:>rand secQndly the Mining Leases (MQdificatiQn Qf Terms) Rules 1956 (hereinafter called the 'Rules') defines the term 'existing mining lease' as thQse Mining Leases' which were ,granted befQre the 25th day Qf OctQber, 1949, hence the leases which were granted after the 25th OctQber, 1949 cannQt be mQdified.

:J,: have given my anxiQus and careful cQnsideratiQn to. the abQve PQints, and, in my view, these cQntentiQns have gQt no. fQrce.

The first cQntentiQn was that the Mines and Minerals (RegulatiQn and DevelQpment) Act, 1957 (hereinafter called the ~Act') and the Rules do. nQt apply .tQ these cases as these persQns are· CQncessiQnaires and nQt ~lessees. In my view this cQntentiQn has gQthQfQrce, as we have to. IQo.k to. the pith and substance Qf the case and nQt to. the fQrm 0.1' wQrds which have been _used under the PQrtuguese Law. The Act' defines the ;Mining Leases and Mining Qpera~iQnS 'as fQllQws:

SectiQn 3 (c): «mining 'lease» means a 'lease' granted fQr the purpo.se Qf undertaking' mining QperatiQns, and includes a sublease granted' fQr such purpQse.

SectiQn 3 (d): «mining QperatiQns» means any operatiQns undertaken fQr the purpose Qf winning any mineral.

These definitiQnl:! are very wide and . include any deed granted fQr mining QperatiQns and the 'mere fact that under the PQrtuguese Law they were called mining cQllcessiQns instead Qf Mining LeaseswQuld nQt make any diffetence.

The concessiQnaires" ~annQt deny that '. they are, operating the 'Mines uIiderc t!le deeds called CQncessions. It will be significant to. nQte that under the PQrtug~ese Co.IQnial Laws, Mining CQncessiQn was defined in almQst similar manner and gav~ the PQwer to'. the cQIrcessiQnaires to. Qperate the mines.

The relevant definitiQns read asfQllows:-

Section I (u)~«MiningCQncessiQn» is that which is granted . .tQ the manifestorand permitshitn to. explQre a mining prQ­perty and to enjoy thereQnall mining rights. It is· unlimited in duratiQn as IQng as the cQncessiQnaire cQmplies with the conditiQnswIfieh the law ahd the'title Qf concessiQn lmpQsed Qn h~m. '

Article {) is very significant to. nQte because it uses the wQrd 'CQncessiQnaires o.r Lessees' Qf mines. It shQWS that even under the PQrtuguese' Law concessiQnaires and Lessees were synQnymQus.

Article 14 says that the cQncessio.n Qf ap.Qre dQes nQt imply Po.ssessiQn Qf the surface Qf the gro.und iIi which it is fQtind,' but invo.lves fQr the, CQncessiQnaires and the pro.-prietQr Qf the gro.und certain rfghts and reciprQcal ,QbligatiQns in acco.rdance with the terms Qf law.

17.TH APRIL, '1969 (OHAITRA 27, 1891)

It'/is true that under. the Rules 'existing Mi'ning Leases' haver been def·~ned ·as those leases which were ex~cuted before the 25th October, 1949 but we have to look to the provision

·of Section 16 of the Act which says that all Mining Leases 'granted In the territory. of Goa, Daman .andDiu before the ~Oinmencement of the Act therein shall, as soon as may be 'll,fter the commencement of this Act, be brought into confor-l;Uity with the provisions of this Act and the Rules made Under Sections 13 and 18. The Act ~'as applied to Goa from f,.10-63 hence all the leases or Concessions which were granted before 1-10~1963 are to be brought into conformity with the provisions of the Act and the Rules. It would be significant to note that under Section 16 of the Act all the Mining LeaseS executed before 1st . October, 1963 are to be modified to bring them in conformity with' the Act and Rules and there is no rider that only those Leases which were executed before the ~5th October, 1949 are to be m·odified.

Section 3 of the Rules provides for the appointment of .8." Controller of MIning LeaseS and that appointment has not been challenged.pnce a controller of Mining Leases has been . appOinted he derives his jurisdiction to modify the lease to bring theiU in conformity with the provisions ·of the Act and Rules. The main modifications which have been proposed are regarding the period of the lease, the royalty to be paid and the maximum area permissible to one lessee. All these provisions are found in the Act itself. Section 8 provides for the period for which a lease can be granted. Section 9 fixes the royalty to be paid and Section 6 fixes the maximum area for which a mining lease can be .granted.

The Ru:as only detail the procedure which is to be fol­lowed in giving notice etc. and can never over-ride the :specific provisions of the Act. Indeed if there is any con­tradiction between the Pl;ovisions of the Act and those of the Rules, then the provisions of the 'Act shall prevail. It is thus clear that once a Controller is apPOinted, he shall modify the Leases . in conformity with the Act and Rules, .and the mere fact that· the «existing Mining Leases» have been defined to be leases granted prior to 25th October, i949 d~es not bar the Controller to modify any ~ease granted up-to 30th September, 1963 to bring them in conformity with the Act. The position would have been different if the «Existing ... Mining Leases» would have been defined as leases granted before ,the 25th October, 1949 in the Act itself.

For the aforesaid reasons,I hold that all the leases or Concessions granted before the 1st October, 1963 would be modified in accordance with the modifications proposed in the Notices and the above mentioned Leases shall stand modified as follows:-

1) The period of the leases shall be 20 years commen­cing from 15th January, 1966 i~ all the cases.

2) . The dead rent payable for' Iron ore .. alone shall be at the rate of Rs. 12-50 Ps. p.er hectare per annum and for other miri.erj:tls or Iron' ore coupled with any other mineral' shall be' at the rate of Rs. 25/­per hectare per annum, from 15th Janu~ry,1966.

3) The royalty shall be payable in respect of any mineral ren:;wved by tlie Lessees frOm the leased area after 15-1-66 at the rate for the . time being spec~i~~L!IJ._ .. thesecond Schedule of the Mines and mineral removed by the Lessees from the leased in respect of that mineral.

4) The lessee shall also pay, for the surface ar,ea used by him for the purpose of mining .operations, sur­face rent and water rate at such rate, not exceeding the land revenue, water and ceases assessable on the land, as ma,y be specified by the State Govern­ment.

5) The following clause shall be deemed to be inserted in the lease deed and shall form part thereof; «except for the modifications made by this order, the lease shall be subject to the rules made or deemed to have been made under Sections 13 and 18 of the
