTER VI

PROVISION OF TRANSITION

Article 39

(1) Importing Country of Origin and Business Unit that have been approved as the Country of Import

Origin and Importing Business Unit of Origin prior to the time this regulation enter into force are

hereby stipulated as Country of Origin and Importing Business Unit.

(2) Recommendation that have been issued prior to the promulgation of this Minister Regulation

shall still be in force up to its expiry date.

CHAPTER VII

CLOSING PROVISION

Article 40

Upon this Minister Regulation entry into force:

a. Regulation of Minister of Agriculture Number 139/Permentan/PD.410/12/2014 regarding the

Importation of Carcass, Meat, and/or the Processed Product thereof into the Territory of the

Republic of Indonesia (State Gazette Year 2014 Number 1967); and

b. Regulation of Minister of Agriculture Number 02/Permentan/PD.410/1/2015 regarding

Amendment to Regulation of Minister of Agriculture Number 139/Permentan/PD.410/12/2014

regarding Importation of Carcass, Meat, and/or the Processed Product thereof into the Territory

of the Republic of Indonesia (State Gazette Year 2015 Number 105), shall be revoked and

declared null and void.

Article 41

This Minister Regulation shall enter into force on the promulgation date.

In order to be publicly acknowledged, ordering the promulgation of this Minister Regulation by

placing it in the State Gazette of the Republic of Indonesia.

Importation Recommendation is granted under the following provisions:

1. This recommendation shall become the requirement to obtain importation license of carcass,

meat, offal, and/or the processed product thereof from Minister of Trade.

2. Importation of carcass, meat, offal, and/or the processed product thereof must comply with the

requirements included in attachment which is an integral and inseparable part of this

Recommendation.

3. Company/applicant shall be sanctioned if does not implement Regulation of Minister of

Agriculture Number ... Regarding Importation of Carcass, Meat, and/or the Processed Products

thereof into the Territory of the Republic of Indonesia.

4. In the event of animal disease outbreak and/or change of food security status of the country of

origin, this Recommendation shall be declared null and void.

5. This Recommendation shall effectively enter into force as of the stipulation date.

This Recommendation is issued to be implemented and to be used appropriately.
