D Datenschutzbestimmungen „STIHL connected“

(1.) Die nachfolgenden Bestimmungen informieren den Kunden über die Erhebung, Verarbeitung

und Nutzung seiner personenbezogenen Daten im Zusammenhang mit der Nutzung des

„STIHL connected“ Systems, bestehend aus „STIHL Smart Connector“, „STIHL App“ und

„STIHL connect pro Portal“.

(2.) Diese Datenschutzbestimmungen können ausgedruckt und gespeichert werden.

(3.) Verantwortlicher

Verantwortlich für die Datenerhebung, Datenverarbeitung sowie Datennutzung ist die

(4.) Einwilligung

Mit der Zustimmung zu diesen Datenschutzbestimmungen willigen Sie gegenüber STIHL in

die Erhebung, Verarbeitung und Nutzung Ihrer personenbezogenen Daten unter Beachtung

der einschlägigen Gesetze und entsprechend den nachfolgenden Bestimmungen ein.

(5.) Personenbezogene Daten

Personenbezogene Daten sind alle Informationen über eine identifizierbare oder identifizierte

natürliche Person. Hierzu zählen z.B. Name, Adresse, Telefonnummer, E-Mail-Adresse,

Profilbilder, konnektierte mobile Endgeräte und gepaarte Maschinen oder Werkzeuge und

Verbrauchsdaten und sonstige Daten, die Sie STIHL zum Zwecke der Registrierung und

Nutzung des Systems „STIHL connected“ zur Verfügung stellt.

(6.) Log-Dateien, Registrierungsdaten und freiwillige Daten

(6.1.) Log-Dateien

Bei jedem Zugriff auf das „STIHL connect pro Portal“ werden Nutzungsdaten durch den

jeweiligen Internetbrowser übermittelt und in Protokoll-Dateien, den sogenannten Server-

Logfiles gespeichert. Die gespeicherten Datensätze enthalten folgende Daten: Datum und

Uhrzeit des Abrufs, Name der aufgerufenen Seite, IP-Adresse, Herkunfts-URL, von der aus

Sie auf das „STIHL connect pro Portal“ gelangt sind, übertragene Datenmenge, Informationen

über den von Ihnen verwendeten Browser. Diese Daten werden ausschließlich zur

technischen Kommunikation genutzt und vorbehaltlich etwaiger gesetzlicher

Aufbewahrungspflichten nach Beendigung der Nutzung gelöscht. Rechtsgrundlagen für die

Datenverarbeitung sind die Durchführung vorvertraglicher Maßnahmen und die Erfüllung des

mit Ihnen bestehenden Vertrages sowie Ihre Einwilligung.

(6.2.) Registrierungsdaten

Sämtliche im Zuge der Registrierung von Ihnen hinterlegten personenbezogenen Daten

[Vorname, Nachname, Adresse (Straße, Hausnummer, Postleitzahl, Ort), E-Mail-Adresse;

Telefonnummer, Passwort; Nutzername; Webadresse; Profilbild; Geburtsdatum;

Kommunikationssprache] zu dem „STIHL Smart Connector“ und der „STIHL App“ sowie dem

„STIHL connect pro Portal“ werden von STIHL unter Beachtung der auf den Vertrag

anwendbaren Datenschutzbestimmungen zum Zwecke der Begründung, Ausgestaltung,

Durchführung, Abänderung und/oder Beendigung des Nutzungsverhältnisses im

automatisierten Verfahren erhoben, verarbeitet und genutzt. Mit Ausnahme der

Telefonnummer, der Webadresse, des Profilbildes, des Geburtsdatums und der


Kommunikationssprache ist die Angabe aller Daten zwingend, damit Sie sich registrieren

können und damit Zugang zum „STIHL connected“ System erhalten. Die freiwillig zur

Verfügung gestellten Daten sind für die Registrierung nicht erforderlich und können auch

später im Nutzer-Account vom Nutzer selbst angelegt oder entfernt werden.

Rechtsgrundlagen für die Datenverarbeitung sind die Durchführung vorvertraglicher

Maßnahmen und die Erfüllung des mit Ihnen bestehenden Vertrages sowie Ihre Einwilligung.

(6.3.) Geräte-/Maschinen-/Werkzeugdaten und Vertragsdaten

Zusammen mit diesen Daten werden die gerätespezifischen Daten zu Ihrem mobilen

Endgerät (Smartphone/Smart-Device) wie Gerätetyp, Betriebssystem und Akkustand sowie

zu der gepaarten Maschine oder dem Werkzeug wie Geräte-/Serien-Nr./Artikel-Nr. sowie zu

dem genutzten „STIHL Smart Connector“, wie zum Beispiel Batteriefüllstand, MAC-Adresse,

HW-/SW-Variante unter Beachtung der auf den Vertrag anwendbaren

Datenschutzbestimmungen zur Begründung, Ausgestaltung, Durchführung, Abänderung

und/oder Beendigung des Nutzungsverhältnisses im automatisierten Verfahren erhoben,

verarbeitet und genutzt.

In gleicher Weise und zu demselben Zweck werden die spezifischen Vertragsdaten [Datum

und Inhalt des Vertragsschlusses, etwaige Widerrufserklärungen, Widerspruch, Auskunfts-,

Löschungs-, Datenübertragungs- und Einschränkungsverlangen in Bezug auf die

Datenverarbeitung, Datum und Inhalt von Vertragsänderungen, sonstige Erklärungen der

Parteien, z.B. Kündigung, Mängelanzeigen etc.] erhoben, verarbeitet und genutzt.

Die Übertragung Ihres Nutzungsverhältnisses zu den „STIHL connected Services“ insgesamt

und/oder einzelner Bestandteile auf Dritte ist ausgeschlossen. Im Falle des nutzerseitigen

Verkaufs und der Eigentumsübertragung oder der dauerhaften Weitergabe des „STIHL Smart

Connectors“ oder des mit ihm gepaarten Geräts an einen Dritten bedarf es zur Bedienbarkeit

des „STIHL Smart Connectors“ mittels „STIHL connected Services“ durch den Dritten

der Abmeldung von den „STIHL connected Services“ durch Löschung Ihres Accounts

mittels der Funktion „ACCOUNT LÖSCHEN“;

des Abschlusses einer eigenständigen Nutzungsvereinbarung zwischen dem Dritten

und STIHL betreffend die „STIHL connected Services“.

Der Dritte erhält somit keinen Einblick in die von Ihnen erzeugten personenbezogenen Daten. Er sieht lediglich bei seiner ersten Inbetriebnahme einmalig die Angabe der Gesamtleistung des „STIHL Smart Connectors“ bzw. des mit ihm gepaarten STIHL Geräts. Danach erzeugt er durch den Betrieb ausschließlich eigene Daten. Rechtsgrundlagen für die Datenverarbeitung sind die Erfüllung des mit Ihnen bestehenden Vertrages und Ihre Einwilligung.

(6.4.) Zusatznutzer (Team)

Falls Sie es wünschen, können sich zusätzliche Nutzer registrieren (im Folgenden „Team“).

Hier werden die personenbezogenen Daten der Teammitglieder (Anzahl,

Registrierungsdaten, die gepaarten Maschinen/Werkzeuge und „STIHL Smart Connectoren“

inklusive aller zuvor bezeichneten Daten in gleicher Weise und zu demselben Zweck und auf

Basis derselben Rechtsgrundlage gemäß Ziff. 6.1 bis 6.3 erhoben, verarbeitet und genutzt.

Der Zusatznutzer erhält von Ihnen eine Einladung und muss sich selber registrieren und in

die Datenverarbeitung einwilligen. Als Hauptnutzer können Sie in die mittels des Betriebes

des Gerätes durch den Zusatznutzer erzeugten Daten Einsicht nehmen. Als Hauptnutzer sind

Sie allein dafür verantwortlich zu gewährleisten, dass diesbezüglich alle

datenschutzrechtlichen Vorgaben eingehalten werden und Sie im Verhältnis zum

Zusatznutzer über die notwendige Berechtigung verfügen.


Rechtsgrundlagen für die Datenverarbeitung sind die Erfüllung des mit Ihnen bestehenden

Vertrages und Ihre Einwilligung.

(6.5.) Standort- und Nutzungsdaten

Zum Zwecke der vertragsgemäßen Nutzung des „STIHL connected“ Systems werden

Standort- und nutzungsbezogene Daten an STIHL übermittelt, insbesondere

Standortdaten des mobilen Endgeräts des Nutzers (Smartphone/Smart-Device) bei

Bluetooth-Reichweite zum „STIHL Smart Connector“ und zur gepaarten

Maschine/zum gepaarten Werkzeug

Standortdaten der gepaarten Maschine/des Werkzeugs, unter anderem aus Google

Maps

Nutzungsverhalten der/des gepaarten Maschine/Werkzeugs mit dem „STIHL Smart

Connector“ (z.B. Betriebsdauer, Verbrauchsdaten, Zeiten der Aktivierung und

Deaktivierung, Pairing-Zeitpunkt)

Daten zu der zu verwaltenden Maschinen-/Werkzeugflotte (Abbildung(en) und Anzahl

der Maschinen/Werkzeuge)

Bestehen/Nichtbestehen einer Bluetooth-Verbindung

Maschinenbezogene Wartungseinträge, Wartungshistorie

Maschineneinsätze (z.B. Spezialeinsätze)

Die in diesem Zusammenhang anfallenden Standort-/Nutzungs- und Befehlsdaten werden – ebenso wie die von Ihnen im Rahmen ihrer Profileinstellungen nach erfolgter Registrierung zusätzlich freiwillig hinterlegten Daten/Angaben (z.B. Hinterlegung einer Telefon-/Mobilfunknummer und E-Mail-Adresse zum Erhalt von Zustands-/Warnmeldungen und für den Fall eines Rückrufs) – ebenfalls von STIHL entsprechend Ziff. 6 der Datenschutzbestimmungen für die Zwecke der Begründung, Ausgestaltung, Durchführung, Abänderung und Beendigung des Nutzungsverhältnisses für das „STIHL connected“ System und die Nutzung der Funktionalitäten der „STIHL App“ und des „STIHL connect pro Portals“ im Rahmen eines automatisierten Verfahrens erhoben, verarbeitet und genutzt. Rechtsgrundlagen für die Datenverarbeitung sind die Erfüllung des mit Ihnen bestehenden Vertrages und Ihre Einwilligung.

(7.) Händlerdaten

Falls Sie es wünschen, können Sie die Daten des von Ihnen bevorzugten Händlers, bei dem

Sie das gepaarte Werkzeug/die gepaarte Maschine erworben haben und/oder der für die

Wartung zuständig sein soll, angeben. Mit der Benennung Ihres bevorzugten Händlers

erteilen Sie die Einwilligung, dass wir diesem Händler Ihre Kunden-, Geräte- und

Nutzungsdaten zum Zwecke des Supports, der Wartung und der Pflege zugänglich machen

sowie diese Daten für besagte Zwecke verarbeitet und genutzt werden dürfen; diese

Einwilligung erstreckt sich auch auf die Nutzung dieser Daten zur Übermittlung von

Informationen durch uns oder den besagten Fachhändler, insbesondere in Bezug auf den

Wartungs- und Pflegebedarf (z.B. Wartungsintervalle etc.).



(8.) Webanalyse-/Standort-/Karten-Tools

(8.1.) Google Analytics

Das „STIHL connect pro Portal“ benutzt Google Analytics, einen Webanalysedienst der

Google Inc. („Google"). Google Analytics verwendet sog. „Cookies", Textdateien, die auf

Ihrem Computer gespeichert werden und die eine Analyse der Benutzung der Website durch

Sie ermöglichen. Die durch den Cookie erzeugten Informationen über Ihre Benutzung dieser


Website werden in der Regel an einen Server von Google in den USA übertragen und dort

gespeichert.

Im Falle der Aktivierung der IP-Anonymisierung auf dieser Webseite, wird Ihre IP-Adresse

von Google jedoch innerhalb von Mitgliedstaaten der Europäischen Union oder in anderen

Vertragsstaaten des Abkommens über den Europäischen Wirtschaftsraum zuvor gekürzt. Nur

in Ausnahmefällen wird die volle IP-Adresse an einen Server von Google in den USA

übertragen und dort gekürzt. Wir weisen darauf hin, dass auf dem „STIHL connect pro Portal“

Google Analytics um den Code „gat._anonymizeIp();“ erweitert wurde, um eine anonymisierte

Erfassung von IP-Adressen (sog. IP-Masking) zu gewährleisten. Ihre IP-Adresse wird daher

auf unsere Veranlassung hin von Google lediglich in gekürzter Form erfasst, was eine

Anonymisierung gewährleistet und keine Rückschlüsse auf Ihre Identität zulässt. Im Falle der

Aktivierung der IP- Anonymisierung auf unseren Webseiten, wird Ihre IP-Adresse von Google

innerhalb von Mitgliedstaaten der Europäischen Union oder in anderen Vertragsstaaten des

Abkommens über den Europäischen Wirtschaftsraum zuvor gekürzt.

Nur in Ausnahmefällen wird die volle IP-Adresse an einen Server von Google in den USA

übertragen und dort gekürzt. Im Auftrag des Betreibers des Webportals wird Google diese

Informationen benutzen, um Ihre Nutzung des Webportals auszuwerten, um Reports über die

Websiteaktivitäten zusammenzustellen und um weitere mit der Websitenutzung und der

Internetnutzung verbundene Dienstleistungen gegenüber dem Webportalbetreiber zu

erbringen.

Die im Rahmen von Google Analytics von Ihrem Browser übermittelte IP-Adresse wird nicht

mit anderen Daten von Google zusammengeführt. Sie können die Speicherung der Cookies

durch eine entsprechende Einstellung Ihrer Browser-Software verhindern; wir weisen Sie

jedoch darauf hin, dass Sie in diesem Fall gegebenenfalls nicht sämtliche Funktionen dieser

Website vollumfänglich werden nutzen können.

Sie können die Erfassung der durch das Cookie erzeugten und auf Ihre Nutzung der Website

bezogenen Daten (inkl. Ihrer IP-Adresse) an Google sowie die Verarbeitung dieser Daten

(8.2.) Tag Manager von Google

Google Tag Manager ist eine Dienstleistung von Google Inc., 1600 Amphitheatre Parkway,

Mountain View, CA 94043, USA ("Google") mit der Tags erstellt, aktualisiert und verwaltet

werden können.

Tags sind kleine Codeelemente auf dem „STIHL connect pro Portal“, die unter anderem dazu

dienen, den Traffic und das Besucherverhalten auf dem „STIHL- connect pro Portal“ zu

messen sowie die Auswirkung von Online-Werbung und sozialen Kanälen zu erfassen.

Wenn Sie das „STIHL connect pro Portal“ besuchen, wird die aktuelle Tag-Konfiguration an

Ihren Browser gesendet. Sie enthält Anweisungen, welche Tags ausgelöst werden sollen.


Das Tool selbst erfasst keine personenbezogenen Daten. Das Tool sorgt aber für die

Auslösung anderer Tags, die ihrerseits unter Umständen personenbezogene Daten erfassen.

(8.3.) Google Maps

Zur Ermittlung der Standortdaten des „STIHL Smart Connectors“ und der gepaarten Geräte

greift STIHL auf die Anwendung von Google Maps zurück, eine Dienstleistung der Google

Inc. ("Google").

Google Maps wird von Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043,

USA betrieben.

Die Nutzung von Google Maps und der über Google Maps erlangten Informationen erfolgt

gemäß den Google-Nutzungsbedingungen für Google Maps. Die Nutzungsbedingungen für

Google Maps sind in den Nutzungsbedingungen von Google zu lesen:

Die Nutzung von Google Maps setzt immer voraus, dass Google die IP-Adresse der Nutzer

wahrnimmt und die Standortdaten der Mobile Devices und der per „STIHL App“ oder über

das „STIHL connect pro Portal“ gesteuerten Geräte erhebt und verarbeitet. Denn ohne die

IP-Adresse könnte Google die Inhalte nicht an den Browser des jeweiligen Nutzers senden.

Die IP-Adresse wird an einen Server von Google übertragen, der auch außerhalb

Deutschlands stehen kann, und dort gespeichert. Google hat sich zwar dem Privacy Shield

unterworfen, das Google verpflichtet, das in der EU gültige Datenschutzniveau einzuhalten,

trotzdem ist die Übermittlung von Daten außerhalb Europas datenschutzrechtlich mit Risiken

verbunden.

Die Nutzung von Google Maps ermöglicht es, Ihr mit dem „STIHL Smart Connector“

versehenes Gerät über die „STIHL App“ oder das „STIHL connect pro Portal“ zu steuern.

Wir weisen jedoch darauf hin, dass die Nutzung der STIHL connected Services

erheblich eingeschränkt oder nicht möglich sein kann, wenn Google Maps deaktiviert

wird, da insbesondere die Standortdaten erforderlich sind, um die wesentlichen

Funktionalitäten von STIHL connected nutzen zu können.



(8.4.) Crashlytics

Die „STIHL App“ benutzt Crashlytics.

Crashlytics ist eine Dienstleistung der Google Inc.,1600 Amphitheatre Parkway, Mountain

View, CA 94043, USA („Google") für App-Entwickler und App-Anbieter, die es ihnen

ermöglicht, Informationen über die Funktionsweise und eventuelle Mängel,

Funktionsstörungen und Abstürze der von ihnen entwickelten oder betriebenen mobilen

Applikationen zu erhalten.

Crashlytics wird dazu verwendet, die „STIHL App“ zu warten. Zu diesem Zwecke werden

Mängel in der Funktionsweise sowie mögliche Abstürze der „STIHL App“ protokolliert.

Google speichert und verarbeitet Informationen über den Zustand des von Ihnen genutzten

mobilen Endgerätes, Gerätenummern, Gerätetyp und Informationen über das verwendete

Betriebssystem, Informationen zu der Funktionsweise der App und den Standort zum

Zeitpunkt eines Absturzes sowie zu der Art und Weise, wie Sie die „STIHL App“ benutzen,

wann Sie die Applikation installiert haben und ob und welches Feedback Sie gegebenenfalls

zu der Nutzung der App gegeben haben. Falls Sie sich auf unsere E-Mail-Einladung hin bereit

erklärt haben, bestimmte Versionen der „STIHL App“ zu testen, dürfen wir die Gerätedaten

und Nutzungsdaten bezogen auf die getestete Version der App sowie Ihren Namen und Ihre

Adresse an Google senden, so dass Entwickler von Google Sie zum Zwecke der Behebung

von Mängeln oder Funktionsstörungen kontaktieren können. Google erhält auch eine

Bestätigung, wenn Sie eine E-Mail von uns geöffnet haben. Google speichert all diese Daten,

um uns zu ermöglichen, die „STIHL App“ zu analysieren und mit Ihnen über Ihre Erfahrung

mit der Nutzung der App zu kommunizieren.

Google speichert und nutzt diese Daten in der beschriebenen Weise für uns zu dem

nachfolgend beschriebenen Zweck: Die Daten dienen dazu, uns zu ermöglichen, die

Funktionalitäten, etwaige Mängel oder Störungen der App zu analysieren und den Service

und die Funktionsweise der App zu verbessern.

Google speichert und nutzt für eigene Zwecke ausschließlich aggregierte anonymisierte und

pseudonymisierte Daten, um den eigenen Service zu verbessern und das Verhalten von

Nutzern und aktuelle Trends zu analysieren oder für ähnliche Recherchen und Analysen.

Die Daten unserer Nutzer werden von Google nicht weitergegeben und stehen nur uns zur

Verfügung.

Wir weisen jedoch darauf hin, dass die gespeicherten Daten auch an einen Server von

Google übertragen werden können, der außerhalb Deutschlands stehen kann, und dort

gespeichert werden. Google hat sich zwar dem Privacy Shield unterworfen, das Google

verpflichtet, das in der EU gültige Datenschutzniveau einzuhalten, trotzdem ist die

Übermittlung von Daten außerhalb Europas datenschutzrechtlich mit Risiken verbunden. Wir

Google sichert zu, alle erforderlichen technischen und organisatorischen Maßnahmen zum

Schutz und zur Sicherheit Ihrer Daten gegen Verlust und Zerstörung ergriffen zu haben. Die

Daten unserer Nutzer werden getrennt von den Daten anderer Auftraggeber von Google

gespeichert und verarbeitet.

Sie können die Erfassung und Verarbeitung der Daten durch Google verhindern, indem Sie

Crashlytics in der „STIHL App“ innerhalb der Menüführung „Impressum / Einstellungen“

deaktivieren.

Wir weisen jedoch darauf hin, dass die Nutzung des „STIHL connected“ Systems

erheblich eingeschränkt werden kann, wenn Crashlytics deaktiviert wird, da

insbesondere die über Crashlytics gewonnenen Erkenntnisse zu einer schnelleren

Feststellung und Behebung etwaiger Störungen führen und die Entwickler von Google

bei der Behebung von Störungen unterstützen können.

Rechtsgrundlage der Datenverarbeitung ist Ihre Einwilligung und unser berechtigtes

Interesse an der Verbesserung unseres Service und unserer Produkte und der schnellen

Beseitigung von Mängeln und Funktionsstörungen.

(9.) Statistische Auswertungen

Der Kunde erklärt sich damit einverstanden, dass zur Anfertigung von anonymisierten

Statistiken (insbesondere solcher zum Zwecke der Produkt- und Serviceverbesserung, zur

Erfüllung unserer Produktbeobachtungspflicht, zur Optimierung des Marketings und zur

Verbesserung des Händlernetzes und zur Durchführung und Verbesserung des Supports und

der Analyse des Geräteverhaltens z.B. im Hinblick auf die Produktsicherheit) die im Rahmen

der vertragsgemäßen Nutzung des „STIHL connected“ Systems generierten/hinterlegten

Daten (insbesondere Händler-, Geräte-/Maschinen-/Werkzeugdaten incl. Standort- und

Nutzungsdaten) genutzt werden können.

Stets werden nur so viele personenbezogenen Daten genutzt, wie dies zwingend zu dem

verfolgten Zweck nötig ist. Wenn irgend möglich, werden nur anonymisierte oder

pseudonymisierte Daten verarbeitet.

Rechtsgrundlagen für diese Datenverarbeitungen sind die Erfüllung und Abwicklung unseres

mit Ihnen bestehenden Vertrages, Ihre Einwilligung und unser berechtigtes Interesse an der

Verbesserung unserer Leistungen, der Erfüllung unserer Produktbeobachtungspflichten und

Gewährleistung der Produktsicherheit.

(10.) Kommunikationsdaten

(10.1.) Wenn Sie uns telefonisch, per E-Mail, per Post, Kontakt-Formulare oder auf andere Weise

mit einem Anliegen kontaktieren oder wir Sie kontaktieren, verarbeiten wir auch Ihre

personenbezogenen Daten (z.B. Name, Adresse, Telefonnummer sowie die Inhalte der

Mitteilung). Wir verwenden diese Kommunikationsdaten grundsätzlich nur, um Ihrem

jeweiligen Anliegen nachzukommen und mit Ihnen zu kommunizieren.


Kommunikationsdaten werden gelöscht, soweit sie nicht mehr zum Austausch mit Ihnen

erforderlich sind und etwaige gesetzliche Aufbewahrungsfristen abgelaufen sind.

Die Verarbeitung Ihrer Daten erfolgt dabei auf Grundlage von Art. 6 Abs. 1 lit. b) DSGVO,

soweit dies mit der Anbahnung oder Erfüllung eines Vertrages mit Ihnen in Verbindung steht,

z.B. bei Reklamationen. Im Übrigen erfolgt die Verarbeitung von personenbezogenen

Kontakt- und Kommunikationsdaten auf Grundlage von Art. 6 Absatz 1 lit. f) DSGVO unter

Bezugnahme auf unser berechtigtes Interesse an der Durchführung einer Kundenbetreuung

und/oder zwecks Verbesserung unseres „M2M“-Serviceangebots.

(10.2.) Für unser Service-Center setzen wir Dienstleister ein, mit denen entsprechende

Auftragsverarbeitungsverträge (siehe hierzu auch Ziff. 11 dieser Datenschutzerklärung)

geschlossen wurden.

Eingangs eines Telefonats mit unserem Service-Center werden Sie gefragt, ob Sie damit

einverstanden sind, dass die Telefonate für Qualitätssicherungs- und Schulungszwecke

aufgezeichnet und/oder durch mit der Qualitätssicherung betraute Mitarbeiter – die von uns,

einem mit uns verbundenen Unternehmen der STIHL-Gruppe oder vom Call-Center selbst

stammen können – mitgehört werden dürfen. Ihre diesbezügliche Einwilligung ist

selbstverständlich freiwillig. Aufzeichnungen der Telefonate werden spätestens nach 90

Tagen wieder gelöscht, unbeschadet dessen, dass sie Ihre erteilte Einwilligung jederzeit und

ohne Angabe von Gründen auch vor Ablauf dieses 90-Tage-Zeitraums widerrufen können.

Ein Einwilligungswiderruf ist Ihrerseits auch während des Telefonats selbst möglich (z.B.

durch entsprechende Mitteilung an den Mitarbeiter).

(11.) Weiterübertragung von Daten/Auftragsverarbeitung

(11.1.) Zum Zwecke des Supports oder der Mängelbearbeitung können die Registrierungsdaten,

Maschinen-, Geräte- und Vertragsdaten und/oder Standort- und Nutzungsdaten an

technische Dienstleister und Call-Center weitergegeben werden.

(11.2.) Zum Zwecke des Supports, der Kundenbetreuung und Wartungsinformation können die

Registrierungsdaten, Maschinen-, Geräte- und Vertragsdaten und/oder Standort- und

Nutzungsdaten an den vom Kunden angegebenen bevorzugten Händler weitergegeben

werden.

(11.3.) Die so weitergegebenen Daten dürfen von unseren Dienstleistern lediglich zur Erfüllung

dieser von uns vorgegebenen Aufgaben verwendet werden. Eine anderweitige Nutzung der

Daten ist nicht gestattet. Stets bestehen mit diesen Dienstleistern Vereinbarungen über die

Auftragsverarbeitung.

(11.4.) Vorbehaltlich der vorstehenden Regelungen werden in keinem Fall ungefragt und ohne Ihre

Einwilligung Ihre personenbezogenen Daten zu Werbe- oder Marketingzwecken oder zu

sonstigen Zwecken Dritten zur Kenntnis gegeben oder an Dritte weitergegeben. Dies gilt nur

dann nicht, wenn STIHL gesetzlich oder aufgrund behördlicher Anordnung, insbesondere in

Fällen der Strafverfolgung oder zum Zwecke der Gefahrenabwehr, zur Herausgabe der Daten

verpflichtet ist.

(11.5.) Es erfolgt – vorbehaltlich Ziff. 8 dieser Datenschutzbestimmungen – grundsätzlich keine

Übertragung der personenbezogenen Daten in Drittstaaten außerhalb des Europäischen

Wirtschaftsraumes. Ist einmal ausnahmsweise eine Übertragung in einen Drittstaat

erforderlich, werden die datenschutzrechtlich erforderlichen Maßnahmen zur Gewährleistung

des Datenschutzniveaus vorgenommen.


(11.6.) Rechtsgrundlage für diese Datenverarbeitung ist stets die Verarbeitung in unserem Auftrag

im Rahmen des geschilderten Zweckes und der angegebenen Rechtsgrundlage des

konkreten Verarbeitungsvorganges.

(12.) Löschen der Daten

Ihre personenbezogenen Daten werden gelöscht, wenn Sie das Nutzungsverhältnis beenden

oder die Löschung verlangen oder die Daten für den Zweck, für den sie erhoben und

verarbeitet wurden, nicht mehr erforderlich sind. Eine Löschung erfolgt nicht, sofern und

soweit gesetzliche Aufbewahrungspflichten bestehen oder die ordnungsgemäße Abwicklung

des Vertragsverhältnisses die weitere Speicherung der Daten erfordert. In letzteren Fällen

werden die Daten gesperrt (sog. Einschränkung der Verarbeitung). Die Daten stehen in

diesem Falle für die weitere oder erneute Nutzung des „STIHL connected“ Systems nicht

mehr zur Verfügung. Für die erneute Nutzung müsste eine Neuregistrierung erfolgen. Wir

weisen darauf hin, dass es im Falle eines Löschungsverlangens oder der Beendigung des

Nutzungsverhältnisses aus technischen Gründen bis zu fünf Wochen dauern kann, bis die

Daten auf allen vorhandenen Sicherungskopien gelöscht sind. Die Daten sind in diesem

Zeitraum jedoch für jegliche Nutzung gesperrt (Einschränkung der Verarbeitung).

(13.) Betroffenenrechte

Als von der Datenverarbeitung betroffener Person stehen Ihnen zahlreiche Rechte zur

Verfügung. Im Einzelnen sind dies:

das Auskunftsrecht, d. h. Sie haben das Recht, Auskunft über die von uns zu Ihrer

Person gespeicherten Daten zu erhalten.

das Berichtigungs- und Löschungsrecht, d.h. Sie können jederzeit die

Berichtigung falscher Daten und – soweit die gesetzlichen Voraussetzungen erfüllt

sind – die Vervollständigung oder Löschung Ihrer Daten verlangen. Soweit

gesetzliche Aufbewahrungspflichten einer Löschung von Daten entgegenstehen, wird

deren Verarbeitung eingeschränkt (siehe nachfolgend).

das Recht auf Einschränkung der Verarbeitung, d.h. Sie können von STIHL –

soweit die gesetzlichen Voraussetzungen erfüllt sind – verlangen, dass STIHL die

Verarbeitung Ihrer Daten einschränkt.

das Recht auf Widerspruch gegen die Datenverarbeitung bei Rechtsgrundlage

„berechtigtes Interesse“, d.h. Sie haben das Recht, jederzeit der Datenverarbeitung

durch STIHL zu widersprechen, soweit diese auf der Rechtsgrundlage „berechtigtes

Interesse“ beruht. STIHL wird dann die Verarbeitung der Daten einstellen, es sei

denn, STIHL kann – gemäß den gesetzlichen Vorgaben – zwingende schutzwürdige

Gründe für die Weiterverarbeitung nachweisen, welche die Rechte des Kunden

überwiegen.

das Recht auf Widerruf der Einwilligung, d.h. sofern Sie eine Einwilligung in die

Verarbeitung Ihrer Daten erteilt haben, können Sie diese jederzeit mit Wirkung für die

Zukunft widerrufen. Die Rechtmäßigkeit der Verarbeitung Ihrer Daten bis zum

Widerruf bleibt hiervon unberührt.

das Beschwerderecht bei der Aufsichtsbehörde, d.h. Sie können eine Beschwerde

bei der zuständigen Aufsichtsbehörde einreichen, wenn Sie der Meinung sind, dass

die Verarbeitung Ihrer Daten gegen geltendes Recht verstößt. Sie können sich hierzu

an die Datenschutzbehörde wenden, die für seinen Wohnort bzw. sein Land zuständig

ist oder an die für STIHL zuständige Datenschutzbehörde.


das Recht auf Datenübertragung, d.h. das Recht, die zur Verfügung gestellten

Daten in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten

und sie durch STIHL an einen anderen Verantwortlichen zu übermitteln.

(14.) Änderungen und Ergänzungen der Datenschutzbestimmungen

(14.1.) STIHL behält sich Änderungen und Ergänzungen der Datenschutzbestimmungen für das

„STIHL connected“ System vor, soweit Sie hierdurch objektiv nicht schlechter gestellt werden

(z.B. Beibehaltung oder Verbesserung oder Ergänzung von Funktionalitäten) oder die

Änderung/Ergänzung unter Berücksichtigung der Interessen von STIHL für Sie zumutbar ist.

Als berücksichtigungswürdige und dem Kunden zumutbare Interessen von STIHL gelten

Veränderungen der Marktverhältnisse in technischer oder kalkulatorischer Hinsicht,

insbesondere, indes nicht beschränkt hierauf,

die Anpassung der Datenschutzbestimmungen an gesetzliche Vorgaben bzw. an

eine aktualisierte/veränderte Rechtsprechung,

die Anpassung der Datenschutzbestimmungen an technische

Änderungen/Neuerungen betreffend die „STIHL connected Services“ (z.B. im

Zusammenhang mit den von der „STIHL App“ unterstützten Betriebssystemen).

(14.2.) Auch im Übrigen behält sich STIHL Änderungen/Ergänzung der Datenschutzbestimmungen

vor. Solch sonstige Änderungen und Ergänzungen der Datenschutzbestimmungen werden

Nutzern in Textform mindestens sechs Wochen vor dem Inkrafttreten der

Änderung/Ergänzung mitgeteilt.

Insofern gelten die Änderungen/Ergänzungen als genehmigt, wenn der Nutzer nicht innerhalb

von 6 Wochen ab Empfang der Mitteilung (gerechnet ab dem Zugang der Benachrichtigung)

den mittels „STIHL connected“ betriebenen Service kündigt; die Kündigung kann mittels

„STIHL App“ oder „STIHL connect pro Portal“-Einstellung („ACCOUNT LÖSCHEN“) oder

Mitteilung (auch in Textform per E-Mail möglich) an die ANDREAS STIHL AG & Co. KG,

Badstraße 115, D-71336 Waiblingen, E-Mail: [email protected] erfolgen. Sie werden auf

diese Kündigungsmöglichkeit sowie über die Änderung/Ergänzung der

Datenschutzbestimmungen mindestens in Textform hingewiesen.


GAO Data Protection Provisions for “STIHL connected”

(1.) The following provisions inform the customer of the collection, processing and use of his or

her personal data in connection with the use of the “STIHL connected” system, consisting of

“STIHL Smart Connector”, “STIHL App” and “STIHL connect pro Portal”.

(2.) These Data Protection Provisions can be stored and printed out.

(3.) Controller

The controller of the collection, processing and use of data is: ANDREAS STIHL AG & Co.

(0)7151-26-0 (hereinafter referred to as “STIHL”).

(4.) Consent

By agreeing to these Data Protection Provisions you consent to “STIHL” collecting,

processing and using your personal data in compliance with the relevant statutes in

accordance with the following provisions.

(5.) Personal data

Personal data means any information relating to an identified or identifiable natural person.

This includes, for example, name, address, telephone number, e-mail address, profile

pictures, connected mobile devices and paired machines or tools and consumption data and

other data you make available to STIHL for the purpose of registering and using the “STIHL

connected” system.

(6.) Log files, registration data and voluntary data

(6.1.) Log files

Usage data are transmitted by the respective Internet browser and stored in log files, so-

called server log files, every time the “STIHL connect pro Portal” is accessed. The stored data

sets contain the following data: date and time of the retrieval, name of the site retrieved, IP

address, source URL which you came to the “STIHL connect pro Portal” from, data volume

transmitted, information on the browser you use. These da-ta are solely used for technical

communication and, subject to any statutory retention obligations, are deleted after

termination of the use. The legal basis for the data processing is the implementation of pre-

contractual measures, the performance of the contract entered into with you and your

consent.

(6.2.) Registration data

All of the personal data stored by you during the course of registering [first name, last name,

address (street, house number, ZIP code, town/city), e-mail address, telephone number,

password, user name; web address; profile picture; date of birth; communication language]

on the “STIHL Smart Connector”, the “STIHL App” and the “STIHL connect pro Portal” shall

be collected, processed and used by automated means by STIHL in compliance with the Data

Protection Provisions applying to the contract for the purpose of establishing, structuring,

executing, amending and/or terminating the usage relationship. With the exception of the

telephone number, the web address, the profile picture, the date of birth and the

communication language, the provision of all data is mandatory for you to be able to register

and thus gain access to the “STIHL connected” system. The data provided on a voluntary


basis are not required for registration and may also be stored or removed from the user

account by the user himself or herself at a later date.

The legal basis for the data processing is the implementation of pre-contractual measures,

the performance of the contract entered into with you and your consent.

(6.3.) Device/machine/tool data and contract data

Together with these data, the device specific data on your mobile device (smartphone/smart

device) such as device type, operating system and battery status, and on the paired machine

or tool, such as device/serial number/article number, and on the “STIHL Smart Connector”

used, for example battery level, MAC address, hard-ware/software variant, shall be collected,

processed and used by automated means, in compliance with the Data Protection Provisions

applying to the contract, for establishing, structuring, executing, amending and/or terminating

the usage relationship.

Similarly and for the same purpose, the specific contract data [date and content of the contract

concluded, any declarations of revocation, objection, request for information, erasure, data

portability and restriction relating to the data processing, the date and content of contract

changes, other declarations by the parties, e.g. notice of termination, notifications of defects]

shall be collected, processed and used.

The transfer to third parties of your usage relationship relating to the “STIHL connected

Services” as a whole and/or individual components thereof is excluded. In the event of the

sale by the user and the transfer of ownership or permanent transfer of the “STIHL Smart

Connector” or of the device paired with it to a third party, the operability of the “STIHL Smart

Connector” by the third party by means of the “STIHL connected Services” shall require the

following

De-registration from the “STIHL connected Services” by deleting your account using

the function “DELETE ACCOUNT”; and

conclusion of an independent usage agreement by the third party and STIHL in

respect of the “STIHL connected Services”.

The third party does not therefore obtain any access to the (personal) data created by you. When first commissioned by the third party, the third party merely sees once the indication of the total performance of the “STIHL Smart Connector” and/or of the STIHL device paired with it. Thereafter the third party solely generates his or her own data through operation. The legal basis for the data processing is the performance of the contract with you and your consent.

(6.4.) Additional users (Team)

If you so desire you can register additional users (hereinafter: “Team”). The personal data of

the Team members (number of users, registration data, the paired machines/tools and the

“STIHL Smart Connectors” inclusive of all aforementioned data) shall be collected, processed

and used in the same way and for the same purpose and on the same legal basis as set out

in sub-sections 6.1 to 6.3 The additional user shall be sent an invitation from you and has to

perform the registration himself/herself and consent to the data processing. As the main user

you are able to access the data generated by the additional user through the operation of the

device. As the main user you are solely responsible for guaranteeing that in this respect all

the requirements of data protection law are complied with and that you have the authorization

necessary under data protection law in the relationship with the additional user.

The legal basis for the data processing is the performance of the contract with you and your

consent.


(6.5.) Data on location and usage

For the purpose of the contractual usage of the “STIHL connected” system, data relating to

location and usage are transferred to STIHL, in particular

Location data of the user’s mobile device (smartphone/smart device) within Bluetooth

range of the “STIHL Smart Connector” and the paired machine/tool

Location data of the paired machine/tool, including from Google Maps

Usage behavior of the paired machine/tool with the “STIHL Smart Connector” (e.g.

operation period, consumption data, activation and deactivation times, pairing time)

Data on the machine/tool fleet to be managed (illustration(s) and number of

machines/tools)

Existence/absence of a Bluetooth connection

Machine-related maintenance records, maintenance history

Deployment of machines (e.g. special deployments)

The location/use and command data generated in this connection shall also – just as the data/details you additionally provided voluntarily when making your profile settings after registration (e.g. storage of a telephone/mobile telephone number and e-mail address in order to receive status/warning notifications and in the event of recall action) – be collected, processed and used by automated means by STIHL in accordance with section 6 of the Data Protection Provisions for the purposes of establishing, structuring, executing, amending and terminating the usage relationship for the “STIHL connected” system and the use of the functionalities of the “STIHL App” and of the “STIHL connect pro Portal”. The legal basis for the data processing is the performance of the contract with you and your consent.

(7.) Retailer data

If you so desire you can indicate the data of your preferred retailer from whom you acquired

the paired machine/tool and/or who is to be responsible for the maintenance. By indicating

your preferred retailer you give us your consent to our making your customer, device and

usage data available to this retailer for the purpose of support, maintenance and service and

to these data being able to be processed and used for the said purposes; this consent also

covers the use of these data to transfer information by us or the said retailer, in particular with

respect to maintenance and service needs (e.g. on maintenance intervals etc.).

you and your consent.

(8.) Web analysis/location/map tools


The “STIHL connect pro Portal” uses Google Analytics, a web analysis service of Google Inc.

(“Google”). Google Analytics uses so-called “cookies”; these are text data files stored on your

computer that enable your use of the website to be analyzed. The information generated by

the cookie on your use of this website is generally transmit-ted to a Google server in the USA

and is stored there.

If the IP anonymization is enabled on this website, however, your IP address is truncated by

Google in advance in Member States of the European Union and in other contracting states

of the Agreement on the European Economic Area. Only in exceptional cases will the full IP

address be sent to a Google server in the USA and truncated there. We point out that Google

Analytics has been extended by the code “gat._anonymizeIp();” on the “STIHL connect pro

Portal” in order to guarantee anonymized recording of IP addresses (so-called IP masking).

At our instigation your IP address will therefore only be recorded by Google in truncated form


thus guaranteeing anonymization and not allowing your identity to be discerned. If IP

anonymization is enabled on our websites, your IP address will be truncated by Google in

advance in Member States of the European Union and in other contracting states of the

Agreement on the European Economic Area. Only in exceptional cases will the full IP address

be transferred to a Google server in the USA and truncated there.

On behalf of the operator of the web portal, Google will use this information in order to

evaluate your usage of the web portal, to compile reports on activities on the website and to

perform additional services relating to website and Internet usage for the operator of the web

portal.

The IP address transmitted from your browser in connection with Google Analytics will not be

combined with other data from Google. You can prevent cookies from being stored by setting

your browser software accordingly; we point out, however, that in this case you might not be

able to fully use all of the functions of this website.

generated by the cookie from being transmitted to Google and processed by Google, by

(8.2.) Google Tag Manager

Google Tag Manager is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain

View, CA 94043, USA (“Google”) enabling tags to be produced, updated and managed.

Tags are small code elements on the “STIHL connect pro Portal” which serve, inter alia, to

measure the traffic and visitor behavior on the “STIHL connect pro Portal” and to capture the

effect of online advertising and of social media.

When you visit the “STIHL connect pro Portal” the current tag configuration is sent to your

browser. It contains instructions on which tags are to be triggered. The tool itself does not

collect any personal data. The tool does, however, ensure that other tags are triggered which

(8.3.) Google Maps

STIHL accesses the application of Google Maps, a service of Google Inc. (“Google”) in order

to establish the location data of the “STIHL Smart Connector” and of the paired devices.

Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA

94043, USA.

The use of Google Maps and of the information obtained via Google Maps is effectuated in

accordance with the Google terms and conditions of use for Google Maps. The terms and

conditions of use of Google Maps can be found in the Google terms and conditions at:

The precondition for the use of Google Maps is always for Google to have the users’ IP

address and to collect and process the location data of the mobile devices and of the devices

controlled by the “STIHL App” or via the “STIHL connect pro Portal”. This is because without

the IP address Google would be unable to transmit the content to the browser of the

respective user. The IP address is transferred to and stored on a Google server which can

also be located outside Germany. Although Google has committed to the Privacy Shield

obligating Google to comply with the data protection level applicable in the EU, transferring

data outside Europe is nonetheless subject to data protection risks.

(8.4.) Crashlytics

STIHL App uses Crashlytics

Crashlytics is a service of Google Inc.,1600 Amphitheatre Parkway, Mountain View, CA

94043, USA („Google") for app developers and app providers, which enables them to obtain

information on the functionality and possible deficiencies, malfunctions and crashes of the

mobile applications developed or operated by them.

Crashlytics is used to maintain the “STIHL App”. To this end, deficiencies in the functionality

and possible crashes of the “STIHL App” are recorded.


Google stores and processes information regarding the condition of the mobile device being

used by you, the device number, type of device and information on the operating system

used, information on the functionality of the application and the location at the time of a crash

as well as the way you use the “STIHL App”, when you installed the application and whether

and – if so - which feedback you have given on the use of the application. If you have agreed,

in response to our email invitation, to test certain versions of the “STIHL App”, we may send

the device data and usage data related to the tested version of the application and your name

and address to Google so that Google developers can contact you with the aim of rectifying

deficiencies or malfunctions. Google also receives a confirmation when you open an email

from us. Google saves all this data to enable us to analyze the “STIHL App” and communicate

with you regarding your experience using the application.

Google stores and uses this data for us in the manner described for the purpose described

below: The data is used to enable us to analyze the functionality, any deficiencies or problems

with the application and improve the service and the function of the application.

Google saves and uses for its own purposes exclusively aggregated anonymized and

pseudonymized data to improve its own service and analyze the behavior of users and current

trends or for similar research and analyses.

The data of our users is not passed on to third parties by Google and is available only to us.

However, we draw your attention to the fact that the stored data may also be transferred to a

Google server, which may be located outside Germany, and stored there. Google has in fact

subjected itself to the Privacy Shield which obliges Google to observe the level of data

protection applicable in the EU, but the transfer of data outside Europe still involves risks in

terms of data protection laws. In this respect we refer to Google’s data privacy statement:


Google warrants that it has taken all necessary technical and organizational steps for the

protection and safety of your data against loss and destruction. The data of our users is stored

and processed separately from the data of other Google clients.

You can prevent the collection and processing of data by Google by deactivating Crashlytics

in the “STIHL App” in the menu prompt “Legal Notice / Settings”.

We would point out, however, that the use of the “STIHL Connected” system can be

considerably restricted if Crashlytics is deactivated because the knowledge gained

through Crashlytics can result in faster identification and correction of any

malfunctions and can support Google developers in rectifying such malfunctions.

The legal basis of data processing is your consent and our legitimate interest in improving

our service and our products and the rapid removal of deficiencies and malfunctions.

(9.) Statistical evaluations

The customer declares that he or she is in agreement with the data generated/stored in

connection with the contractual use of the “STIHL connected” system (in particular retailer/


device/ machine/ tool data incl. location and usage data) being used to pro-duce anonymized

statistics (in particular such statistics for the purpose of enhancing the product and service,

fulfilling our obligation to monitor the product, optimizing marketing, improving the retailer

network and for conducting and improving support and analyzing device behavior e.g. with

respect to product safety).

Personal data shall always only be used to the extent absolutely necessary for the purpose

pursued. If at all possible only anonymized or pseudonymized data shall be processed.

The legal basis for this processing of data is the performance and processing of our contract

entered into with you, your consent and our legitimate interest in enhancing our services,

complying with our obligations to monitor the product and ensuring pro-duct security.

(10.) Communication data

(10.1.) If you contact us by phone, by contact form or in another way with a concern or if we contact

you, we will also process your personal data (e.g. name, address, telephone number as well

as the content of the message). We generally only use this communication data to deal with

your respective concern and to communicate with you.

Communication data is deleted, if it is no longer necessary to exchange information with you

and any statutory archiving periods have elapsed.

Your data is processed on the basis of Art. 6 para. 1 lit. b) GDPR, in so far as this is connected

with starting up or fulfilling a contract with you, e.g. for complaints. Furthermore, personal

contact and communication data is processed on the basis of Art. 6 para. 1 lit. f) GDPR with

reference to our vested interest in the provision of customer service and/or with the goal of

improving our M2M service offer.

(10.2.) For our Service Center we use service providers with which corresponding order processing

contracts have been concluded (also see section 11 of this Data Privacy Statement).

When you call our Service-Center you will be asked if you consent that phone calls are

recorded for quality assurance and training purposes and/or listened to by the employees

entrusted with quality management who could come from one of the companies affiliated with

the STIHL Group of from the call-center itself. Your consent to this is of course voluntary.

Recordings of telephone calls are deleted after 90 days, irrespective of the fact that you can

revoke your consent at any time and without specifying reasons before the expiry of this 90

day period. You can also revoke consent during the telephone call itself (e.g. by informing the

employee accordingly).

The legal basis for processing your personal data in the framework of the quality assurance

and training purposes above is your consent, Art. 6 para. 1 lit. a) GDPR.

(11.) Transfer of data/ commissioned processing

(11.1.) The registration data, machine, device and contract data and/or location and usage data may

be disclosed to providers of technical services and call centers for the purpose of support and

for processing defects.

(11.2.) The file containing your personal data will be maintained on the servers of STIHL or its

commissioned processors and will be accessible by authorized employees, agents and

representatives as necessary for the purposes described in this Privacy Policy. STIHL and its

commissioned processors may be located outside of your country of residence, including the

Netherlands and Ireland. While outside of your country of residence, personal data will be

subject to applicable local laws, which may permit government and national security agencies

to access personal data in certain circumstances.


(11.3.) The registration data, machine, device and contract data and/or location and usage data may

be disclosed to the preferred retailer indicated by the customer for the purpose of support and

for customer service and maintenance information.

(11.4.) The data thus disclosed may be used by our service providers solely to perform these du-ties

specified by us. No other use of the data is permitted. Agreements on commissioned

processing always exist with these service providers.

(11.5.) Subject to the above provisions, your personal data shall not, in any event, be disclosed or

notified to third parties for advertising or marketing purposes or for other purposes without

your having been asked and without your consent. This does not apply only if STIHL is subject

to a statutory obligation or order of a governmental authority to disc-lose the data, in particular

in cases of criminal prosecution or for the purpose of averting danger.

(11.6.) Subject to section 8 of these Data Protection Provisions there shall not, in principle, be any

transfer of the personal data to third countries outside the European Economic Area. If such

transfer to a third country should be necessary as an exception, those measures shall be

implemented under data protection law that are required to guarantee the data protection

level.

(11.7.) The legal basis for this data processing is always the processing on our behalf in the context

of the purpose described and the legal basis indicated of the specific processing transaction.

(12.) Erasure of the data

Your personal data will be erased when you terminate the usage relationship or request

erasure or if the data are no longer required for the purpose for which they were collected

and processed. There shall be no erasure if and to the extent that there are statutory record-

keeping obligations or if the proper winding up of the contract relationship requires continued

storage of the data. In the latter cases the data shall be made unavailable (so-called restriction

of processing). In this case the data are no longer available for the continued or renewed use

of the “STIHL connected” system. Re-registration is required for renewed use. We point out

that, for technical reasons, in the event of an erasure request or termination of the usage

relationship it can take up to five weeks for the data to be erased from all existing back-up

copies. During this period of time the data are, however, unavailable for any use (restriction

of processing).

(13.) Rights of the data subject

As the data subject affected by the data processing you have numerous rights. The details of

these are as follows:

The right of access, i.e. you have the right to obtain information on the data stored

by us concerning you.

The right to rectification and the right to erasure, i.e. you may request at any time

that inaccurate data be corrected and - insofar as the statutory requirements have

been met - that your data be completed or erased. Insofar as the erasure of data is

opposed by statutory record-keeping obligations, the processing of the data shall be

restricted (see below).

The right to restriction of processing, i.e. you may request of STIHL - insofar as

the statutory requirements have been met - that STIHL restrict the processing of your

data.

The right to object to data processing if the legal basis for this is a “legitimate

interest”, i.e. you have the right to object to the data processing by STIHL at any time


insofar as this is founded on the legal basis of a “legitimate interest”. STIHL shall then

discontinue processing the data unless STIHL can evidence - in accordance with the

statutory requirements - that there are compelling legitimate reasons for further

processing the data which override the rights of the customer.

The right to withdraw consent, i.e. insofar as you have consented to the processing

of your data you may withdraw this consent at any time with future effect. The

lawfulness of the processing of your data up to the date of your withdrawal of consent

shall remain unaffected by this.

The right to lodge a complaint with the supervisory authority, i.e. you can lodge

a complaint with the competent supervisory authority if you are of the opinion that the

processing of your data is in breach of applicable law. In this connection you may

apply to the data protection authority responsible at your place of residence or in your

country or to the data protection authority responsible for STIHL.

The right to data portability, i.e. the right to receive the data which have been

provided, in a structured, commonly used and machine-readable format and to have

them transferred to another controller by STIHL.

The right to receive a copy of your personal data which have been processed and

stored by us.

(14.) Amendments and supplements to the Data Protection Provisions

(14.1.) STIHL reserves the right to amend and supplement these Data Protection Provisions for the

“STIHL connected” system insofar as you are objectively not placed in a less favorable

position as a result thereof (e.g. retention of or improvement in or addition to functionalities)

or if the amendment/supplement can be reasonably expected of you whilst taking the interests

of STIHL into consideration.

Interests of STIHL that are worthy of consideration and which can be reasonably expected of

the customer are deemed to be changes in the circumstances on the market in a technical or

calculatory respect, including but not limited to:

adapting the Data Protection Provisions in accordance with statutory requirements

and/or updated/changes in case law,

adapting the Data Protection Provisions in line with technical changes/innovations

relating to the “STIHL connected Services” (e.g. in connection with the operating

systems supported by the “STIHL App”).

(14.2.) STIHL also reserves the right to amend/supplement the Data Protection Provisions in other

respects. The users shall be notified in textual form of such other amendments and

supplements to the Data Protection Provisions at least six weeks before the effective date of

the amendment/supplement.

To this extent the amendments/supplements shall be deemed approved if the user does not

terminate the service operated by means of “STIHL connected” within 6 weeks of receipt of

the notification (calculated from the date of receipt of the notification); termination can be

effectuated using the “STIHL App” or “STIHL connect pro Portal” setting (“DELETE

ACCOUNT”) or by notification (also possible in textual form by e-mail) to ANDREAS STIHL

l'utilisation de ses données à caractère personnel en lien avec l'utilisation du système «

STIHL connected », composé du « STIHL Smart Connector », de la « STIHL App » et du «

En approuvant les présentes dispositions relatives à la protection des données, vous

consentez à ce que STIHL collecte, traite et utilise vos données à caractère personnel dans

le respect de la législation applicable et conformément aux dispositions suivantes.

(5.) Données à caractère personnel

Les données à caractère personnel consistent en l'ensemble des informations au sujet d'une

personne physique identifiable ou identifiée. Elles comportement p.ex. le nom, l'adresse, le

numéro de téléphone, l'adresse de courrier électronique, les photos de profil, les terminaux

mobiles connectés ainsi que les machines ou outils appariés de même que les données de

consommation et autres données que vous mettez à disposition de STIHL à des fins

d'enregistrement et d'utilisation du système « STIHL connected ».

(6.) Fichiers journaux, données d'enregistrement et données fournies de façon volontaire

(6.1.) Fichiers journaux

Lors de chaque accès au « STIHL connect pro Portal », le navigateur web concerné transmet

des données d'utilisation, lesquelles sont enregistrées dans des fichiers de protocole appelés

fichiers journaux de serveur. Les paquets enregistrés contiennent les données suivantes:

date et heure de consultation, adresse de la page consultée, adresse IP, URL d'origine au

départ de laquelle vous avez accédé au « STIHL connect pro Portal », quantités de données

transmises, informations quant au navigateur que vous utilisez. Ces données sont

exclusivement utilisées à des fins de communication technique et supprimées au terme de

l'utilisation, sous réserve d'éventuelles obligations légales de conservation. Les fondements

juridiques sous-jacents au traitement de données consistent en la réalisation de mesures pré-

contractuelles, en l'exécution du contrat existant avec vous et en votre accord.

(6.2.) Données d'enregistrement

L'ensemble des données à caractère personnel fournies par vos soins lors de

l'enregistrement auprès du « STIHL Smart Connector », de la « STIHL App » et du « STIHL

connect pro Portal » [prénom, nom de famille, adresse (rue, numéro, code postal, localité),

adresse de courrier électronique ; numéro de téléphone, mot de passe ; nom d'utilisateur ;

adresse web ; photo de profil ; date de naissance ; langue de communication] sont collectées,

traitées et utilisées de façon automatisée par STIHL conformément aux dispositions relatives


à la protection des données applicables au contrat, à des fins de justification,

d'aménagement, de réalisation, de modification et/ou de cessation de la relation d'utilisation.

Hormis le numéro de téléphone, l'adresse web, la photo de profil, la date de naissance et la

langue de communication, la mention de l'ensemble des données est impérative afin de vous

enregistrer et d'accéder ce faisant au système « STIHL connected ». Les données mises à

disposition de façon volontaire ne sont pas nécessaires à l'enregistrement et l'utilisateur peut

également les enregistrer ou les supprimer ultérieurement par ses propres soins dans le

compte d'utilisateur.

Les fondements juridiques sous-jacents au traitement de données consistent en la réalisation

de mesures pré-contractuelles, en l'exécution du contrat existant avec vous et en votre

accord.

(6.3.) Données d'appareil/de machine/d'outil et contractuelles

Parallèlement à ces données, les données spécifiques à votre terminal mobile

(smartphone/équipement intelligent) comme le type d'appareil, le système d'exploitation et le

niveau de batterie, celles relatives à la machine appariée ou à l'outil comme le n° d'appareil/de

série/d'article et celles concernant le « STIHL Smart Connector » utilisé, comme le niveau de

batterie, l'adresse MAC, la variante matériel/logiciel sont collectées, traitées et utilisées de

façon automatisée conformément aux dispositions relatives à la protection des données

applicables au contrat, pour la justification, l'aménagement, la réalisation, la modification

et/ou la cessation de la relation d'utilisation.

Les données contractuelles spécifiques [date et contenu de la conclusion du contrat,

déclarations de rétractation éventuelles, oppositions, demandes de renseignement,

suppression, transmission des données et restriction en lien avec le traitement des données,

la date et le contenu des avenants au contrat, les autres déclarations des parties, p.ex. la

résiliation, les notifications de défauts, etc.] sont collectées, traitées et utilisées de façon

identique et à la même fin.

Le transfert de votre relation d'utilisation des « STIHL connected Services » de façon globale

et/ou partielle à des tiers est exclu. Dans l'hypothèse où l'utilisateur vend, transfère la

propriété ou transmet durablement le « STIHL Smart Connector » ou l'appareil apparié avec

celui-ci à un tiers, l'utilisation du « STIHL Smart Connector » au moyen des « STIHL

connected Services » par le tiers nécessite

la désinscription des « STIHL connected Services » en supprimant votre compte via

la fonction « SUPPRIMER LE COMPTE »; et

la conclusion d'une convention d'utilisation à part entière entre le tiers et STIHL

concernant les « STIHL connected Services ».

En procédant de la sorte, le tiers n'a pas connaissance des données à caractère personnel générées par vos soins. L'unique élément visible une seule fois lors de sa première mise en service du « STIHL Smart Connector » resp. de l'appareil STIHL apparié avec celui-ci concerne la performance globale du « STIHL Smart Connector ». Le tiers génère ensuite uniquement ses propres données lors de l'utilisation. Les fondements juridiques sous-jacents au traitement des données consistent en l'exécution du contrat existant avec vous et en votre accord.

(6.4.) Utilisateurs supplémentaires (équipe)

Si vous le souhaitez, vous pouvez enregistrer des utilisateurs supplémentaires (ci-après

désignés « équipe »). Les données à caractère personnel des membres de l'équipe (nombre,

données d'enregistrement, machines/outils et « Connecteurs STIHL Smart » appariés, y

compris l'ensemble des données préalablement décrites) sont collectées, traitées et utilisées


de façon identique, à des fins identiques et sur la base de fondements juridiques identiques

à ceux exposés sous les points 6.1. à 6.3. L'utilisateur supplémentaire reçoit une invitation

de votre part, doit s'enregistrer par ses propres soins et approuver le traitement des données.

En votre qualité d'utilisateur principal, vous pouvez consulter les données générées par

l'utilisateur supplémentaire en exploitant l'appareil. En votre qualité d'utilisateur principal, il

vous incombe exclusivement de garantir que l'ensemble des prescriptions y relatives en

matière de protection des données soient respectées et que vous disposiez, envers

l'utilisateur principal, de l'autorisation nécessaire.

du contrat avec vous et en votre accord.

(6.5.) Données de localisation et d'utilisation

L'utilisation conforme au contrat du système « STIHL connected » implique la transmission

de données de localisation et d'utilisation à STIHL, en particulier

les données de localisation du terminal mobile de l'utilisateur

(smartphone/équipement intelligent) en présence d'une portée Bluetooth au « STIHL

Smart Connector » et à la machine appariée/à l'outil apparié

les données de localisation de la machine/de l'outil apparié(e), entre autres issues de

Google Maps

le comportement d'utilisation de la machine/de l'outil apparié(e) avec le « STIHL Smart

Connector » (p.ex. la durée de fonctionnement, les données de consommation, les

heures d'activation et de désactivation, l'instant d'appariement)

les données relatives au parc de machines/d'outils à gérer (illustration(s) et nombre

de machines/d'outils)

l'existence/l'inexistence d'une connexion Bluetooth

les traces de maintenance concernant les machines, l'historique de maintenance

les utilisations de machines (p.ex. les utilisations spéciales)

STIHL collecte, traite et utilise également de façon automatisée les données de localisation, d'utilisation et d'injonction générées dans ce cadre, tout comme les données/indications supplémentaires librement fournies par vos soins dans le cadre du paramétrage de votre profil après enregistrement (p.ex. l'enregistrement d'un numéro de téléphone/ de portable et d'une adresse de courrier électronique pour la réception de messages d'état/d'alerte et en cas de rappel), conformément au point (6.) des dispositions relatives à la protection des données, à des fins de justification, d'aménagement, de réalisation, de modification, d'exécution et/ou de cessation de la relation d'utilisation pour le système « STIHL connected » et l'utilisation des fonctionnalités de la « STIHL App » ainsi que du « STIHL connect pro Portal ».

(7.) Données concernant le revendeur

Si vous le souhaitez, vous pouvez mentionner les données de votre revendeur préféré auprès

duquel vous avez acheté l'outil/la machine apparié(e) et/ou responsable de la maintenance.

En mentionnant votre revendeur préféré, vous fournissez votre accord afin que nous rendions

vos données de client, d'appareil et d'utilisation accessibles à ce revendeur à des fins

d'assistance, de maintenance et d'entretien mais également afin que nous traitions et

utilisions ces données auxdites fins ; cet accord s'étend également à l'utilisation de ces

données pour la transmission d'informations par nos soins ou par ceux dudit revendeur

spécialisé, en particulier eu égard au besoin de maintenance et d'entretien (p.ex. les

intervalles de maintenance, etc.).

(8.) Outils d'analyse web/de localisation/cartographiques


Le « STIHL connect pro Portal » utilise Google Analytics, un service d'analyse web de Google

Inc. (« Google »). Google Analytics utilise des « cookies », à savoir des fichiers texte

enregistrés sur votre ordinateur et permettant une analyse de l’utilisation que vous faites du

site web. Les informations générées par les cookies et concernant l’utilisation que vous faites

de ce site web sont en principe transmises à un serveur de Google aux USA et y sont

enregistrées.

En cas d'activation de l'anonymisation de l'adresse IP sur ce site web, Google réduit toutefois

préalablement votre adresse IP dans les États membres de l'Union européenne ou dans

d'autres États signataires de l'accord sur l'Espace économique européen. L'adresse IP

intégrale est uniquement transmise à un serveur de Google aux USA et y réduite en présence

de cas exceptionnels. Nous attirons votre attention sur le fait que Google Analytics a été

étoffé du code « gat._anonymizeIp(); » sur le « STIHL connect pro Portal », afin de garantir

une saisie anonymisée des adresses IP (masquage IP). Google saisit dès lors votre adresse

IP à notre instigation uniquement sous forme réduite, ce qui assure une anonymisation et ne

permet pas de remonter à votre identité. En cas d'activation de l'anonymisation de l'adresse

IP sur nos sites web, Google réduit préalablement votre adresse IP dans les États membres

de l'Union européenne ou dans d'autres États signataires de l'accord sur l'Espace

économique européen. L'adresse IP intégrale est uniquement transmise à un serveur de

Google aux USA et y réduite en présence de cas exceptionnels.

Google utilise ces informations sur ordre de l'exploitant du portail web, afin d’évaluer

l’utilisation que vous faites du portail web, afin d’élaborer des rapports sur les activités

constatées sur le site web mais également afin de fournir à l'exploitant du portail web d’autres

prestations liées à l’utilisation du site web et à l’utilisation d’Internet.

L'adresse IP transmise par votre navigateur dans le cadre de Google Analytics n'est pas

fusionnée à d'autres données dont Google dispose. Vous pouvez empêcher l’enregistrement

Le Google Tag Manager est un service de Google Inc., 1600 Amphitheatre Parkway,

Mountain View, CA 94043, USA (« Google ») permettant de créer, d'actualiser et de gérer

des balises.

Les balises sont de petits éléments de codage présents sur le « STIHL connect pro Portal »

et servant, entre autres, à mesurer la fréquentation et le comportement des visiteurs sur le «

STIHL connect pro Portal » ainsi qu'à percevoir l'effet de la publicité en ligne et des réseaux

sociaux.

Lorsque vous visitez le « STIHL connect pro Portal », la configuration de balises actuelle est

envoyée à votre navigateur. Elle contient des instructions quant aux balises à déclencher.

L'outil en tant que tel ne saisit aucune donnée à caractère personnel. L'outil veille cependant

au déclenchement d'autres balises qui saisissent le cas échéant des données à caractère
