2 Section 1. Sectior~ 8111(d) is hereby added to Chapter 8, Division 1 of

3 Title 5 of the Guarn Code Annotated to read as follows:

4 "(d) Under no circumstances shall a public agency vote on any

5 matter before it during an executive or closed meeting. All voting must

6 be held in a public meeting and minutes shall be kept and opened to the

7 public."

11. SUMMARY OF TESTIMONY There r\'ere no individuals appearing ilefore tlie Committee to present oral testimony on the bill. Senator Forbes stated tliat tht. bill ni,lhes it clear that certain matters cannot be decided with closed votes. The true purpose of csecuti\.c sc.ssions is for matters that migl-it violate the privacy rights ot individuals, not to allo~v secret votes, Forbes said. l~ l e said the Opcn Government Law should be clear tli,it there should bc public olisel-\.ation of clecisions that affect the public and ultimately affect the se r~ ices providcil to the public.

Senator Pangelinan said t11'1t the bill is keeping with the continued t>olicy of this Legislature for 0pt.n government. He said the bill clarities tlie issue of voting in executi~.c> sessions - some matters should be discussed in executive sessions, but ivhen it comes to the actual \.oting, it should be made in public.

111. FINDINGS AND RECOMMENDATION The Committee on Rules, <I;overnmcnt Reform, Reorganization and I-ederal Affairs finds that Bill KO. 440, increases the stand~rcis of go\-ernment accountability and openness for which I Liheslaturan Guahan has consistently strived. From the Sunshine Reform Act to the elected Public Auditor and elected ilttorney Gcner'll, I Liheslatur,~ has made its message clear: Ilie government of Guam will bt. - ope11 to the public, and all decisions nlC1de by the government will bt. made under the light of day.
