B. Adopted the following "trigger" language with respect to the Department of Health Services' budget:

1. By October 1, 1995, the County will have completed closure of all Comprehensive Health Centers and 29 Health Centers, except those for which a public-private partnership has been approved;

2. Should additional action on the State budget preclude the receipt of revenue or impose additional health related unfunded mandates, the Board shall immediately initiate hospital closures or other Department of Health Services cutbacks to the extent necessary to eliminate the shortfall;

3. By October 1, 1995, the County shall determine the degree to which Federal revenues are assured to meet the shortfall under "Option C" as revised under A.1 through A.4, above; and shall initiate hospital closures or other Department of Health Services cutbacks to the extent necessary to eliminate the shortfall;

4. By September 1, 1995, the County shall determine which hospital or combination of hospital services shall be closed if the requirements of B.1., B.2., or B.3. are not met; and shall begin pre-planning for such closures; and



5. The Chief Administrative Officer and Health "Czar" will provide the Board with a report on a weekly basis which reflects the Department's success in achieving revenue and implementing reduction as well as projections regarding savable costs from hospital closures assuming a sixty-day implementation schedule

C. Instructed the Chief Administrative Officer to transfer $75 million in SB 75 revenues from the County General Fund to the County Hospital Enterprise Fund; and

D. Instructed the Chief Administrative Officer and the Auditor-Controller to recognize $96.6 million from "1115 Waiver" revenues and place such revenues in the Hospital Enterprise Fund.

Consideration of the Chief Administrative Officer's memo dated July 26, 1995 regarding distribution of the Los Angeles County Employee Retirement Association's benefit cost reductions adopted on July 26, 1995 by the board of Investments, plus the benefit to be realized by a premium holiday for retiree health insurance. Recommendation as submitted by Supervisor Antonovich: Instruct the Executive Officer of the Board to allocate ongoing funding in amount not to exceed $215,000 per year from the Cable Television Franchise Fund for a six-hour Music Center Holiday Program, plus a one-time cost of $25,000 for holiday backdrops to be amortized over ten years. Recommendation as submitted by Supervisor Yaroslavsky: Adopt resolution which would implement transfer of $75,000,000 annually from sales and use tax revenue allocated from the County's local transportation fund to the County's General fund, as specified in SB 75 (Polanco). THE BOARD MADE A FINDING PURSUANT TO GOVERNMENT CODE SECTION 54954.2(B)(2) THAT THERE IS A NEED TO TAKE IMMEDIATE ACTION AND THAT THE NEED FOR ACTION CAME TO THE ATTENTION OF THE BOARD SUBSEQUENT TO THE AGENDA BEING POSTED AS SPECIFIED IN SUBDIVISION (A); AND ADOPTED A RESOLUTION WHICH WOULD IMPLEMENT TRANSFER OF $75,000,000 ANNUALLY FROM SALES AND USE TAX REVENUE ALLOCATED FROM THE COUNTY'S LOCAL TRANSPORTATION FUND TO THE COUNTY'S GENERAL FUND, AS SPECIFIED IN SB 75 (POLANCO) Documents of file in Executive Office.

Recommendation as submitted by Supervisor Molina: Instruct the Chief Administrative Officer to implement the six measures, described in the 1995-96 Budget Balancing Plan, and to place the proceeds in the Nondepartmental Special Accounts as revenue/potential savings. THE BOARD TOOK THE FOLLOWING ACTIONS:



Approved that portion of the 1995-96 Budget Balancing Plan relating to a Yuletide Furlough for a savings of $28 million.

Vote: Supervisor Yaroslavsky voted no on this action.

Approved that portion of the 1995-96 Budget Balancing Plan relating to a Transient Occupancy Tax and an Entertainment Tax, for revenue in amount of $0.80 million and $2.70 million, respectively.

Vote: Supervisor Dana voted no on this action.

Adopted the remainder of the 1995-96 Budget Balancing Plan; and instructed the Chief Administrative Officer and the Auditor-Controller to take the necessary actions to implement the measures described in the 1995-96 Budget Balancing Plan, and to place the proceeds in the Nondepartmental Special Accounts as revenue/potential savings.

On motion of Supervisor Antonovich, the Board took the following actions:

a. Agreed to assume in the Final Budget increased revenue of $8 million more than is assumed in the Proposed Budget;

b. Allocated the additional $8 million to the budget of the Assessor; and

c. Requested the Assessor to return to the Board after the State Budget is adopted, with options and recommendations for obtaining additional State funds

On motion of Supervisor Dana, the Board took the following actions:

a. Allocated $4 million to the County Library from Nondepartmental Special Accounts;



b. Instructed the County Librarian to utilize the $4 million to avert library closures and to restore service hours to all libraries for the 1995-96 year;

c. Instructed the County Librarian to implement a volunteer corps patterned after the pilot project of Brakensiek Library in Bellflower with the purpose of maintaining the 1994-95 level of service and operating hours; and

d. Instructed the County Librarian to report back in three weeks with an implementation schedule for the volunteer corps

On motion of Supervisor Burke, the Board took the following actions:

a. Allocated $12.3 million from Nondepartmental Special Accounts to the Probation Department and that camps remain open until the final State Budget and bills are approved;

b. Augmented the Probation Department's budget by an



additional $7.5 million to be funded in the following manner:

Additional Title IVa Revenue $6.0 million Increased Collections $1.5 million

This amount would increase the Probation Department's appropriation totalling $24.6 million in order to maintain juvenile investigations, area offices, community-based contracts, 14-day adult investigations, and work furlough at the 1994-95 budget level; and

c. Instructed the Chief Probation Officer to delay implementation of curtailments relating to camps until the State Budget is finalized

On motion of Supervisor Molina, the Board allocated a total of $11.2 million to the Courts as follows:

On motion of Supervisor Burke, the Board allocated $5.0 million from Nondepartmental Special Accounts to the Department of Parks and Recreation for local park maintenance, recreation services, park police, and craft and facility maintenance.

On motion of Supervisor Antonovich, the Board took the following actions:

a. Instructed the Auditor-Controller to credit the Department of Parks and Recreation for annual Payments in Lieu of Taxes (PILT) payments; and

b. Instructed the Chief Administrative Officer and the Director of Parks and Recreation to allocate the PILT payment to offset the planning program in the 1995-96 Budget

On motion of Supervisor Antonovich, the Board ordered that the Sheriff's Department Budget contain one budget unit for purposes of budgetary control by the Auditor-Controller and the Chief Administrative Officer when the Final County Budget is adopted for Fiscal Year 1995-96.

On motion of Supervisor Molina, the Board allocated the following amounts from the Nondepartmental Special Accounts:

On motion on Supervisor Molina, the Board agreed to increase the Department of Public Social Services's appropriation by $45 million, revenue by $45 million and budgeted positions by 1,307, upon the Governor's signing of Senate Bill 1344.

On motion of Supervisor Dana, the Board allocated the Chief Administrative Officer's proposed appropriation of $5 million to community-based programs, equally in each Supervisor's District.

On motion of Supervisor Yaroslavsky, the Board took the following actions:

a. Entered into negotiation with Burt Margolin to serve as Health Services "Czar" with powers and duties as outlined by the Health Crisis Task Force; and instructed the Chief Administrative Officer to bring in a proposal with a recommended compensation contract with the law firm of Brady & Berliner to engage the services of Mr. Margolin for this purpose;

b. Instructed Mr. Margolin to immediately pursue a Medicaid Demonstration Waiver under Section 1115 and all other possible sources of revenue for the health system; to develop a process for the restructuring



of the health care delivery system by developing public-private partnerships and working to reverse the current backward incentives of Federal health care financing; to fashion a mechanism for rebuilding outpatient service by retaining or reopening health centers, clinics and hospital ambulatory services; to develop a new, collaborative program between the three medical schools and the County; and to recommend to the Board action to implement all other recommendations of the Health Crisis Task Force; and

c. Instructed Mr. Margolin to further develop the feasibility of a Health Authority as recommended by the Health Crisis Task Force and if feasible, to bring a Health Authority implementation plan to the Board in 60 days for approval

On motion of Supervisor Yaroslavsky, the Board instructed the Chief Administrative Officer and the Director of Health Services, in implementing the budget decisions made by the Board, to implement service reductions in such a way as to ensure the receipt of CARE Act funding, by adhering to Federal Maintenance of Effort requirements.

On motion of Supervisor Yaroslavsky, as amended by Supervisor Antonovich, the Chief Administrative Officer was instructed to appropriate from the Cable Television Franchise Fund an additional $470,000 to the Los Angeles County Music and Performing Arts Commission's budget as follows: (ALSO SEE BOARD ORDER NO. 77-B THIS DATE)

a. $170,000 to cover additional costs to produce a 6-hour Holiday Celebration Program televised on December 24, 1995 on KCET; and

b. $300,000 for the Los Angeles County Music and Performing Arts Commission programs, including the operation of the John Anson Ford Theatre

On motion of Supervisor Burke, the Board took the following action:



a. Extended thanks to members of the Los Angeles County Legislative Delegation for working closely with Los Angeles County during the current budget crisis; and instructed the Executive Officer of the Board to prepare a 5-signature letter of appreciation to the Los Angeles County Legislative Delegation; and

b. Instructed the Chief Administrative Officer to convey the Board's appreciation to Steve Juarez, Legislative Advocate in Sacramento, for his good work during the current budget crisis

III. ACTIONS FOR ADOPTION OF 1995-96 BUDGET

Order such revisions, additions, and changes to the Chief Administrative Officer's budget recommendations as deemed necessary and approve the revised figures as the Final Budget for 1995-96, and instruct the Auditor-Controller to prepare and present the Final Budget Resolution for Board adoption. Recommendation as submitted by Supervisor Dana: Upon adoption of the State budget, agree to the terms and conditions of the State's proposal and accept ownership of eight State beaches, with anticipated revenue of $1.5 million per year for Fiscal Years 1995-96, 1996-97 and 1997-98, for a total of $4.5 million, and the County's priority claim for future California Department of Boating and Waterways funding; also instruct the



Chief Administrative Officer, Director of Beaches and Harbors and the Fire Chief to take necessary action to accept fee title of the eight State beaches pursuant to the terms and conditions set forth in the State's proposal. Recommendation as submitted by Supervisor Antonovich: Instruct County Counsel to work with the County's Legislative Representatives in Sacramento to develop legislation to reduce the cost of court reporters by allowing daily transcripts or real-time transcripts at public expense in criminal trials only when the court makes a finding that its use will reduce the overall public cost of the proceedings or that its use is constitutionally required; and instruct the County's Representatives in Sacramento to seek passage of this legislation. Recommendation as submitted by Supervisor Molina: Instruct the Chief Administrative Officer to prepare revised salary schedules within two weeks and any necessary accompanying documentation to bring the salaries of Deputy District Attorneys (DDA) into parity with those of the County Counsel's Office, effective July 1, 1995, with these adjustments to be funded by narcotics forfeiture revenues; and create two additional merit steps for DDA classes with employees to be eligible for the first step effective July 1, 1996. Recommendation as submitted by Supervisor Molina: Instruct the Chief Administrative Officer to contact the County's Legislative Representative in Sacramento to identify the appropriate State Legislator to sponsor an amendment to the California Vehicle Code, that will include Environmental Health Specialists among the list of professions to have confidential Department of Motor Vehicle information, due to the number of recorded incidents of threats or assaults in the Department of Health Services to Environmental Health Specialists while performing their official duties; and report back to the Board within 45 days. Recommendation as submitted by Supervisor Burke: Instruct Director of Health Services to report to the Board within one week on the conclusions reached by the Task Force formed immediately after Deputy Sheriff Yamamoto's death at Martin Luther King, Jr. Hospital in March 1992, and the changes in procedures that have taken place to ensure that the circumstances surrounding the death of this Deputy will not happen again; also instruct Director of Health Services to engage an independent consultant on medical procedure to review and report to the Board on the effectiveness of present County hospital procedures and how these procedures compare with those of leading hospitals in the area. Reviewed and continued local emergency caused by the discovery of an infestation of fruit flies, as proclaimed on August 8, 1989 and May 10, 1990; local emergency as a result of disastrous fires commencing on October 26, 1993, and occurring in various locations throughout Los Angeles County, including damage resulting from soil erosion, landslides, flooding and mudslides, as proclaimed on October 27, 1993 and modified on December 21, 1993; and local emergency as a result of a strong earthquake in the San Fernando Valley area of Los Angeles County, which conditions are beyond the control of local resources, as proclaimed on January 17, 1994; continue local emergency as a result of a storm commencing on January 4, 1995, and occurring in various locations throughout Los Angeles County, as proclaimed on January 5, 1995; continue local emergency as a result of a landslide in the Rowland Heights unincorporated area and the City of Diamond Bar, as proclaimed on May 19, 1995. The Meeting adjourned to Closed Session at 12:27 p.m., following Board Order No. 55 for the purpose of considering discipline/dismissal/release of public employees, pursuant to Government Code Section 54957.
