Dear Sir,

You will be aware that, this sensitive issue has been under active

consideration of OILManagement since 2016 and Board of Trustee for OILINDIA

SUPERANNUATIONTRUST FUNDS could not take a conclusive decision despite

having the Hon 'ble Supreme Court of India verdict and legal opinion in favor of

providing fresh change of option for contribution to pension fund on the wages

exceeding the statutory ceiling.

Here we also take this opportunity to refer to the latest circular received by

us from the public domain of EPFO (Copy Enclosed) where by it has been directed

to all concern offices dealing with employee's pension to abide by the order of the

Hon'ble Supreme Court of India vide SPL 33032- 33033 of 2015 where it had been

clearly mentioned that from the deposit of the employer's share @12 % in the

Provident Fund on the actual salary exceeding the statutory ceiling, 8.33% of the

salary exceeding the ceiling amount can be diverted to the Pension Fund. This has

also been approved by MOL&E on 16.03.2017. Thus as per the verdict of the

Hon'ble Supreme Court of India as well as the approval from MOL&E, a member

contributing to the Provident Fund on the wages exceeding the statutory ceiling

cannot be debarred from exercising the option to contribute on such higher wages

to the Pension Fund and hence it is legally binding on the OIL INDIAEMPLOYEES

PENSION FUND (OIEPF) as well. Basic reason of the verdict of the Hon'ble

Supreme Court of India was that any benevolent scheme like pension ought not to

be allowed to be defeated by any cut off date to contribute on the wages exceeding

the statutory ceiling.

It is contrary to note that while a section of the active members of the OIEPF

are not being permitted to change the option of contribution to EPS 95 after June

2006 onwards and the provision of choosing option of contribution is however

kept open for the fresh recruitees as per the earlier decision taken by Board Of

Trustee on the 46th meeting held on 28th January ,2015 to avoid curtailment of

benefits for the new members w.e.f. 1St September 2014, which by itself is

contradictory.

We also understand that D(HR&BD)is trying to obtain AG's opinion in this

regard for last few months. Though this is an appreciable move, however the delay

in getting the opinion is actually making our members worried since some of them

had already superannuated or at the verge of being separated soon. They are

holding with a hope of the favorable decision to contribute to the maximum of

salary and as such many of them did not withdraw the PF fund till date. It is also

to be noted that though AG's opinion is desirable, it may not be hard and fast

since we are not contradicting with the Hon'ble Supreme Court's verdict and

obtained the Legal Opinion from learned counselor also.On the other hand, kindly

note that OIEEA being the initiator of the proposal and OIL Superannuation Trust

Funds Board being the approver, probably the AG's approval may not be

mandatory since the initiator and approver are not the same entity.

In a nut shell, the delay in the whole process is resulting in an unhappy

situation amongst a large group of executives & employees of OIL. It is our humble

submission and request that being your good self being CMD of the company and

also the Chairman of the Superannuation Trust Funds of OIL, we look forward and

appreciate for a conclusive decision from your end in the next Trustee Meeting in

favor of the executives & employees long standing wishes to allow for the change of

option of contribution on the actual wages exceeding the statutory ceiling.

Sub: DELAY IN IMPLEMENTATION OF HON'BLE SUPREME COURT ORDER ON PAYMENT OF

PENSION ON HIGHER WAGES - REGARDING.

Sir,

Attention is drawn to Head Office Circular dated 23.03.2017 vide which instructions

were issued to all field offices to take necessary action in accordance with the order dated

04.10.2016 of the Hon'ble Supreme Court in SLP No.33032-33033 of 2015 as approved by the

government and as per the provisions of the EPF & MP Act, 1952 and Schemes framed

thereunder.

2. However on review of the information received from field offices it is noticed that

following offices as mentioned below have reported for compliance on revised pension on

higher wages as referred above.

3. It has also come to notice that some offices have not complied the instructions of Head

Office based on the Hon'ble Supreme Court order d~ted 04.10.2016 as referred above on

revision of the pension on higher wages despite applica'tions received in this regard, by taking

the plea that reference has been made by those offices to Head Office and that reply has not

been received for the clarifications/ guidelines sought from Head Office.

4. In this context, the following observations may be noted:

i) Payment of benefits to the members of the EPS-95 have to be regulated as per the

provisions of the scheme and all concerned are required to comply with the said

provisions.

ii) The manual for settlement of pension alongwith the module for ca lculation in the

software has already been circu lated from time to time.

iii) Even prior to the Hon'ble Supreme Court order dated 04.10.2016 Pension cases on

higher wages were being settled as per the scheme provisions by utilizing the

existing software.

iv) IS Division has already clarified that the revision of pension on higher wages can be

processed by utilizing the 10D specia l module.

v) No instructions can be kept aside for compliance only on the ground that reference

has been made to Head Office for further clarification on assumption basis without

attempting to comply those instructions practically. Moreover, the revision of cases

as detailed out in Para 2 above clearly shows that many field offices are taking

appropriate actions on the detailed order of the Hon' ble Supreme Court duly

circulated by Head Office for compliance by utilizing t he provisions already existing

in the relevant software, whereas some offices are deliberately not taking any

action to revise the pension claims to eligible members by taking one plea or the

other.

vi) Field functionaries are expected to know the provisions of the Act and Scheme and

comp ly accordingly.

vii) Most of the references made to Head Office are sent directly bypassing the Zonal

Office and containing no recommendations / suggestions of RPFC-1 and Addl.CPFC

(Zone);

viii) Non-settlement of pension cases in respect of eligible members in light of the

Supreme Court order dated 04.10.2016 has not only put the concerned members to

inconvenience but may also amount to disobedience of instructions of Head Office

for compliance of the order of the Hon'ble Apex Court.

5. Therefore, it is once again directed to take appropriate steps to revise the pension cases

of all the eligible members as per the existing sof.tware and the provisions in the Pension

Scheme. All references made to Head Office on modalities of revision of pension as per the

Hon' ble Supreme Court order on the matter may be treated as disposed and Non est.

6. The number of grievances due to non-settlement of eligible cases is rising and it is made

clear that the concerned RPFC-1 / lncharge of the Region will be held responsible for denial /

delay in settlement of such cases to eligible app licants. If any applicant is found not eligible for

revision of pension as per Hon'ble Supreme Court order, the same must be conveyed to the

applicant within seven days of receipt of such request.

7. All the reference made to the Head Office on the issue of revision of pension on higher

wages are accordingly disposed of and in case any Field Office still requires any

clarification/guideline, specific query may be forwarded through proper channel to the Head

Office duly incorporating the observations/suggestion of RPFC-1/0IC and ACC Zone in this

regard.

2) The Hon'ble Apex court in SLP No.33032-33033 of 2015 observed that the refere1ce

to the date of commencement of the Scheme or the date on which the salary exceeds t~e

ceiling limit are dates from which the option exercised are to be reckoned with for ca cu at1on o: pensionable salary. The said dates are not cut-off dates to determine the eligib1I t'y o: ·-e employer-employee to indicate their option under the proviso to Clause 11(3) of the Pe 5!

Scheme. It has further been observed that a beneficial Scheme, ought not to be allov-.ec :o :­defeated by reference to a cut-off date, particularly, in a situation where (as in tre :)-ese-:

case) the employer had deposited 12% of the actual salary and not 12% of the ce1 ng z

Rs. 5000/- or Rs. 6500/- per month, as the case may be.

In a situation where the deposit of the employer's share at 12% has oee- - ·-e actual salary and not the ceiling amount, the Provident Fund Commissioner cou d see· :: -e:: ... -"

3) Accordingly a proposal was sent to MOL&E to allow members of the Employees'

Pension Scheme, 1995 who had contributed on higher wages exceeding the statutory wage

ceiling of Rs. 6500/- in the Provident Fund to divert 8.33% of the salary exceeding Rs 6500/- to

the Pension Fund with up to date interest as declared under EPF Scheme, 1952 from time to

time to get the benefit of pension on higher salary on receipt of joint option of the Employer

and Employee.

4) The MOL&E vide letter dated 16.03.2017 has conveyed its approval to allow

members of the Employees' Pension Scheme, 1995 who had contributed on higher wages

exceeding the statutory wage ceiling of Rs. 6500/- in the Provident Fund to divert 8.33% of the

salary exceeding Rs.6500/- to the Pension Fund with up to date interest as declared under EPF

Scheme, 1952 from time to time to get the benefit of pension on higher salary on receipt of

joint option of the Employer and Employee. (copy enclosed for ready reference}

5) The officers in charge of all field offices are directed to take necessary action

accordingly in accordance with the order of the Hon'ble Supreme Court in SLP No.33032-

33033 of 2015 as approved by the Government and as per the provisions of the EPF & MP Act,

1952 and Schemes framed there under.
