got a call about a quarter to saying they were stuck in
traffic. They were on their way to the MAX station. He will
be a little bit late.

explains to the jury.

the jury his absence.

Everyone else is here. Yes? All right.
The jurors are ready to come in. I'm -- I want to review
the intended instruction, which is consistent with the model
number 712 to see if anyone has any input to that.
I also want to acknowledge Mr. Ammon Bundy's filing
overnight of a renewed proposal for substantive instruction on
Second Amendment rights. It's filing number 1496.
I'm not taking argument on it. I have considered it, but
this -- at this stage, there's not any basis to reinstruct on
substance. Whatever instructions have been given, if they are

legally erroneous, the parties have preserved their objections.
The only point of an instruction now is to address the
jurors with respect to the need to begin deliberations anew,
respectful of the addition of the new juror, number 18.
So as to the model instruction, are there any additions,
exceptions, or alterations that the government proposes?
MR. KNIGHT: No, Your Honor.
THE COURT: Do the defendants have any suggestions
with respect to the model instruction or any issues with it?
No.
There is -- in the last line of the model instruction
substance, it says, "All the previous instructions given to
you, including the unanimity requirement for a verdict, remains
in effect."
In light of the question from the earlier panel, I propose
to change that to "unanimity requirement for a verdict as to
each count and each defendant remains in effect" just to --
just to make that point.
All right. Are we otherwise ready for the jury?
Okay. And, Ms. Boyer, remind them to take rows of six and
six.

Juror No. 18, welcome.
Good morning, jurors. All of you, welcome back. As you
know, you're now here to begin anew deliberations on the issues
that were presented to you. So I just wanted to confirm a few
basic points on the fact that you are deliberating anew. All
right.
First, do not speculate or discuss the reasons why you are
a new group of 12. That's a matter that's happened and passed.
Put yourselves in the position you were in when I gave you the
case originally. So you can put yourself in that spot where I
told you, "You may now retire to deliberate," and that is the
state of mind you should take to the jury room.
Juror No. 18, do you still have your written instructions
from before the final instructions?
JUROR NO. 18: Yes.
THE COURT: I'm not going to reread the substantive
instructions. I assume you all have them in mind, in any
event. But certainly they're still available for consultation,
as any of you may need or want, during the course of your
deliberations.
You must start your deliberations anew. This means you
should disregard entirely any deliberations taking place before
Juror No. 18 joined you, and you must consider freshly the
evidence as if the previous deliberations had never occurred.
Although starting over may seem frustrating, do not let it

discourage you. It is important that each juror, each and
every one of the 12 of you, has a full and fair opportunity to
explore his or her views and respond to the views of other
jurors so that you may come to a unanimous verdict.
All the previous instructions given to you, including as
to the unanimity requirement for a verdict on each count as to
each defendant, remains in effect.
Your lunches will be ordered in the normal protocol.
You'll be taking your breaks in the normal protocol. With your
permission, we'll expect you will be working until 5:30, unless
you tell us something otherwise, as a unanimous group. All
right?
As I said to some of the jurors yesterday -- you weren't
here No. 18 -- you've waited on us throughout these
proceedings, and we are now at your disposal. So if at any
point the 12 of you wish to change the schedule, just tell me,
and we will work on that.
Of course it takes a little bit of time to turn a big
ship. We can't do things instantly. If you know something is
coming that will affect the schedule, let Ms. Boyer know so
that we can get moving on whatever your request is. All right?
So you should have with you in the jury room, then, all of
the exhibits.
The good news, No. 18, is the jurors have figured out how
to use the electronic display system so none of that time needs

Well, actually, technically, yes, because you don't have a
foreman because your prior deliberations don't matter. So
don't just -- just start anew. Start anew on everything.

question comes in. All of the defense team has access to the
space on the third floor if you need to be. And we begin anew.

DEPUTY COURTROOM CLERK: All rise.
THE COURT: Good afternoon, everyone. Please be
seated. The parties should have received a copy of a note
signed again by the juror in seat number one, reading,
"Judge Brown, we have reached consensus on all but one charge.
What is your next instruction? We have exhausted all
discussion on the issue and cannot come to a unanimous
decision."
Having received that note, I thought it would be important
to confirm with the jurors that, in fact, they all agree that
they have actually considered all the evidence anew and that
all jurors agree that further deliberations would not, under
any circumstances, change the status of their views. And so I
have given to the parties a proposed ballot for the jurors to
complete to provide that information.
I'm certainly open to other ways to respond to this note.

MR. KNIGHT: Your Honor, the government is fine with
the proposed questionnaire.
THE COURT: Defendants?
Mr. Olson?
Mr. Mumford?
MR. MUMFORD: I -- I haven't discussed this with
others, but I would -- I -- Your Honor, I would suggest --
especially given the status of the deliberations and the new
juror that came on this morning, I would suggest -- before we
go to this step, I would -- which seems to be the Allen -- you
know, the Allen charge type of a scenario, I would go with the
7.7 deadlocked jury instruction first, send them back, and try
to encourage them to -- you know, to continue to deliberate and
resolve their -- their -- their differences, but I'll --
THE COURT: Let me note for the record what my
questions are for the jury, as I propose them, I don't construe
these proposed questions as an Allen charge at all.
MR. MUMFORD: Okay.
THE COURT: I construe these questions as simply
confirming what I believe we're construing from the note, and
this does not in any way, in my view, suggest anything other
than "I need to confirm I'm understanding what you're saying."
The model instruction is the Allen charge, the so-called
dynamite charge, which is typically discouraged because it
proposes -- it suggests coercion, and all I'm trying to do by

this ballot is to confirm what I read the note to mean; that,
first, the first question I propose to ask is, "Do all 12
jurors agree you have, in fact, considered all of the evidence
as to all of the charges anew?"
Given the timing, that it's only been a matter of hours
since the newly constituted jury was discharged, I think that's
a fair inquiry to close the record with respect to that
obligation. It's also not hard to understand that they might
be able to have done this. The 11 jurors are well familiar
with the issues, and probably it's fair to conclude that they
have an efficient way to go through them now that they didn't
have when they started the case.
And then the second question is, "Do all 12 jurors agree
that further deliberations will not, under any circumstances,
change the status?"
That doesn't suggest it's a good thing or a bad thing.
It's suggesting that I'm trying to confirm that they can't.
So I don't see this as an Allen-type charge or a
dynamite-type charge at all.
Mr. Olson wanted to offer something.
MR. OLSON: Your Honor, I don't believe the first
question is necessary.
THE COURT: All right.
MR. OLSON: And it might -- they might take it as the
Court suggesting or doubting whether they have considered all

the evidence anew.
THE COURT: Fair enough.
MR. OLSON: And I think Your Honor instructed about
that very clearly this morning, so --
THE COURT: Okay. Do you think the second question
is necessary?
MR. OLSON: I don't have any problem with the second
question.
THE COURT: I'm certainly willing to only send the
ballot to them as to the second question if that's how all
parties agree.
Ms. Maxfield, you were kind of nodding and shaking your
head at different points.
MS. MAXFIELD: Whatever Per says is always what I
say.
THE COURT: All right. So, Mr. Knight?
MR. KNIGHT: Your Honor, I just want to confirm that
all defendants --
THE COURT: I'm trying to get there.
So the proposal right now is that the Court respond to the
message only with what I have enumerated as number two on the
ballot form. "Do all 12 jurors agree that further
deliberations will not, under any circumstances, change the
status of your views, as referenced in your attached note to
me?"

And then the following would be, "If your answer is yes, I
will organize the parties and call for you to present your
verdicts in open court. That may take up to 30 minutes.
Please stand by," and "If your answer is no, I will provide you
an additional instruction." Maybe.
I don't quite know what to do if their answer is no to
that, but at least we would have it confirmed.
Did you have another point?
MR. MUMFORD: Yes.
THE COURT: Yes, Mr. Mumford.
MR. MUMFORD: I was going to suggest maybe leave the
"if your answer" to both of these -- or to the questions, leave
that off, and let's just see what the -- what the answer is.
THE COURT: All right. That's fine. I can just give
them the number two as a single question and send it in and see
what they do.
All right. That's what I will do. Does everyone agree
with that? Every defendant?
Is there any opposition by defendants?
No one is articulating any.
Mr. Knight, for the government?
MR. KNIGHT: Thank you. That is fine with the
government.
THE COURT: All right. Then we're going to sit at
ease because I suspect there -- it won't being long for us to

have a written response. As soon as we have a written
response, then we'll go forward.
Let me -- I'm going to ask for this to be modified. But
while I have everyone's attention while that's happening, I
wanted to review the process of receiving the verdict.
So we have seven defendants. Seven separate verdict
documents, and I intend to address the verdicts as they're
proposed, on a defendant-by-defendant basis. One verdict at a
time.
When the jurors are in, I will ask the presiding juror if
the jurors have reached a unanimous verdict on all but the one
matter, whatever it is. I assume the presiding juror will say
yes. I'll ask to see the verdicts, and then I'll begin, of
course, with Mr. Ammon Bundy, since he's the first on the
verdict form. I'll ask you to please stand and face the jury.
I will read the verdict form in its entirety. I will ask
the presiding juror, "Did I read the verdict correctly in all
respects?" And then I will ask, "Do all 12 jurors agree that I
read the verdicts correctly?" And then I will ask you to be
seated, and then we'll go to Ryan Bundy. And we'll do this in
order until we're finished.
And then it remains to be seen what needs to be done next.
I will, in fact, as I say, get confirmation that the
verdicts are unanimous. I believe that is sufficient and
doesn't warrant a juror-by-juror poll. If I ask them in open

court, I want you to watch them and to ensure that you agree
that they're all answering and confirming.
Now, if they have one open question, then the issue is
what to do about it, and I don't -- I can't forecast that right
now because I don't know what the open question is, and I don't
know as to whom the question remains open.
So what I want to do is then, once we have the verdicts
announced and the jurors confirm I've read those accurately,
I'm going to ask, "Does anyone have any matter that has to be
addressed before the verdicts are received and the jurors
discharged?" And if you do, I want you to state what those
issues are because then I'll need to decide if I have to do
something before I receive formally the verdicts and discharge
the jurors.
If no one has anything at that point, I will briefly thank
the jurors for their service. I will tell them that I will
meet with them as soon as I can to pass on my personal thanks,
and that will be the end of their service. The verdicts will
be received.
But I anticipate I will need to do something in court here
depending on what those verdicts are.
For example, if there are acquittals of any of the
gentlemen in custody, I need to acknowledge that and address
that immediately.
And so we'll take up the immediate consequences.

If there are convictions, I will set a tracking date for
sentencing -- one date for all who may have been found
guilty -- subject to an adjustment in due course. But I need a
date just for a purpose.
And then we'll see what else needs to be done on the
record.
Mr. Schindler, can you please update me, please, as to
Mr. Medenbach's situation?
MR. SCHINDLER: Yes, Your Honor. He remains quite
ill. He is in Bend near -- at a friend's house that's close
enough to the hospital that he can go there quickly if need be.
The main issue for him right now is that he's -- has to be
connected to a specialized piece of machinery to give him the
drugs that he's taking currently for the issue that he has.
I've been told that they anticipate he is going to be on a
course of medication that will last for another 12 days.
THE COURT: All right.
MR. SCHINDLER: So at this point I don't anticipate
he will be able to travel for another week or a week and a
half, so I'm prepared to take --
THE COURT: I will note to the jury -- and I should
have this morning and I failed to, but I will note to the jury
at this point that assuming -- once we have the verdicts
received, I will simply tell them that he's been ill and that
is the nature of the personal problem; but I need to

acknowledge his absence in their presence.
MR. SCHINDLER: I understand.
THE COURT: Finally -- just a few more steps before
finally.
There remains in effect a protective order as to the
identity of all of the jurors. And unless and until that order
is set aside, no party may disclose the identity of the jurors.
I'm going to remind the jurors of that order.
I am, however, going to also tell them that they are --
once they're discharged, they are free to speak to whomever
they want about whatever they want with the exception of that
which went on in the jury room which is private among them.
I'm going to tell them that no party may reach out to a juror.
That is prohibited under our rules.
However, if any of them wish to reach out to you, they
may. And if they wish contact information from us, I will
provide it. So you need to know there's that.
Finally, with respect to taking the verdict, it is
absolutely necessary that there not be any audible or
behavioral reaction to a verdict as it is being announced.
Anybody in the spectator section who speaks out in response to
the verdict reading or acts in any way that a United States
marshal perceives as disruptive will be removed from the room.
I'm not going to get in the middle of it. They're going to
remove you from the room and remove you from the courthouse.

So if your interest is in seeing the verdicts through,
please contain yourself. Wait until the proceeding is
recessed, and then you'll have the opportunity to react.
This applies also to people who will be in the 13th floor
observation room.
So any marshal who observes a reaction to the verdict that
is disruptive may and should remove that person reacting from
the room and from the courthouse.
I want to be sure we have enough people around to ensure
an orderly process. This is an extremely important part. It
is, in fact, what all of you have been here for. And so I ask,
please, for the cooperation of everybody to please just let the
process unfold. Whatever the verdicts are, they are. They
will be addressed in due course. It doesn't do anyone any good
for there to be distraction and disruption in the room when
this process happens.
All right. So I have now a note that says, "Jurors,
please answer the following question: Do all 12 jurors agree
that further deliberations will not, under any circumstances,
change the status of your views as referenced in your attached
note to me? Answer yes or no," a line for the presiding juror
to sign with the seat number, and I'm signing the note.

So it appears to me that the jurors' note references one
charge. We don't know what that is and won't know until the
verdicts are presented, and it appears to me as to that charge
there may be a so-called hung jury and that there is a verdict
to be received on every other charge. As noted, I will confirm
that as the verdicts are received.
It will take a little bit of time for us to get ready to
receive the verdict. So, again, we'll go off the record, and I
ask you to just wait patiently until we're ready to proceed,
and then we will -- Mr. Mumford?
MR. MUMFORD: I just would renew my request that
we -- that we pursue a 7.7 instruction at this point and -- and
let them -- let them keep going.

the dedicated service of you citizen jurors. The right to a
jury trial, guaranteed to each of us by the Constitution, would
not mean anything if people like you weren't willing to come
and serve. It has been a long road and one on which I know
many of you traveled with burdens. It was -- they were long
days; many days of hard work and attention. Your service is
greatly appreciated, not just by the Court and the parties
involved in the case, the defendants, even the government and
the prosecutors, literally by our nation. This process is one
that has served us well for centuries, and it will continue to
do so if citizens like you continue to step up and to serve.

to discharge you from all of the orders I've been giving you,
which is to say that you are free to speak to whomever you want
about whatever you want, with one exception, and that is what

At some point there may come a time when I'm being asked
to lift that protective order, but not today. I just wanted

released from custody.
Mr. Olson, is there a plan in place at the moment, or is
it better for Mr. Fry to yet spend the night and be released
