B. Adopted the following "trigger" language with respect to the Department of Health Services' budget:

1. By October 1, 1995, the County will have completed closure of all Comprehensive Health Centers and 29 Health Centers, except those for which a public-private partnership has been approved;

2. Should additional action on the State budget preclude the receipt of revenue or impose additional health related unfunded mandates, the Board shall immediately initiate hospital closures or other Department of Health Services cutbacks to the extent necessary to eliminate the shortfall;

3. By October 1, 1995, the County shall determine the degree to which Federal revenues are assured to meet the shortfall under "Option C" as revised under A.1 through A.4, above; and shall initiate hospital closures or other Department of Health Services cutbacks to the extent necessary to eliminate the shortfall;

4. By September 1, 1995, the County shall determine which hospital or combination of hospital services shall be closed if the requirements of B.1., B.2., or B.3. are not met; and shall begin pre-planning for such closures; and

5. The Chief Administrative Officer and Health "Czar" will provide the Board with a report on a weekly basis which reflects the Department's success in achieving revenue and implementing reduction as well as projections regarding savable costs from hospital closures assuming a sixty-day implementation schedule

C. Instructed the Chief Administrative Officer to transfer $75 million in SB 75 revenues from the County General Fund to the County Hospital Enterprise Fund; and

D. Instructed the Chief Administrative Officer and the Auditor-Controller to recognize $96.6 million from "1115 Waiver" revenues and place such revenues in the Hospital Enterprise Fund.

Consideration of the Chief Administrative Officer's memo dated July 26, 1995 regarding distribution of the Los Angeles County Employee Retirement Association's benefit cost reductions adopted on July 26, 1995 by the board of Investments, plus the benefit to be realized by a premium holiday for retiree health insurance. Recommendation as submitted by Supervisor Yaroslavsky: Adopt resolution which would implement transfer of $75,000,000 annually from sales and use tax revenue allocated from the County's local transportation fund to the County's General fund, as specified in SB 75 (Polanco). THE BOARD MADE A FINDING PURSUANT TO GOVERNMENT CODE SECTION 54954.2(B)(2) THAT THERE IS A NEED TO TAKE IMMEDIATE ACTION AND THAT THE NEED FOR ACTION CAME TO THE ATTENTION OF THE BOARD SUBSEQUENT TO THE AGENDA BEING POSTED AS SPECIFIED IN SUBDIVISION (A); AND ADOPTED A RESOLUTION WHICH WOULD IMPLEMENT TRANSFER OF $75,000,000 ANNUALLY FROM SALES AND USE TAX REVENUE ALLOCATED FROM THE COUNTY'S LOCAL TRANSPORTATION FUND TO THE COUNTY'S GENERAL FUND, AS SPECIFIED IN SB 75 (POLANCO) Documents of file in Executive Office.

Approved that portion of the 1995-96 Budget Balancing Plan relating to a Transient Occupancy Tax and an Entertainment Tax, for revenue in amount of $0.80 million and $2.70 million, respectively.

Vote: Supervisor Dana voted no on this action.

Adopted the remainder of the 1995-96 Budget Balancing Plan; and instructed the Chief Administrative Officer and the Auditor-Controller to take the necessary actions to implement the measures described in the 1995-96 Budget Balancing Plan, and to place the proceeds in the Nondepartmental Special Accounts as revenue/potential savings.

c. Requested the Assessor to return to the Board after the State Budget is adopted, with options and recommendations for obtaining additional State funds

c. Instructed the County Librarian to implement a volunteer corps patterned after the pilot project of Brakensiek Library in Bellflower with the purpose of maintaining the 1994-95 level of service and operating hours; and

d. Instructed the County Librarian to report back in three weeks with an implementation schedule for the volunteer corps

c. Instructed the Chief Probation Officer to delay implementation of curtailments relating to camps until the State Budget is finalized

a. Entered into negotiation with Burt Margolin to serve as Health Services "Czar" with powers and duties as outlined by the Health Crisis Task Force; and instructed the Chief Administrative Officer to bring in a proposal with a recommended compensation contract with the law firm of Brady & Berliner to engage the services of Mr. Margolin for this purpose;

b. Instructed Mr. Margolin to immediately pursue a Medicaid Demonstration Waiver under Section 1115 and all other possible sources of revenue for the health system; to develop a process for the restructuring

of the health care delivery system by developing public-private partnerships and working to reverse the current backward incentives of Federal health care financing; to fashion a mechanism for rebuilding outpatient service by retaining or reopening health centers, clinics and hospital ambulatory services; to develop a new, collaborative program between the three medical schools and the County; and to recommend to the Board action to implement all other recommendations of the Health Crisis Task Force; and

c. Instructed Mr. Margolin to further develop the feasibility of a Health Authority as recommended by the Health Crisis Task Force and if feasible, to bring a Health Authority implementation plan to the Board in 60 days for approval

On motion of Supervisor Yaroslavsky, as amended by Supervisor Antonovich, the Chief Administrative Officer was instructed to appropriate from the Cable Television Franchise Fund an additional $470,000 to the Los Angeles County Music and Performing Arts Commission's budget as follows: (ALSO SEE BOARD ORDER NO. 77-B THIS DATE)

a. $170,000 to cover additional costs to produce a 6-hour Holiday Celebration Program televised on December 24, 1995 on KCET; and

b. $300,000 for the Los Angeles County Music and Performing Arts Commission programs, including the operation of the John Anson Ford Theatre
