OUR LAW SCHOOL IS A WONDERFUL AND EXCITING PLACE. The energy that pervades Inlow Hall every day is palpable and bears witness to the fact that this is one of the most dynamic and interesting places in the entire country to study and research how the law and our legal system shape, interact with, and impact our society.

One factor that makes this such a fabulous environment for legal education is the school’s location right downtown in one of the most vibrant cities in America. Being within easy walking distance from the state capitol building and all of the state agencies, the federal and state trial and appellate courts, and untold numbers of law firms, businesses, and cultural, educational, sports, and other non-profit organizations of every imaginable kind, provides a wealth of resources that enriches our school and our students’ opportunities immeasurably. Few law schools in America can provide so many resources and opportunities within a stone’s throw.

As a result, few law schools in America are as engaged as ours with their local communities. The benefits that our alumni, faculty, and students provide to the political, economic, and civic life of Central Indiana are immense. Not only do our alumni make up roughly half the lawyers and judges, but they comprise a large segment of the political and business leadership, including the Secretary of State, the Secretary of Commerce, several legislators, the CEOs and senior executives of many leading businesses, and innumerable leaders of our universities and civic organizations. To list all of these distinguished alumni individually would take many pages, but it would be a mighty impressive list indeed.

Furthermore, our students make a huge contribution to the quality of life in this community. More than 500 IU-Indy law students have provided 70,000 hours of pro bono service to 178 different non-profit agencies that serve the community. Every year more than 150 IU-Indy law students serve for an entire semester as unpaid interns at dozens of government agencies, courts, and non-profit organizations in Central Indiana. Over the years, more than 1,500 live-client clinic students have represented more than 5,000 indigent clients in a wide variety of civil, criminal, disability, and immigration cases, and have had spectacular success in many, establishing precedents that have had a significant impact on the law.

The tremendous strength that being in downtown Indianapolis gives our school, and the great contribution our school makes to Central Indiana, are why we have dedicated this issue to the theme “Law and the City.” We want to highlight the great relationship and engagement between the City of Indianapolis and the IU School of Law – Indianapolis. We believe that when you read this issue you will come away extremely proud of your law school.

Incorporated into this issue of the magazine is our annual Dean’s Report. Within these pages we recognize those generous individuals who have contributed to the law school during the last fiscal year. We thank you for your support of the school and hope that you will continue to partner with us in the months and years ahead.

Professor López Wins Diversity in Practice Award

PROFESSOR MARÍA PABÓN LÓPEZ was chosen as the recipient of the Indiana

Lawyer’s 2008 Diversity in Practice Award on October 24 at the Conrad in downtown Indianapolis. She is pictured above with Greg Morris, IBJ media vice president and Byron Myers, chief managing partner at Ice Miller.

Prior to joining the law school in 2002, Professor López worked as an assistant U.S. Attorney, Criminal Division, for the U.S. Department of Justice, District of Puerto Rico in San Juan and practiced law in San Juan and Philadelphia.

At IU she has implemented new courses about issues related to diversity and ensuring an environment of inclusion. Her course, Race and the Law was first offered in the Spring of 2008.

Since June of 2003, Professor López has been an appointed member of the Indiana Supreme Court’s Court Interpreter Certification Advisory Board, a project of the Race and Gender Fairness Commission. She is also a member of the Latino Affairs Committee of the Indiana State Bar. In December 2007, Indiana Chief Justice Randall T. Shepard named Professor López, the only academic, to the State Board of Law Examiners.

In addition, Professor López is currently working on a book about the education of immigrant children. She was presented with the 2007 Rabb Emison Award from the ISBA recognizing her commitment to promote diversity and equality in the legal profession and in the membership of the Indiana State Bar.

Law School Hosts Roundtable Discussion on the Economy

FORECLOSURES RISE. The stock market plummets. Credit markets freeze. Huge companies go bankrupt or are effectively nationalized. Former Federal Reserve chief Alan Greenspan says we’re in a “once-in-a-century” financial crisis. Politicians and pundits predict a depression.

The current economic crisis set the stage for a Roundtable Discussion: The

Economic Crisis and The Emergency

Economic Stabilization Act of 2008, on Thursday, October 23 at the law school. Five members of the law school faculty discussed the issues that impact today’s economic woes, before a packed house of students, faculty and concerned members of the public.

The program was organized by Professor Max Huffman, who spoke on consumer credit ramifications. Other participants were Cynthia A. Baker, Clinical Associate Professor of Law and Director, Program on Law and State Government, who addressed the impact on state and local government finance; Antony Page, Associate Professor of Law and Dean’s Fellow, who spoke on “From Mortgage Crisis to Financial Meltdown;” Nicholas L. Georgakopoulos, Harold R. Woodard Professor of Law, who tackled the topic, “From Financial Crisis to ... (Great Depression?)” and Lloyd T. “Tom” Wilson, Jr., Professor of Law and Chair-Elect, AALS Section on Real Estate Transactions who provided comment on “Understanding the Mortgage Crisis.”

Elizabeth Monroe ’02, Receives Award for Scholarship on SCOTUS History

ELIZABETH BRAND MONROE, ‘02, Associate Professor of History at IUPUI, has been honored by the Journal of Supreme

Court History Board of Editors for her 2007 article “The Influence of the Dartmouth College Case on the American Law of Educational Charities.” It was chosen as the best article for the year and was published in the March issue of the journal.

Monroe’s article examines the 1819 Supreme Court case Dartmouth

College v. Woodward where the New Hampshire legislature attempted to revise the university’s charter to allow the reinstatement of the former Dartmouth president. The Supreme Court’s ruling in favor of Dartmouth College allowed the school to remain a private institution without state interference.

Monroe attended the Supreme Court Historical Society annual dinner in Washington, D.C. on June 2nd at the Supreme Court, where she was presented the Hughes-Gossett Award by Justice Anthony Kennedy (pictured above).

Debra McVicker Lynch Appointed U.S. Magistrate Judge

DEBRA McVICKER LYNCH, ’86, has been appointed to the position of United States Magistrate Judge. This position became available due to the elevation of William T. Lawrence, ‘73 to the position of federal district judge.

Prior to her appointment, Lynch was of counsel at Taft Stettinius & Hollister LLP (formerly Sommer Barnard) where she worked for more than 20 years. Her practice included litigation of contract disputes, business dissolutions, antitrust matters, securities fraud cases, professional malpractice actions, and non-competition and trade secret matters. Lynch served as a law clerk to the Hon. Sarah Evans Barker from 1986 - 1988.

Lynch is also an adjunct professor at the law school, teaching the Complex Litigation course. She served as Special Master for Judge Sarah Evans Barker in the Bridgestone/Firestone Tires Products Liability Multidistrict Litigation from 2000 to 2004.

Lynch is a summa cum laude graduate of the law school, where she served as Editor-in-Chief of the Indiana Law Review.

United States Magistrate Judges are appointed by the Judges of the U.S. District Court for a term of eight years, and are eligible for reappointment to successive terms. A Magistrate Judge Merit Selection Committee chaired by retired Magistrate Judge V. Sue Shields reviewed more than 50 applications and recommended five candidates for the position. The district judges of the court then selected Ms. Lynch from among those five candidates.

Professor Edwards Receives Award for International Distinction

On August 1, 2008, Professor George E. Edwards was awarded the Ronald Harmon Brown Award of International Distinction from the National Bar Association (NBA). Professor Edwards was unable to attend the NBA dinner in Houston, Texas at which the award was presented because he was on his way from Laos to Thailand to make presentations on behalf of the law school’s Program in International Human Rights Law.

The following are excerpts from Prof. Edwards’ acceptance speech, delivered on his behalf:

“I am proud that the NBA has permitted me to be a part of its noble effor ts to promote and protect international human rights, not only in the United States, but around the world…. We have made great strides towards ensuring human rights and the rule of law. But, much more needs to be done.

Human rights protections begin with knowledge about what our rights are, who is responsible for ensuring our rights are not violated, what steps to take when our rights are violated, and how our human rights are to be enforced…. Knowledge is power. Power is meaningless, unless we take action.”

Alumni Organize Legal Aid Centre in Kenya

A TRAILBLAZING LEGAL AID ORGANIZATION has been established in Kenya thanks to the efforts of Judge Patricia Riley, ‘74, Indiana Court of Appeals, and Fran Quigley, ‘87, director of operations for the IU partnership between the Indiana University School of Medicine and Moi University in Eldoret, Kenya. The Legal Aid Centre of Eldoret (LACE) officially started in September with a small staff and initial funding from the Reuben Family Foundation and the Indianapolis Rotary Club. LACE is currently located in the hospital where the Nobel Peace Prize-nominated AMPATH program has IU physicians and medical students helping Kenyans living with HIV/AIDS. Riley and Quigley started LACE because many of the medical patients are in need of legal as well as medical help, especially in the areas of land rights and family law.

The law school plans to collaborate with LACE by offering a Kenyan lawyer or lawyers a full scholarship to attend the LL.M. program in Indianapolis on condition that they agree to work at least two years as a staff attorney at LACE, as well as to coordinate legal work assistance for LACE from volunteer LL.M. graduates and students while enrolled as an LL.M. student.

The program is seeking other funding sources and hopes to expand its case load capacity. The organizers hope to arrange a trip for attorneys from Indiana to see the centre in action in the near future.

Celebrating Law School

Law andtheCity

On Thursday evening, October 16, the law school hosted a private reception to kick off the school’s Board of Visitors Summit. More than one hundred people joined in celebrating the school’s many partnerships with the State of Indiana and the City of Indianapolis. This is an important time in the history of the school, as we embark upon a bold new era of increased collaboration with our community stakeholders. In addition to our distinguished Board of Visitors and other university and community dignitaries, a special guest at the event was Indiana University President Michael A. McRobbie. Following remarks from President McRobbie and Dean Gary R. Roberts, guests enjoyed music provided by students from IU’s Jacobs School of Music.

AND THAT’S THE CONDENSED LIST OF CIVIC WORK. “It’s my way of putting back some of what I’ve been given,” Johnson says. “I’m living the American dream.”

Johnson also is one of the law school’s Partners in Progress donors as a member of that campaign’s Landmark Society, for donors of $10,000 and above. He characterizes the gift as “modest,” considering what a law degree has given him.

“Law school is a fantastic opportunity and it had a huge impact on my life,” he says. “Sometimes, I think we may take that opportunity for granted. We need to cherish the law school and the opportunities it has given us, and we need to nourish the law school.” Touched by fantastic people

Johnson grew up in Indianapolis and was educated in the public schools—in 2007 he was inducted into the Indianapolis Public School Alumni Hall of Fame—and credits early influences including his parents, teachers, coaches and governmental officials for inspiring him to dream of law school. One teacher made him write the words “I can” 100 times on the chalkboard and the late

U.S. Representative Julia Carson reminded him that he was standing on a lot of shoulders of individuals who had preceded him.

At Purdue University, Johnson earned a bachelor’s degree in political science and industrial management. He joined the Indiana State Police and as a young man in his mid-20s, served as Governor Otis Bowen’s bodyguard. During his first year as a state trooper Johnson started law school, where Professors Bill Marsh and Gerald Bepko were important influences.

“The state police was a pretty conservative, law-and-order organization,” he says. “What I quickly learned in law school is that we are a nation of laws, and that the oath we take to uphold those laws protects us all.”

Johnson joined the U.S. Navy Reserves in 1981 and retired as a lieutenant colonel in 1993. He worked in government relations for Sagamore-Bainbridge Inc., as a director of security for the Indiana State Lottery and as an Indiana State Police deputy superintendent before joining Ice Miller in 1993.

“I’ve been touched by some fantastic people,” Johnson says. “What you can do with that is pass it on.”

Life and Law School Shaped Lacy Johnson

As an attorney and partner in the Indianapolis firm Ice Miller, LLP, Lacy Johnson, ’81 has a busy law practice, but he’s at least as busy outside the office. A member of the law school’s board of visitors and the IU Foundation board of directors, Johnson also serves on the board for the Indianapolis Airport Authority, the U.S. Congressional Black Caucus Political Education and Leadership Institute, Indiana Black Expo, Conner Prairie, the IUPUI Advisory Board, Simon Youth Foundation, Indianapolis Downtown, Inc., the Oaks Academy, American Pianists Association and the Indiana Museum of African American History.

FRED GLASS, ’84, HAS SEVERAL GOALS for the Indiana University athletic department—and winning national championships isn’t the first.

Glass, who was named director of intercollegiate athletics by IU President Michael A. McRobbie on October 28, says his top two priorities are to ensure that IU complies with NCAA rules and regulations and that IU’s athletes achieve success academically.

“I want to be excellent on the field, the court, the pool. I want to win championships and have winning records,” Glass said. “But I think we have to do two things first. We’re going to be known as a university that follows the rules, and our athletes are going to excel academically.”

Using a sports metaphor, Glass said the job offer from IU “came out of left field,” and that he was happy practicing law as a partner at the Indianapolis law firm Baker & Daniels.

But his secured transactions professor from law school—former IUPUI Chancellor Gerald Bepko—recommended Glass for the job.

“It’s a nice example of how those relationships you have in law school stay with you for a lifetime,” Glass said.

Glass recalled turning to Bepko for advice several times during his career, including once when he was preparing to graduate from law school and had two enviable positions on the horizon: an offer from a big Indianapolis law firm and a clerkship with U.S. Federal District Court Judge S. Hugh Dillin.

He chose the clerkship.“He [Bepko] advised me that when trying to make a decision,

choose the one that will give you the most opportunities for the future,” Glass said. “It’s advice I’ve followed throughout my career and I’ve been able to do a lot of different, interesting things.”

A native of Indianapolis, Glass also earned a bachelor’s degree from IU in 1981. He served as chief of staff to former Indiana Governor Evan Bayh from 1989 to 1993 and was transition team chief for former Indianapolis Mayor Bart Peterson when he took office in 2000.

Peterson appointed Glass to the Capital Improvement Board, which owns and operates Lucas Oil Stadium, the Indiana

Convention Center, Conseco Fieldhouse and Victory Field. During his eight-year tenure as CIB president, Glass represented the mayor in successful negotiations to keep the Colts in Indianapolis and headed up the planning effort for construction of Lucas Oil Stadium and the expansion of the convention center.

Glass served on the organizing committees for the NCAA Final Four Tournament in 2000 and again in 2006, and negotiated a deal to make the city part of a permanent rotation to host

NCAA Final Fours. He also was on the executive committee of the 2002 World Basketball Championship and co-chaired the 2006 local organizing committee for the Big Ten Men’s and Women’s Basketball Tournaments.

Most recently, he was president of the City of Indianapolis’ 2011 Super Bowl Bid Committee, which although not successful for that year, laid the groundwork for a successful bid for 2012.

In making the announcement, McRobbie praised Glass’s leadership and understanding of the challenges—and importance— of IU athletics.

“He has a well-earned reputation as someone who can get the big things done. He is exactly the person we need to take on the challenges our Athletics Department will encounter in the next decade,” McRobbie said.

AT THE LEGAL WRITING INSTITUTE (LWI) conference held at the IU School of Law-Indianapolis in July, Clinical Associate Professor of Law Kenneth D. Chestek was chosen as President-Elect of the organization.

“ I a m h o n o r e d t o b e chosen as President-Elect of

LWI,” said Professor Chestek. “As the importance of skills education in American law schools grows, LWI will continue to be at the forefront of changes in the legal academy. During my term as President I hope to continue LWI’s growing outreach to the practicing bar nationwide, in order to help bridge the gap between law school and law practice.”

IU LAW-INDIANAPOLIS HOSTED the 13th national biennial conference of the Legal Writing Institute (LWI), July 14-17, bringing more than 600 legal writing faculty members from 13 countries to Inlow Hall. The program kicked off with a reception at the Artsgarden in downtown Indianapolis.

Conference sessions covered more than 100 different topics, among them, Using ‘Real World’ Documents to Teach Persuasive Writing; The Changing Nature of Legal Research and Legal Authority in the Electronic Age; Dealing with Race, Culture and Gender in the Classroom; and Communicating with Millennials: Teaching and Preparing the Next Generation of Lawyers.

The Site Chair for the national conference was Professor Deborah McGregor, Assistant Director of the Legal Analysis Research and Communication Program at the law school. All of the members of the school’s legal writing faculty were involved with the planning for the conference, including the director, Professor Joan Ruhtenberg, and Professors Cynthia Adams, Ken Chestek, Jim Dimitri, Allison Martin, and Joel Schumm.

The Legal Writing Institute (LWI) is a non-profit organization dedicated to improving legal writing by providing a forum for discussion and scholarship about legal writing, analysis and research. The LWI has more than 2,200 members and includes representatives from 38 countries.

Law School Hosts National Legal Writing Conference

Professor Ken Chestek Becomes President-Elect of LWIProfessor Chestek has been active in numerous

capacities with the LWI, an organization of more than 2,200 legal writing professionals from all over the country—and increasingly around the world. While primarily an organization of legal writing professors, LWI also includes a growing number of practicing lawyers and judges. The largest voluntary organization of law professors in the country, its mission is to provide law schools and law professors with resources, advice, scholarship and materials to improve the quality of legal writing teaching.

Previously, Professor Chestek served as a member of the board of directors and treasurer of LWI. From 2005-08 he co-chaired the ALWD/LWI. He has published and given lectures on a wide variety of subjects, including persuasion, teaching methods, tax exemption policy, hospitals and the uses of computers in law offices.

CLINICAL PROFESSORS OF LAW, CYNTHIA M. ADAMS AND DEBORAH B. MCGREGOR, co-authored a new resource for international lawyers preparing to practice in the United States or deal with U.S. companies. The International Lawyer’s Guide to Legal Analysis and Communication in the United States uses a global perspective to put the basic principles of legal reasoning and communication into context.

The book includes a concise introduction to the U.S. legal system, the common law as U.S. precedent and the anatomy of a U.S. lawsuit, as well as practical guidance for law study in the United States, including how to brief a case for class and other suggestions about the law school classroom.

U.S. Court of Appeals for the Seventh Circuit Visits Law SchoolOn September 23, 2008, the U.S. Court

of Appeals for the Seventh Circuit heard oral arguments for three cases in the Wynne Courtroom. It was the first time since 1994 that they had visited the law school and it was their first visit to Inlow Hall. The three-judge panel consisted of Chief Judge Frank H. Easterbrook, Judge Michael S. Kanne, and Judge John D. Tinder.

After hearing arguments in USA v. Ricky L. Fines and LeRoy F. Miller; Jonathan S. McGlothan, M.D. v. Tracey Wallace and Eric Wallace; and Sondra J. Hansen and William R. Hansen Individually and on behalf of C.H. v. Board of Trustees of Hamilton Southeastern School Corporation and Dimitri B. Alano, the judges held a question and answer session for students and the public. The judges answered questions and shared stories about life at the 7th Circuit for 45 minutes. The Indianapolis Bar Association hosted a reception for the judges following the arguments in the Conour Atrium.

ON DECEMBER 30, 2003, THE PRESIDENT OF THE UNITED STATES, through the Secretary of Defense, invited Chief Justice Williams to be a member of the then-Military Commissions Review Panel for tribunals to be held in Guantanamo Bay, Cuba, with the rank of Major General. The Military Commissions Act of 2006 created the Court of Military Commission Review on which Williams serves as a civilian appellate judge. On November 21, 2007, the Secretary of Defense appointed Chief Justice Williams Chief Judge of the U.S. Court of Military Commission Review.

Justice Williams is a member of the U.S. Lincoln Bicentennial Commission and Chair of the Rhode Island Abraham Lincoln Bicentennial Commission. He is currently at work on an annotated bibliography of all books and pamphlets written about Abraham Lincoln, due to be published in time for the bicentennial of Abraham Lincoln’s birth in 2009.

The Honorable Frank J. Williams, Chief Justice of the Supreme Court of Rhode Island, delivered the 12th annual Indiana Supreme Court Lecture at Inlow Hall on Tuesday evening, October 7. The founding chairman of the Lincoln Forum, Chief Justice Williams has been a leader in the Lincoln community for 30 years, first as president of both the Lincoln Group of Boston and the Abraham Lincoln Association. In addition, he is a major collector of Lincolniana, a peripatetic lecturer before Lincoln and Civil War groups, and a scholar whose books include JUDGING LINCOLN (Southern Illinois University Press, 2002) and, with Edna Greene Medford and Harold Holzer, THE EMANCIPATION PROCLAMATION: THREE VIEWS (Louisiana State University Press, 2006).

ACROSS THE COUNTRY, STATES CONTINUE TO STRUGGLE with issues of education funding, high school graduation rates, the meaning and function of standardized test scores, matching educational requirements to changing work force needs, recidivism, and issues of adequacy with respect to public education’s role in a democracy. On October 3, the law school’s Program on Law and State Government (PLSG) examined these issues during its eighth annual fellowship symposium.

The first half of this year’s symposium focused on the effects of high-stakes testing on student success. Relationships between recidivism rates and educational opportunities for juvenile offenders highlighted the second half of this year’s event.

Student fellows for 2008 were Jonelle Redelman, who presented a paper on “Kids Who Fail: State Governments’ Response to Failure,” and Anderson Sanders, whose fellowship address focused on “Educating Incarcerated Kids: Lowering Double Digit Recidivism.” Speakers included Professor Michael Heise, Cornell Law School, whose topic was “Litigation Impacting States’ High-Stakes Testing Mandates,” Professor John Robert Warren, Professor of Sociology, University of

Intellectual Property Issues Take Center Stage at Annual CLE Program

This year’s Annual CLE Program on October 14 took place in the Wynne Courtroom and was entitled “Protecting the Idea: Patent Law and Other Intellectual Property Issues.” Speakers included Dean Gary R. Roberts and Mark A. Roesler, ’82, Chairman and CEO of CMG Worldwide, who spoke on “Intellectual Property & The Sports Industry.” Professor Laura Heymann, William & Mary School of Law, made a presentation on the topic, “The Boundaries of Intellectual Property in the Age of the Internet,” and Professor María Pabón López, IU School of Law-Indianapolis, gave a one-hour lecture on ethics, “Indiana Professional Responsibility Update.”

In the afternoon, the program focused on patent issues. “Judicial Attempts at Patent Reform” was presented by Charles Lipsey, Finnegan Henderson, and Professor Emily Morris, IU School of Law-Indianapolis, presented on “The Future of Patent Reform.” Rounding out the program were two alumni of the law school who now work in Washington, D.C. Janet Gongola, ’03, Associate Solicitor, Office of the Solicitor, U.S. Patent & Trademark Office, and Kirby Lee, ’03, Trial Attorney, Intellectual Property Section, Commercial Litigation Branch Civil Division, Justice Department who spoke on “Patent Law & Policy: A View from Washington.”

RECENTLY, VOYLES MADE A GENEROUS $50,000 PLEDGE to the IU School of Law-Indianapolis, earmarked for the law school’s clinics. The clinics have offered more than 1,500 law school students the opportunity to practice their skills and provide access to legal counsel to more than 5,000 clients since they were established over 25 years ago.

“It’s my way of giving back to the law school that gave me everything,” Voyles says.

Sense of humanityIn addition to representing famous clients—from boxer

Mike Tyson to players from the Indianapolis Colts and Indiana Pacers—and less famous clients in need of counsel, Voyles has been a leader in the profession and will be president of the Indianapolis Bar Association in 2009. He is a fellow of the American College of Trial Lawyers, a member of the American Board of Criminal Lawyers, a board member of the National Association of Criminal Defense Lawyers, and a member of the Indiana Supreme Court Character and Fitness Committee.

What his clients—and adversaries—may not know about are the experiences outside of the courtroom that helped shape the kind of lawyer he is.

Voyles earned a bachelor’s degree from Illinois College in Jacksonville, Illinois, where he worked with students at the nearby Illinois School for the Visually Impaired. Later,

as a law student, he worked during the day with clients with disabilities at Easter Seals Crossroads, and as an adjudicator for the Social Security Administration while taking classes at night in the Maennerchor Building.

Those experiences helped Voyles understand that society needs lawyers who want to help people.

“A trial lawyer has to have a sense of humanity and like people—all kinds of people,” Voyles says. “I’ve represented people with disabilities and misfortunes, and I’ve represented people who seem to have everything.”

A clerk to John J. Dillon, ’52, Voyles graduated from law school and joined his uncle, George Ober, ’44, in a law practice that evolved into the present-day firm of Voyles, Zahn, Paul, Hogan & Merriman.

Voyles says he was fortunate to have professors like Larry Jegen, John Grimes, Ben Small, Bruce Townsend and Cleon Faust who were “good lawyers who loved the law,” and law partners who taught him—by example—the importance of integrity.

His gift to the law school, he hopes, will prepare the next generation of trial lawyers.

“I hope that young men and women in law school now have the passion for the law that I have had,” Voyles says. “The better prepared they are, the better our society will be.”

And it’s different, every day,” says Voyles, an Indianapolis attorney whose criminal defense practice has earned him a formidable reputation. The gleam in his eyes when he talks about his profession reflects passion for a career that’s still going strong after 40 years.

Fostering the Rule of Law in Iraq

EVANSVILLE NATIVE REBECCA STATON, ’01, says while she was in law school she really did not know what she wanted to do following graduation. Through an On Campus Interview (OCI) organized by the Office of Professional Development (formerly Career Services), Staton landed a job with the Marion County Prosecutor’s office where she worked for 6 years. She eventually worked as the Chief Gang Prosecutor. In that role she quickly realized she needed to look for ways to reach out to the community and get people talking, hopefully to help improve and coordinate gang prevention efforts in Indianapolis. She says she always tries to remember advice from her former boss, Marion County Prosecutor Scott Newman, who counseled her to maintain a “constant sense of outrage.” Staton says the prosecutor’s office was very willing to let her “do my own thing,” and let her craft programs. She says, “For the first time in my life I felt like I was doing something that really mattered. I liked feeling like I was part of something larger than myself.”

Then, in 2007, Staton received an e-mail from a colleague at the National District Attorney’s Association that gave details

about a job opportunity with the Department of Justice (DOJ) Office of Overseas Prosecutorial Development Assistance and Training (OPDAT) working on Rule of Law initiatives in Iraq. She applied and was accepted. Now she is approaching the end of her first year as a Resident Legal Advisor (RLA) in Iraq and is thrilled with the opportunity to put the skills she had honed in the prosecutor’s office to use in such an ambitious setting. She has spent most of her time in Kirkuk, an ethnically diverse, oil rich province in the northern part of the country, comprised of Kurdish, Turkman, and Arab populations.

In her job as a Resident Legal Advisor, she works to bring together, and build relationships between, the people and institutions involved in the legal system in Iraq. She has had the opportunity to put to good use her interpersonal and legal skills, as well as interagency experience she gained in Indianapolis working on the gang task force, where she had to deal with several different federal agencies, including the Federal Bureau of Investigation (FBI) and Immigration and Customs Enforcement (ICE). In addition, Staton had worked with law enforcement in Santiago, Chile and Calnali, Mexico. That interagency and international

to take root. “Superiors on all sides notifying everyone involved that they will be held accountable also helps. The goal is to build relationships that will be there long after the U.S. presence is gone,” Staton says.

While on vacation back in the U.S., Staton recently paid a visit to Inlow Hall in hopes of kindling a relationship between the law school in Kirkuk (which her office has assisted in getting

back on its feet) and her alma mater. She met with Dean Gary R. Roberts and Claire Grove, ’99, Assistant Dean for Graduate Studies about how such a fledgling alliance might develop.

experience, along with her background as a prosecutor, made her an excellent candidate for a job that often goes to people with experience at the U.S. Attorney level.

Staton is clearly excited and cautiously optimistic about the future of Iraq. She says, “Our Rule of Law efforts are starting to work in Kirkuk,” where she and her military and DOJ colleagues have worked to increase communication and trust between judges and police. She says that the police are frustrated because they see a low conviction rate of the perpetrators they arrest, while judges are often dubious of confessions and testimony obtained from suspects who may have been tortured. She describes visiting police stations and seeing the obvious accoutrements to torture installed in the buildings. Getting members of the judiciary and law enforcement together in face-to-face meetings to discuss these fundamental differences is helping to change the climate and the rule of law is starting

JUDGE G. MICHAEL WITTE, ‘82, is the 2008 recipient of the Indiana University Asian Alumni Association’s Distinguished Asian Pacific American Alumni Award. This award recognizes outstanding professional achievements and community service of Asian/Pacific American Alumni of IU.

In August, Witte received the Franklin N. Flaschner Award from the American Bar Association National Conference of Specialized Court Judges. The award is given to the outstanding judge in the nation who presides in a court of limited jurisdiction.

A lifetime member of the IU Alumni Association, Witte received his bachelor’s degree in forensic studies in 1979 and his law degree from the IU School of Law-Indianapolis in 1982. Witte, who serves as judge for the Dearborn Superior Court No. 1, was the first Asian American trial judge to be elected in the state of Indiana.

A nationally-recognized expert on highway traffic safety legal issues and known for his commitment to improving the public trust in the judicial branch of government and improving the performance of America’s judges, Witte has been a faculty member with the National Judicial College of the University of Nevada since 1994.

A finalist for the nomination to the Indiana Court of Appeals in 2008, Witte is the vice-chair of the judicial division of the American Bar Association and will become its chairman in 2011, another Asian American first. In addition, Witte belongs to the National Asian Pacific American Bar Association, Indiana State Bar Association, American Judges Association, and the Indiana Judges Association. Additionally, he was appointed to the Indiana Commission on Courts.

An involved alumnus, Witte is the president for the IU School of Law - Indianapolis Alumni Association, has been president of the Dearborn County Chapter of the IUAA and served as the coordinator of the Dearborn County IU Varsity Club. Active in his community, Witte is recognized as a leader for diversity and has been instrumental in reaching out to Asian and other minority youth in programs across the nation. The Hoosier Trails Council of the Boy Scouts of America named him a Distinguished Citizen in 1996, just one of many honors he has received.

Witte is the third recipient of the Distinguished Asian Pacific American Alumni Award, an honor established in 2006 by the IU Asian Alumni Association in conjunction with the IU Asian Culture Center. Witte, who was born in Batesville, Indiana, lives with his wife, Dawn, in Lawrenceburg, Indiana They have a daughter, Christy.

The award was presented to Witte during a dinner celebrating the 10th anniversary of the IU Asian Culture Center on October 3 in Bloomington.

Faculty NewsCYNTHIA ADAMS presented “Challenges in Negotiating

and Drafting International Dispute Resolution Provisions in Commercial Contracts,” at Bahcesehir University, Istanbul, Turkey, in August 2008.

CHANCELLOR EMERITUS GERALD L. BEPKO spoke on the topic of leadership to a convocation of the OneAmerica Financial Leadership Group on August 19th. He also represented the OneAmerica Board of Directors at the OneAmerica National Awards Convocation in Orlando, Florida July 23-26. September was a busy month for Chancellor Bepko. On September 5, he spoke at the annual reception to welcome the Bepko Scholars and Fellows to IUPUI. On September 8, he participated in the release to the media of the Indiana Higher Education Commission document titled “Reaching Higher for Indiana.” He presented the annual Bepko Spirit Awards at the IUPUI Employee Recognition Convocation on September 23, and was named a member of the Footlite Musicals Board of Advisors on September 30.

The first edition of Bepko’s Materials on Leadership and Law (165 pages) was published for the course in Leadership and Law, taught by Chancellor Bepko in the fall term, 2008.

SHAWN BOYNE presented a lecture on “Revisiting Damaska: Prosecutorial Discretion in Germany,” at the Untenured Academics Conference at Indiana University-Bloomington, August 5-6. She presented “From Coffee to Culture: Conducting Qualitative Research Abroad,” at the Midwest Law & Society Retreat, at the University of Wisconsin Law School, September 19-20.

In June, KAREN E. BRAVO discussed her paper Regional Trade Agreements and Labor Liberalization: (Lost) Opportunities for Experimentation? at the Law and Society Association and Canadian Law and Society Association 2008 Joint Meeting held on May 29 through June 1, 2008 in Montreal, Canada. Professor Bravo participated as a panelist on the panel “International Trade Regimes: Deconstructing Their Effects on Domestic Policy.” Her article of the same topic is forthcoming in the ST. LOUIS UNIVERSITY PUBLIC LAW REVIEW.

In September, in Minneapolis, Minnesota, Professor Bravo presented her research on the issue of whether the international anti-money laundering regime can serve as a model for the international effor ts against the trafficking in human beings. Professor Bravo served on a panel titled “Global Dynamics of Human Trafficking” at the University of St. Thomas Law Journal’s symposium: Human Trafficking: Global and National Responses to the Cries for Freedom which took place on September 25. Her ar ticle, “Follow the Money?: Does the International Fight Against Money Laundering Provide A Model for the International Fight Against Human Trafficking?” is for thcoming in the

UNIVERSITY OF ST. THOMAS LAW JOURNAL.On October 22, 2008, Professor Bravo participated in

the Southern Methodist University School of Law’s Faculty Forum series in Dallas, Texas. She presented her work on labor liberalization as a solution for the modern traffic in humans. Her paper “Free Labor! A Labor Liberalization Solution to Modern Trafficking in Humans,” is forthcoming in the international law journal of the University of Iowa College of Law – the JOURNAL OF TRANSNATIONAL LAW AND CONTEMPORARY PROBLEMS.

Also in October, Professor Bravo participated in the historic conference, Commemorating 1808: Fighting for the Right to Dream – 200th Anniversary of the Federal Prohibition on Importing Slaves organized by and held at the University of Toledo College of Law in Toledo, Ohio, October 24-25. Professor Bravo presented her work on the implications of the trans-Atlantic slave trade for the modern traffic in humans. Professor Bravo’s paper “Exploring the Analogy between Modern Trafficking in Humans and the Trans-Atlantic Slave Trade,” was published as the lead ar ticle in the winter issue of the BOSTON UNIVERSITY INTERNATIONAL LAW JOURNAL and can be found at 25 B.U.J. INT’L L. 207 (2007). Also in October, Professor Bravo presented her paper “Transborder Labor Liberalization: A Path to Enforcement of the Global Social Contract,” at the Workshop on Work, Employment, and Industrial Relations in the New Social Contract held at the Cecil Rhodes House, Oxford University, United Kingdom, and organized by the Foundation for Law, Justice and Society.

Earlier this year, Professor Bravo received an Indiana University Trustees Award for Excellence in Teaching. She was also named as a John S. Grimes Fellow and a Dean’s Fellow.

KEN CHESTEK’s article, “The Plot Thickens: The Appellate Brief as Story” appeared in the 2008 edition of the JOURNAL OF THE LEGAL WRITING INSTITUTE at 14 LEGAL WRITING 127 (2008). At the LWI Biennial Conference held in Indianapolis in July, he was elected President-Elect of LWI. Also at the Biennial conference, he was a member of a panel presentation, “Geek 101: Using Technology Effectively (Without Having to Know the Difference Between Star Trek and Star Wars).” In August, he was the invited speaker at the annual breakfast meeting of the Appellate Practice Committee of the American Bar Association’s Section of Litigation, held in conjunction with the ABA Annual Meeting in New York City. He spoke about his continuing research into the use of narrative in appellate brief-writing, including a study he is working on as a follow-up to his Plot Thickens article. In September, Professor Chestek was invited to moderate a panel discussion on the proper role of pathos in persuasive writing. The conference, A Dialogue About Persuasion in Legal Writing & Lawyering, was held Sept. 19 at Rutgers University School of Law—Camden.

Professor Cole spoke on “Developments in Climate Change Policy and Implications for Indiana,” at the Indianapolis Chamber of Commerce Conference on Energy Policy, in Indianapolis, on June 19. Two days later, he gave a presentation on “Climate Change and Collective Action,” at the Annual Meeting of the International Society for New Institutional Analysis, in Toronto, and on June 24 he spoke on “Benefit-Cost Analysis and Collective Action: The Case of Climate Change,” at the Annual Meeting of the Society for Benefit-Cost Analysis in Washington, DC. On October 3, Professor Cole gave a presentation on “Climate Change and Collective Action,” at the Annual Meeting of the Midwest Law & Economics Association at the Searle Center, Northwestern Law School, in Chicago.

JENNIFER DROBAC served as Organizing Host of the Inaugural Midwest Family Law Conference, “Jazzing Up Family Law,” which took place at the law school on June 13. Over 40 family law scholars and lawyers from across the nation presented work at this conference. Judge James W. Payne, Director Indiana Department of Child Services, provided the keynote address. During the summer, Professor Drobac served as director of the Indiana University Central & Eastern European Law Summer Program, Dubrovnik Riviera, Mlini, Croatia. Thirty-eight students from across the U.S. and Croatia participated in this program. Instructors from the University of Zagreb Law Faculty taught courses on subjects including human rights and business law.

Professor Drobac served as a 2008 Manuscript Referee for CHILD ABUSE & NEGLECT, a scholarly journal, and she continues her service as Vice Chair and Trustee on The Henry J. Kaiser Family Foundation Board of Trustees, Menlo Park, California.

PROFESSOR EMERITUS JEFF GROVE served as University External Assessor for a Ph.D. dissertation, “Transformation of the Chinese Judiciary from the Traditional to the Modern: A Study in Judicial Reform in Revolutionary Conditions,” prepared by a Chinese judge who is a Ph.D. candidate at the Graduate School of the University of Queensland, Australia.

MAX HUFFMAN was selected by the 2008 graduating class at his alma mater, the University of Cincinnati College of Law, to receive the Nicholas Longworth Award, recognizing his status as the outstanding alumnus for 2008. In September, Professor Huffman attended the Fordham International Antitrust Conference and the FTC’s workshop on Antitrust and Section 5 of the FTC Act in October. At the FTC Workshop, he was cited by

one panelist recognizing his input in the preparation of remarks on the respective roles of private and public enforcement in antitrust. Professor Huffman co-organized, moderated and presented at a Roundtable Discussion: The Economic Crisis and the Emergency Economic Stabilization Act of 2008, held October 23, 2008, in the Wynne Courtroom at the law school. During the fall semester, Professor Huffman taught Antitrust and pursued scholarship on antitrust and consumer protection topics. He currently serves on the law school’s curriculum committee.

ELEANOR KINNEY has published, “Dances with Elephants: Administrative Resolution of Medical Injury Claims by Medicare Beneficiaries,” (Kinney and Sage) 5 INDIANA HEALTH LAW REVIEW 1 (2008). Her article, “The Corporate Transformation of Medical Specialty Care: The Exemplary Case of Neonatology,” appears in volume 36 of the JOURNAL OF LAW MEDICINE & ETHICS. “Health Care Funding,” (McCabe & Kinney), appears in Chicago Companion to the Child (U. Chicago Press, 2008).

Professor Kinney lectured on the topic, “Challenges in Health Law and Policy,” at the 2008 Graduate Program for Judges, sponsored by the Indiana Supreme Court and the Indiana Judicial Center in Nashville, Indiana in June. In July, she spoke on “Legal Perspective: Standards of Care,” at a conference on The Ethics of Pandemic Influenza Planning in Indiana: What Have We Done and Where Are We Going? Sponsored by the Indiana State Department of Health, in Indianapolis. In September, Professor Kinney served as the moderator for the Emergency Preparedness Conference, sponsored by the Marion County Health and Hospitals Corporation, in Indianapolis. In October, Professor Kinney spoke at a faculty colloquium at Emory University School of Law in Atlanta, Georgia, on the topic, “A Problem in Search of a Theory in Search of Access to High Quality and Affordable Health Care for All.” Also in October, she was a panelist at the Invitational Panel on Public Health Law, at the Annual Meeting of the American Public Health Association in San Diego, California. The panel’s topic was “Global Economic Integration – An Opportunity for Realizing the International Human Right to Health.”

With the IU Center for Bioethics Professor Kinney was awarded a grant to provide legal analysis for the Indiana State Department of Health to support the project, “Translating Ethics Advice into Practice: Public and Professional Outreach about Pandemic Flu Planning,” 2008.

Recently, NORMAN LEFSTEIN, PROFESSOR AND DEAN EMERITUS, served as the expert witness in two cases in which public defender programs challenged their caseloads as excessive, claiming that they were violating their duty to represent indigent clients competently under rules of professional conduct. The relief sought in both cases was to curtail the assignment of some of the new cases that the offices routinely received. In June, Professor Lefstein testified in Knoxville, Tennessee, on behalf of the Knoxville Public Defender, and in July he testified on behalf of the Dade County

Public Defender in Miami. No decision has yet been rendered by the trial court in the Knoxville case, whereas the Public Defender prevailed in the trial court in Miami and the case is now on appeal. In September, Professor Lefstein delivered the keynote address at a symposium on public defense at the University of Houston Law Center. His comments were titled “Reflections on the Right to Counsel after 45 Years: Texas and the Nation.” Also, in November, at the National Legal Aid and Defender Association meeting in Washington, D.C., he spoke about ways of controlling caseloads in public defense.

MARÍA PABÓN LÓPEZ published “A Tale of Two Systems: Analyzing the Treatment of Non-Citizens Families: in State Family Law Systems and Under the Immigration Law System,” 11 HARVARD LATINO L. REV. 229 (2008). She was a panelist at the Joint Annual Meeting of the Law and Society Association and the Canadian Law and Society Association held in Montreal on May 29 - June 1, 2008. The panel she participated in was a session discussing the book: OPENING THE FLOODGATES: WHY AMERICA NEEDS TO RETHINK ITS BORDERS AND IMMIGRATION LAWS by Kevin R. Johnson. Professor Lopez presented her work on immigration and family law at a panel on Family Law, Support, and Poverty during the Inaugural Midwest Family Law “Jazzing Up Family Law” Conference held at the law school on June 13, 2008. She also presented her work about colorblindness and racial privacy initiatives at the Second Big Ten Untenured Conference held at the Indiana University School of Law, Bloomington on August 5-6, 2008. Prof. Lopez presented an update on Indiana Professional Responsibility at the Protecting the Idea: Patents and Other Intellectual Property Issues program which took place at the law

school on October 14, 2008. Additionally, she received the Indiana Lawyer’s 2008 Diversity in Practice Award.

GERARD MAGLIOCCA holds the Fulbright-Dow Distinguished Research Chair in Middelburg, the Netherlands for the Fall semester. In October, he conducted a workshop at the University of Copenhagen on “The Use of History in U.S. Constitutional Interpretation.” In June, Professor Magliocca served on the faculty of the law school’s Master of Laws program in Alexandria, Egypt, where he taught Admiralty Law.

At the Thirteenth Biennial Legal Writing Institute Conference, held in July 2008, ALLISON MARTIN presented findings based on an interdisciplinary empirical study; the presentation was entitled “The Future’s So Bright, I Gotta Wear Shades: A Study of Hope, Optimism, Academic Performance, and Psychological Well-Being in Law School.”

JAMES NEHF traveled to Rio de Janeiro in August to present a lecture on “Unintended Consequences: How the Weakening of U.S. Consumer Laws Rocked World Financial Markets,” at a meeting of the International Law Association. The presentation discussed how the weakening of state and federal consumer protection laws in the residential mortgage market contributed to the worldwide financial crisis. Professor Nehf also published a book entitled THE FUTURE OF CONSUMER CREDIT REGULATION (Ashgate Publishing 2008), which he co-edited with faculty from the University of South Africa and the University of Bremen. He published a book chapter on the financing of manufactured housing in SECURED TRANSACTIONS UNDER THE UNIFORM COMMERCIAL CODE, and a chapter on misleading

On October 29, the law school hosted a Health Reform Debate, “What do YOU know about health care reform? Are you prepared for November 4th?” Differing health care reform agendas were debated by Professor of Pediatrics, Aaron Carroll, MD, MS, IU School of Medicine and Professor of Law and Medicine, David A. Hyman, JD, MD, University of Illinois. The event, which took place in the Wynne Courtroom, was co-sponsored by the Consortium for Health Policy, Law & Bioethics, the Health Law Society, the Hall Center for Law & Health, and IUPUI.

He also wrote several “Expert Commentaries” on secured transactions and consumer protection, which are available on LEXIS-NEXIS. Professor Nehf serves on the Executive Board of the International Association for Consumer Law, as the Chair of the Consumer Law Working Group in the Cyberspace Committee of the ABA Section of Business Law, and a legal advisor to the Streamlined Sales Tax Governing Board. He has also agreed to serve as Associate Dean for Graduate Programs at the law school, which oversees the school’s LL.M. and S.J.D. programs, beginning in January 2009.

DAVID ORENTLICHER’s article, “Presumed Consent to Organ Donation: Its Rise and Fall in the United States,” appears in volume 61 of the RUTGERS LAW REVIEW. In June, Professor Orentlicher spoke on the topic,“Presumed Consent to Organ Donation: A Dead End for Reform?,” at the 31st Annual Health Law Professors Conference, in Philadelphia, Pennsylvania. He made a presentation on July 14 on the topic, “Implementing Best Practices: Converting Good Ethics into Good Law,” at Confronting the Ethics of Pandemic Influenza Planning: The 2008 Summit of the States, in Indianapolis.

At the July 25th Bioethics for Breakfast Program, sponsored by the IU Center for Bioethics, Professor Orentlicher spoke on “Drug Development and Resource Allocation: Making New Advances Available to the Poor.” He spoke on Leadership Day, August 16, at the IU School of Medicine on “Reforming Health Care in America: The Physician’s Role,” and in September he made a presentation on “A Right to Health Care Under the Constitution: Why Not?” for the Constitution Day Program at Southern Illinois University School of Medicine, in Springfield, Illinois.

Also in September, Professor Orentlicher spoke on “Ethics and Lobbying,” at the Annual Meeting of the Government Affairs

Society of Indiana, in Indianapolis, on September 23, and gave a presentation on “Health Care Reform in the United States: The Lessons of History,” at Harvard Medical School’s Perspectives in Health Care in 2008 and Beyond, also in Indianapolis, on September 28. He also was a presenter on the topic, “Expensive New Drugs: Are They Worth It?” at the University of Illinois College of Medicine, in Chicago on October 29.

ANTONY PAGE’s article, “Batson’s Blind Spot: Unconscious Stereotyping and the Peremptory Challenge,” was quoted by the Texas Supreme Court for the proposition that attorneys may make race-based or sex-based peremptory challenges unconsciously. Davis v. Fisk Elec. Co., --- S.W.3d ----2008 WL 4370670 (Tex., Sep 26, 2008). The case is particularly important, as it recognizes that a lawyer may unconstitutionally exercise a peremptory challenge on the basis of race, while simultaneously being “pure of heart.” Professor Page also presented his work “Unconscious Bias and the Limits of Director Independence,” at the Washington University in St. Louis regional faculty workshop and at the Big 10 Scholars’ Conference in Bloomington. He also presented a follow-up work “Process Matters: Directors, Deliberation and the Duty of Loyalty,” at the Midwestern Law & Economics Association Annual Conference held at Northwestern University Law School in October. Professor Page was a panelist speaking about the causes of the financial crisis at the law school’s Roundtable Discussion: The Economic Crisis and the Emergency Economic Stabilization Act of 2008. Finally, Professor Page has recently been quoted in a variety of national and international media, including The Wall Street Journal (Deal Journal), the International Financing Review, Bloomberg, New York Post, Star-Ledger, and Fund Strategy, commenting on the recent financial crisis and mergers and acquisitions.

Gubernatorial Candidates’ Forum on Health Care

On October 13, Professor David Orentlicher (shown left), Samuel R. Rosen Professor of Law, participated in a Gubernatorial Candidates’ Forum on Health Care. Indiana State Senator Patricia Miller (R) represented Republican Governor Mitch Daniels’ plan, while Indiana State Representative David Orentlicher (D) represented Democrat Jill Long Thompson’s plan, and Libertarian Andrew Horning represented his own plan. The event, which took place in the Lilly Auditorium of IUPUI’s Library, was sponsored by the Consortium for Health Policy, Law & Bioethics.

Faculty NewsIn November, the ALABAMA LAW REVIEW published “The

Voting Rights Act and the Era of Maintenance” by MICHAEL PITTS. The article can be found at 59 ALA. L. REV. 903 (2008). In October, Professor Pitts presented a paper at the Washington University School of Law Regional Junior Faculty Workshop and appeared on a panel at the University of Maryland School of Law to discuss the Supreme Court’s decision in Crawford v. Marion County Election Board (the Indiana voter identification case). In April, he provided commentary to CNN regarding Crawford. Professor Pitts also has been elected to the law school’s Executive Committee, and been named a Dean’s Scholar and a John S. Grimes fellow for the 2008-2009 academic year.

FLORENCE WAGMAN ROISMAN’s two recent

publications are “Using International and Foreign Human Rights Law in Public Interest Advocacy,” 18 IND. INT’L. AND COMP. L. REV. 1 (2008) and “Living Together,” 41 IND. L. REV. 507 (2008). Living Together is the introduction to the Symposium Issue of the INDIANA LAW REVIEW, which comprises the papers prepared for the law review’s April symposium marking the fortieth anniversary of the enactment of the federal Fair Housing Act and the assassination of Dr. Martin Luther King, Jr. (Professor Roisman worked with the law review staff to organize the symposium.)

In May, Professor Roisman went to Columbia Law School to participate in a roundtable meeting on the Future of Race Conscious Housing Programs and Other Policies to Promote Racial and Economic Integration. In July, pursuant to an invitation from the Commission, she testified in Chicago before the National Commission on Fair Housing and Equal Opportunity, which is co-chaired by former HUD Secretaries Henry G. Cisneros and Jack Kemp. In September, she spoke at a conference on The Integration Debate: Competing Futures for American Cities at John Marshall Law School in Chicago. Her topic was: “The Constitutional and Statutory Mandates of Residential Racial Integration.” In October, she was a speaker at the Celebration of the Fortieth Anniversary of the National Housing Law Project in Oakland, California. In November, Professor Roisman spoke in Cleveland, Ohio, at a conference on New Strategies for Fair Housing.

In May, Professor Roisman received a 2008 Faculty Leadership Award for “extraordinary dedication and leadership” as Chair of the Faculty Recruitment Committee. (She continues to serve on that Committee during the current academic year.) She also has been re-elected to serve on the board of the American Civil Liberties Union of Indiana and has been nominated to the executive committee of the National Board of the American Civil Liberties Union. She continues to serve on the boards of the Inclusive Communities Project, Dallas, Texas; the Society of American Law Teachers; and the Poverty and

Race Research Action Council (PRRAC), Washington, DC. She is a member of the executive committee of the Poverty Law Section of the Association of American Law Schools and is on the advisory council of the National Housing Law Project, Oakland, California. She also continues to serve as faculty advisor to the Equal Justice Works chapter at the law school.

JOEL SCHUMM has been selected as the reporter for the National Association of Criminal Defense Lawyer’s Task Force on Problem-Solving Courts. He will prepare a comprehensive report to be issued in the summer of 2009. He was appointed by Indiana Court of Appeals Chief Judge John Baker to the committee that drafted procedures for expedited appeals in Department of Child Services’ cases in response to House Bill 1001. Additionally, this fall marked the inaugural semester of the Appellate Clinic, directed by Professor Schumm. Three students in the clinic each litigated an appeal for an indigent litigant under Professor Schumm’s direction. One student also presented an oral argument to the Indiana Supreme Court in December.

PROFESSOR EMERITUS JAMES P. WHITE met with the American Bar Association’s Accreditation Committee on June 28 to review approaches to legal education. He spoke in Barcelona at the 15th Anniversary of the Puerto Rico Law School and University of Barcelona Summer Program and Joint J.D. degree program, which took place July 8-11. On August 8, Professor White chaired the meeting of the ABA International Legal Education Committee at the ABA Annual Meeting in New York City. In September, he served as Chair of the Academic Affairs Committee of the Butler University Board of Trustees. Also in September, Professor White participated in the Centennial Celebration of the New England School of Law/Boston, in Boston, Massachusetts.

LLOYD T. “TOM” WILSON’s article “All Things Considered: The Contribution of the National Mortgage Licensing System to the Battle Against Predatory Lending,” was published in July in the GEORGIA STATE UNIVERSITY LAW REVIEW. It can be found at 21 GEORGIA STATE UNIVERSITY LAW REVIEW 415 (2008).

On June 2, Professor Wilson delivered a lecture on “The Interplay of Contract Law Regimes in the United States,” at Renmin University of China School of Law in Beijing, China, and on October 23, he was a panelist for the law school’s Roundtable Discussion on the Economic Crisis and Emergency Economic Stabilization Act of 2008. His topic was “Causes of the Mortgage Crisis.”

Jonna Kane MacDougall, ’86, Assistant Dean for Institutional Advancement, was recently appointed to the Indiana Pro Bono Commission. She continues to serve on the ICLEF board, and also serves as president of the board of directors of Outrun the Sun, Inc., an organization dedicated to raising awareness of the risk factors for skin cancer and to raising funds for medical research for melanoma.

THE HALL CENTER FOR LAW AND HEALTHat the Indiana University School of Law-Indianapolis is hosting Professor Halit Yilmaz from the law faculty at Akdeniz University in Antalya, Turkey. Professor Y i lmaz i s a v i s i t i ng fellow at the Hall Center during the entire 2008-09 academic year.

His main areas of interest are administrative law, mass communication law, urban planning and general theory of law. Professor Yilmaz is planning to work on articles, as well as a book, on the international human right to health and the regulation of the pharmaceutical industry.

Professor Yilmaz says, “The topic of health care in Turkey, with relation to a right to health and from an administrative law perspective, requires immediate attention of scholars and thorough study.”

Scholarship & Award Recipients 2007-2008

THE LOVEJOY AWARDSThe Lovejoy Awards were established in 2004 by Joby Jerrells, ‘03. They are awarded annually to the students submitting the best briefs in the third semester of legal writing as a component of moot court participation. Elijah Lovejoy was a publisher and avid abolitionist during the antebellum era who died defending his printing press. An angry mob murdered Lovejoy in 1837 on the frontier of the American west in Alton, Illinois. Many consider Lovejoy to be the first martyr to freedom of the press in the United States. Lovejoy was a contemporary of Abraham Lincoln, who later selected Lovejoy’s younger brother John to serve as U.S. counsel to Peru. Another brother, Owen, served and died in the U.S. Congress during Lincoln’s presidency. Upon hearing the news of Owen’s death, Lincoln said: “Lovejoy was the only friend I had in Congress.” The Lovejoy Award for best brief was established to honor this generation of brothers who dedicated their lives to a greater purpose and through the power of their words, writings, and advocacy changed a nation.

Her contributions to the legal profession were numerous as she acted as an outstanding role model for female attorneys. Ms. Shideler was named Outstanding Alumna of the Year in 2001 by the IU School of Law - Indianapolis, and in 1995, she received the Antoinette Dakin Leach Award from the Indianapolis Bar Association. She was truly a pioneer for women in the legal profession.

Spirit of Philanthropy Awards 2007-2008THE TWENTIETH ANNUAL IUPUI SPIRIT OF

PHILANTHROPY LUNCHEON, sponsored jointly by The Center on Philanthropy at Indiana University, the IU Foundation and the IUPUI campus, took place on Thursday, April 17 at the new IUPUI Campus Center. Each school on the Indianapolis campus honored individuals or entities that provided exemplary voluntary service or financial support to the school. The event was attended by several hundred civic and community leaders, as well as IUPUI Chancellor Charles R. Bantz. The law school’s honorees were Adam Arceneaux, ’93, and Stephen A. Stitle, ’70.

Adam Arceneaux is a 1993 graduate (summa cum laude) of the law school. He is a partner at the firm of Ice Miller in the Competitive Business Practices Litigation Group.

While in law school, he served as Associate Editor of the INDIANA LAW REVIEW and, as a member of the Order of Barristers, participated in Intercollegiate Moot Court competitions. He has served the law school through his service as a long-time member and past president of the Indiana University School of Law-Indianapolis Alumni Association Board of Directors. Mr. Arceneaux has also demonstrated his exceptional dedication to his alma mater by leading fundraising efforts on the school’s behalf. He has served as a Law Firm Campaign Chair volunteer at Ice Miller for over 10 years and served as a member of the Capital Campaign Steering Committee to raise money for the new building.

Stephen A. Stitle graduated from the law school in 1970. After working as an executive at Eli Lilly and Company for nearly 25 years, he became President of Indiana Banking at National City Bank. He serves on the board of directors of numerous organizations including the Central Indiana Corporate Partnership, the Indianapolis and Indiana Chambers of Commerce, Indiana University Foundation, and the Sagamore Institute for Policy Research. He currently serves on the law school’s Board of Visitors and volunteers for the mock interview program with the school’s Office of Professional Development and alumni association. He used his fund raising expertise for the benefit of his alma mater while serving as a co-chair of the law school’s highly successful capital campaign to raise funds for the new building. Throughout his impressive career, he has consistently shown dedication toward the law school and the university, as well as leadership among his alumni and community peers.

Your class reunion is fast approaching. In addition to reconnecting with special friends and your favorite faculty members, we hope you will join us as we begin a new IU Law-Indianapolis tradition. In addition to class recognition, we will welcome the class of 2009 as the newest members of our alumni family.

We will celebrate the class of 1959’s Golden Anniversary, 1984’s Silver Anniversary, and 1994’s Crystal Anniversary. We warmly welcome all other “4” and “9” class years to join us in celebrating your class’s achievements; and we need to know whether you have an interest in having the Alumni Association assist in organizing activities for you. The Alumni Association will happily work with your class in contacting fellow classmates, collecting reservations, and handling all the details for the weekend.

Annual Law Firm and Corporate Campaign 2007

Each year, alumni in a number of law firms and corporations participate in the Annual Law Firm and Corporate Campaign. A volunteer chair is recruited from each firm or corporation, and they are asked to solicit contributions from fellow alumni in their office. This annual campaign is vital to the law school’s annual fund and is, by far, our most successful fund raising drive of the year. Thank you to the 2007 Campaign Chairs and everyone who participated in the 2007 Law Firm and Corporate Campaign. STEVEN SANDERS, ‘75, was recently selected for inclusion in The Best Lawyers in America 2009. A partner in the firm of Williams Venker & Sanders in St. Louis, MO, he was recognized for his achievements in personal injury litigation as well as commercial and product liability litigation.

DAVID A. HAIST, ‘77, has been inducted into the Indiana Academy for his lifetime achievement and contribution to Indiana. The Academy recognizes individuals for their leadership, achievement and philanthropy that furthers development of business, public service, higher education, the arts and sciences, literature and the general culture of Indiana. Haist is executive vice president and chief operating officer of Do It Best Corporation, a $3 billion member-owned international hardware and building materials cooperative headquartered in Fort Wayne. He is also chair of the Parkview Hospital Board, and is former chair of the Manchester College Board of Trustees and the Fort Wayne Philharmonic.

DENNIS HAYES, ‘77, general counsel at the NAACP, was honored by the Indiana University School of Education.

ED PEASE, ‘77, has been appointed to the Indiana State University Board of Trustees. A senior vice president with Rolls Royce America, Pease was U.S. Representative for Indiana’s 7th District from 1997-2001. He was vice president for university advancement at Indiana State from 1992-96 and was a state senator from 1980 to 1992. He has also served as general counsel at Indiana State and as an instructor in the English department.

CARYL E. DELANO, ‘79, was appointed as a bankruptcy judge of the United States Bankruptcy Court for the Middle District of Florida, Tampa Division. KATE SHELBY, ’08, an associate in the Indianapolis office of Taft Stettinius & Hollister LLP, was recently elected to the Board of Directors of the Young Professionals of Central Indiana (YPCI). YPCI is Indiana’s largest networking group for young professionals and offers networking, education and social events. Shelby is a member of the firm’s Environmental Law group. She is also a member of the United States Patent Bar.

ARGUING BEFORE THE CHICAGO IMMIGRATION COURT, law students Lun Kham and Andrea Schmidt recently secured lawful permanent residency for the immigrant parents of three American-born children. The father and mother of the Indianapolis family (from Guatemala and Mexico respectively) had both resided in the United States for approximately 18 years. During that time, they raised a family of three boys, all U.S. citizens, now ages 15, 13 and 10.

Professor Linda Kelly Hill, director of the Immigration Clinic at the law school, says, “The boys excel in school, taking advanced classes and having high ambitions for their college educations and futures. One of the children also suffers from severe migraines and weight loss and is under close medical supervision. Through championship soccer teams, church and school, the parents are also extremely active in the community and their boys’ lives.”

Kham and Schmidt were able to argue persuasively that the parents were eligible for “cancellation of removal” by proving the “exceptional and extremely unusual hardship” that would have been imposed on these three U.S. citizen children if they were effectively deported upon their parents being ordered to be removed. The students’ representation included providing all necessary examination and argumentation in a four hour hearing, drafting a 50 page legal memo, submitting nearly 700 pages of documentary evidence and preparing over 10 witnesses, including family, teachers and doctors. Because of the students’ work, the parents now have lawful permanent residency and already look forward to the day they can be sworn in as United States citizens.

The law school’s Immigration Clinic was established in 2006 by Professor Linda Kelly Hill, the M. Dale Palmer Professor of Law. Clinic students represent non-detained immigrants in immigration matters under the supervision of Professor Kelly Hill. Since its inception, approximately 30 students have assisted in Immigration Clinic cases.

Egypt Program UpdateSEVERAL INDIANA UNIVERSITY SCHOOL OF LAW

– INDIANAPOLIS EMPLOYEES travelled to Cairo and Alexandria, Egypt in October for the Fall 2008 LL.M. - Egypt program orientation: Frank Emmert, Director of the Center for International and Comparative Law; Sonja Rice, Egypt Program Coordinator; Terri Cuellar, Director of Technology Services, and Jacob Manaloor, Assistant Director of Grant Administration.

On the Alexandria campus, twenty new students were accepted to our LL.M. program, and on the Cairo campus, thirty-nine new students were accepted, for a total active enrollment of ninety-four students. Our admissions enrollment for the Fall 2008 cohort saw an increase of over 60% from the Spring 2008 cohort.

AMUZU, EDWARD TUINESE of Ghana has been appointed the Executive Director of the Legal Resources Centre (LRC), a national non-profit organization in Ghana dedicated to human rights capacity building for individuals, groups and other non-profits. In the last year, he led a team of LRC lawyers to institute a habeas corpus action against the Minister of Justice on behalf of the Minister for Interior, the Inspector General of Police and the Director General of the Ghana Immigration Service for the unlawful arrests and detention of six hundred and thir ty Liberian refugees who are women and children. He also led the legal team in a cour t action for an writ of mandamus to compel the Electoral Commission of Ghana to register Ghanaian prisoners in anticipation of voting in public elections and referenda. In July 2008, Mr. Amuzu par ticipated in the Conference on the Rule of Law organized by the World Justice Program with the suppor t of the American Bar Association in Vienna, Austria, and a conference on combating cyber crime organized by the U.S. Depar tment of State in Benin, Cotonou.

HUANG, GUOBAO of China has joined the Jia Yuan Law Firm in Beijing, P.R.C.

HUANG, RAN of China recently passed the New York bar exam. She travels between the law firm where she works in Guangzhou, China, and Windsor, Canada, where her husband is located, and the U.S, where she par tners with AWB Consulting, LLC, which provides international legal services.

LEE, JEONG-HO of Korea (J.D. ’01) passed the February California bar examination and is now admitted to practice in Indiana, Washington, D.C., and California. He is now the General Counsel for CMG Worldwide, Inc., and is spending most of his time in the West Hollywood, CA, of fice. He visited Berlin, Germany, this May to par ticipate in the International Trademark Association’s Annual Meeting. Mr. Lee enjoyed visiting with fellow LL.M. graduate, Alex Hoffmann, and his wife while he was in Berlin.

LIU, XIUHUI (SUSAN) of China moved to Canada in Spring 2008. She is now International Business Transaction Consultant with Sorbara, Schumacher, McCann LLP, in Kitchener, Ontario.

OAKLEY, JIAXIN (HUANG) of China currently lives in Zionsville, Indiana, with her son and husband.

ROSE, ANTHONY (TONY) of Indianapolis, Indiana, teaches Internet Law as an adjunct professor at both IU Law—Indianapolis and IU Law—Bloomington.

TINDERA, SOLANGEL originally from Columbia serves as immigration consultant for Indianapolis attorney Joel S. Paul. She manages Latino immigration cases and is currently involved in a project to bring qualified bilingual nurses from South America to work in U.S. hospitals. She also works par t-time for attorney Timothy Hayes in Terre Haute, Indiana, as a paralegal for personal injur y cases involving Latino clients. She is also in the process to become a cer tified cour t interpreter for the state of Indiana. YAN, ZHENFENG of China has joined the Jia Yuan Law Firm in Beijing, P.R.C.

ZHENG, LI LI, of China is a lawyer in Zhejiang Guosheng Law Firm in Zhejiang Province, P.R.C., and is also a par t-time teacher in Zhejiang Changzheng Jishu College.

ZHOU, YUAN of China began the J.D. Program at IU Law—Indianapolis in Fall 2008.

AKRAM, UJALA, of Pakistan now serves as Senior Advisor for the LL.M. Program IU Law—Indianapolis. Ms. Akram advises current and prospective LL.M. students and assists with marketing, adver tising and promotion for the program. She is also responsible for planning and executing international recruitment trips.

CHEN, SONG of China works at Kevin Kerveng Tung., P.C. in New York, where he has assisted with some mergers and acquisitions. IU Law—Indianapolis administration would like to add that prior to graduating Mr. Chen completed an internship with the Indiana Public Access Counselor where his excellent work received special thanks from the Public Access Counselor in her forward to the April 2008 update of the Handbook on Indiana’s Public Access Laws.

NISHIOKA, KOICHI of Japan has returned to his position as legal counsel for Marucho, Co., Ltd., in Osaka, Japan.

SHISLER, JANNA (J.D. 1988) of Indianapolis, Indiana, has been working as a fellow in the Hall Center for Law and Health at IU Law—Indianapolis expanding earlier graduate law research to complete work on a paper for publication. YAO, CHUCHU of China works par t-time in an immigration law office in Flushing, New York, while she studies for the MPRE.

YILDIZ, C. MELIH (MEL) of Turkey has joined the LL.M. Program at IU Law—Indianapolis as Student Advisor. His responsibilities include LL.M. admissions and a wide array of student services for the program’s international and domestic students. He also represents the law school staff as an elected member of IUPUI Staff Council.

YU, LI of China works with Peter Cook and Associates, an estate planning law firm in New Jersey.

I U L AW S C H O O L – I N D I A N A P O L I S ’ ENVIRONMENTAL LAW FORUM HOSTED VISITING CHINESE LAWYER, WANG XIAOHUI, (pictured above) this summer while she conducted comparative research on U.S. environmental law through a fellowship provided by Probe International. Xiaohui works with a prominent Chinese Environmental Law organization, the Center for Legal Assistance to Pollution Victims (CLAPV) in Beijing. She is both a practicing lawyer and a Ph.D. candidate at China University of Political Science and Law, where her dissertation topic relates to environmental law in China.

Xiaohui was in Indianapolis during July and August. While here she had an opportunity to interact with members of the faculty who teach environmental law, Professors Dan Cole and Eric Dannenmaier, and to meet with Professors Tom Wilson and Gerard Magliocca, who co-direct the law school’s Chinese Law Summer Program. Xiaohui also had the opportunity to meet with practicing lawyers, public interest advocates, and government officials. At the close of her visit, Xiaohui gave a presentation to the faculty on Environment and Health Management in China—discussing the challenges of protecting human health and the environment in the face of enormous development pressures in the worldís largest developing country.
