1. Overview

The City of Casey is seeking a suitably qualified artist to develop a site-specific artwork for Merinda Park Learning and Community Centre 141 – 147 Endeavour Drive, Cranbourne North. This is an exciting project for the City of Casey, valued at $10,000 ($10K).

The successful artist will be awarded the opportunity to design, fabricate and install a permanent artwork at the designated location within the budget and timeframe specified in this brief.

The artwork will respond to the City of Casey’s Public Art Policy, encouraging original Public Art that enhances public space and community facilities in Casey, reflecting aspects of the area’s unique heritage, attributes of local neighbourhoods and aspirations of its communities through a diversity of contemporary art forms.

2. Background

City of Casey’s neighbourhood houses and community learning centres play a vital role in building a vibrant community. They provide universal services that are available to all community members and reflect the needs of the local community. Service activities also provide opportunities for members of the community to contribute time and skills to support or provide activities within the facility.

Merinda Park Learning and Community Centre provides such opportunities to the people in Cranbourne North and surrounding area. Each week more than 750 people visit Merinda Park Learning and Community Centre. People of all abilities, backgrounds and ages attend the facility, coming together to meet new people, develop new skills, transition to study or work and engage with their community.

3. Project Outline

Before the renovation to the facility Merinda Park Learning and Community Centre had a small ivy mural that adorned the doorway at the entrance to the facility, (please see Appendix B). This artwork was linked to a community award that the centre presents annually, the current Committee of the centre have highlighted that consideration of this

imagery in any future concept proposals would be highly desirable.

3.2 Site Allocated for the ArtworkThe site for the public art intervention is within the Merinda Park Learning and Community Centre, 141-147 Endeavour Dr, Cranbourne North. The artwork is intended to extend the wall of a waiting room for individuals seeking counselling services.

The physical structure of the artwork must extend out from the fixed wall by 890 MM and be 2210 MM in height.

3.3 Project Value

The Merinda Park Learning and Community Centre Public Art Project has a total budget of $10,000 (excluding GST) allocated to the successful artist. This budget is to cover all fees, permits, design, fabrication and costs associated with the development and installation of the works.

3.4 Commencement and Completion of the Project

The project commences immediately upon the arrival at a formal agreement. Installation of the artwork must be completed by Wednesday 28 June.

3.5 Intellectual Property and TitleFollowing the execution of an agreement between the City of Casey and the artist, the City of Casey will be granted royalty-free license to reproduce images or replicas of the artwork and retain any materials and drafts created as part of producing the work (including the developed design) for any purpose. The artist must not reproduce the same artwork for any other commissioner or organisation. The Moral Right of the artwork will remain with the artist.

3.6 Project Management

The artist’s primary contact throughout the project will be Council’s Arts Development Officer. The Superintendent for this Quotation Contract will be the Manager Community Strengthening.

4. Selection Process

4.1 Expression of InterestThis Expression of Interest represents the first stage of the selection process. To register your interest address the Submission Requirements outlined below. Please note there is no concept proposal required at this time. Please forward any questions or queries at this stage to the Arts Development Officer on 9705 5200.

4.2 Short listing of ArtistsFollowing the close of the Expressions of Interest period, a short-listing process will be undertaken from which a limited number of artists will be invited to develop a concept proposal.

The concept proposal should outline a detailed budget, methodology, timelines, materials, dimensions and maintenance considerations. It should include preliminary concept designs / drawings and/or a maquette.

A fee of $500 will be paid to the unsuccessful applicants for their concept proposal per artist/ artist collaborative.

All short-listed artists will be scheduled to present their concept proposal to the selection panel at the second stage of the selection process.

In general terms the selection criteria will include:

» Demonstrated understanding of the project and the desired outcomes.

» Demonstrated ability to design, fabricate and install a high quality Public Art piece.

» The innovative nature of the artist’s previous works.

» Demonstrated capacity to complete the work within the project timelines and project budget.

Applicants may be contacted during the assessment period and be requested for further information which should be provided within twenty four hours where possible. The Council reserves the right to accept or reject any submission.

4.3 Artist CommissionThe commission for the project will be awarded to one artist or an artist collaborative. A letter of acceptance together with this Expression of Interest Brief, the concept proposal and the quotation submitted by the artist will form the agreement between the successful artist and the City of Casey for the design, fabrication and installation of the artwork.

5. Scope of work for the successful artist

The successful artist will design, fabricate and install a permanent artwork within the budget and timeframe specified in this brief.

This will entail the following:

5.1 Design

The successful artist will be required to present a concept design, then upon approval refine their concept proposal and present a final design for Council sign-off. This will include supplying detailed specifications for materials, installation and maintenance.

A Design Risk Analysis will be undertaken by Council officers to try to identify issues and advise the artist at an early stage in the project. The artist will be required to liaise with Council officers in relation to technical specifications to ensure the successful integration of the artwork.

5.2 Materials and Storage

Installation should not commence until the final design has been approved. The artist is responsible for the fabrication, storage and transportation of all materials.

5.3 Installation

To ensure the safety of visitors to the centre the installation of the artwork will need to be timed appropriately with the successful artist; this may include some afterhours work.

The artist is responsible for costs associated with the installation and meeting all safety requirements. An approved schedule of work and site specific safety plan will be required prior to commencement.

5.4 Maintenance Schedule

The artist will be responsible for protecting the finished surface of the work against wear and graffiti and will be required to submit a detailed maintenance schedule for the artwork outlining materials, lifespan, care and maintenance of the work.

This must be provided before final payment will be made.

5.5 Handover to Council

Handover to Council will be complete when a final inspection has occurred and all outstanding documents have been received, including the maintenance schedule, and the final invoice from the artist has been paid.

Responsibility for the work will remain with the artist until the time of handover to Council, at which time the artist will guarantee the work for 12 months for any defects and for reasonable repairs.

6. Permits and statutory requirements

The artist will be responsible for obtaining any statutory approvals and permits in relation to the design, construction and installation of the artwork and meeting Australian Safety Standards.

7. Conditions for Quotations

This quotation shall be Lump Sum as stated, on a firm price basis unless otherwise specified and subject to these Conditions and the Conditions of Contract (Quotations).

No late quotation will be considered.

The quotation must be addressed including quotation number and delivered to Council as specified.

Quotations shall allow for payroll tax and other loadings on all wages and for any fees royalties, premiums, costs, charges and the like which will be due or payable to any person or authority.

The contract price or rates are inclusive of all the Contractor's expenses, insurance, duties, imposts, and taxes which shall be paid by the Contractor but are exclusive of any GST.

The Contractor shall provide in their quotation for all matters required by or for the works.

Quotations shall be assessed using the criteria in the specification.

Council reserves the right to reject any or all quotations. The lowest quotation will not necessarily be accepted.

The accepted quotation, letter of acceptance, conditions, plans and specifications shall together constitute a binding contract between the City of Casey and the successful Tenderer.

8. Conditions of Contract (Quotations)1. The Contractor shall at his own risk complete the whole of the works in according with

these Conditions, the plans and specifications and shall observe and comply with the provisions of all relevant acts, ordinances, regulations, bylaws, orders and rules and all requirements of any authority applicable to the works of the Contract.

2. Any notice in writing by the Superintendent will, if posted to the Contractor at the address stated in his quotation, be deemed to have been duly received by the Contractor at the time at which in the ordinary course of post it would have reached that address.

3. The Contractor shall not assign, charge or encumber the Contract or any part thereof or any benefit or moneys or interest thereunder. No part of the works shall be sub-contracted nor any sub-contractor engaged without the approval of the Superintendent.

4. The Contractor shall indemnify the City of Casey at all times against any claim for compensation or any action, claim, demand or expense arising from or incurred by reason of the existence of any patent, design, trademark or copyright or other protected right arising from the performance of the Contract.

5. The Contractor shall provide and maintain all site fencing, signs, and all equipment, devices and other things as required by the contract or lawfully required by any public or other authority or necessary for the protection of the works or the property of others or for the safety and convenience of the public, their workmen and others and shall remove the same from the site when no longer required.

6. The Contractor shall be held solely liable for loss or damage to the works from any cause (except loss or damage caused by the negligence, omission or default of the City of Casey, its servants or agents) until the Superintendent has certified that the Contract has been satisfactorily completed.

7. The Contractor shall indemnify and keep indemnified the City of Casey against all liability in respect of any actions, suits, proceedings, claims, demands, costs and expenses whatsoever which may be taken, instituted or made against the City of Casey for personal injury to or death of any person or for injury or damage to property arising from the carrying out of the works. Insurance policies to cover the Contractor's liability as required by this clause shall be taken out and maintained by the Contractor for the duration of the Contract for amounts not less than those specified.

8. The Contractor shall ensure and show written evidence that all employees and sub-contractor's employees are insured under the State Government WorkCover Scheme.

9. The Council will not be liable for any loss of earnings, medical or legal expenses or any other loss or damage resulting from injuries sustained to employees of the Contractor or any sub-contractor.

10. If the Contractor fails to pay any such premiums the Council may withhold any payment and pay these premiums.

11. The Contractor shall notify the City of Casey of any accident, injury or property damage caused by the Contractor's employees or sub-contractors.

12. The Contractor shall have the right to possession of such of the site as shall be reasonably necessary to enable him to execute the works but shall not without good cause impede the execution of works by others on or adjacent to the site.

13. All materials and workmanship shall be as specified or if not specified shall be in accordance with the relevant standard of the Standards Association of Australia or such other standards as are agreed to by the Superintendent. If the Superintendent determines that any part of the works including materials is not satisfactory, he may direct removal or correction at the Contractor's expense or alternatively he may accept such work at the value he may determine. If the Contractor fails to remove or correct work in accordance

with a written instruction, the Superintendent may arrange for such removal or correction at the Contractor's expense.

14. The Contractor shall have the right to attend all examinations, inspections and measurements of the works but the Superintendent's determination as to quality and quantity shall be final.

15. Unless otherwise provided or approved by the Superintendent, the Contractor shall carry out the whole of the works between 7.30 am. and 6.00 pm, Monday to Friday excluding gazetted public holidays. No work shall be carried out on Sundays.

16. The Contractor shall make good promptly at his own cost all fencing, roads, footpaths, landscaping and other areas which may be disturbed by cartage or other operations; they shall leave the site of the works and adjacent areas in good repair and from time to time remove from the site all rubbish, debris and waste resulting from their activities.

17. Unless otherwise provided or agreed to and subject to these Conditions, the Contractor will be paid monthly the value of the work as determined by the Superintendent. Final payment will not be made until the Superintendent has certified that the Contractor's obligations have been fulfilled.

18. Where the Council is required to pay the Contractor any amount under the Contract on account of GST, the amount representing GST will only be payable by the Council where the Contractor supplies to the Council a tax invoice for GST purposes in a form approved by the Council.

19. If required by the Superintendent before final payment, the Contractor shall furnish a declaration that all wages due and owing to workmen employed by the Contractor in association with the works have been paid.

20. If the Contractor fails to commence or to complete the works within the period specified or fails to carry out the works at a rate of progress satisfactory to the Superintendent or intimates that they are unwilling or unable to complete the works or neglect or omits to carry out promptly any written instruction, the Superintendent may by written notice inform the Contractor that they are in default and unless he complies with the Conditions within the time specified in the notice, the Superintendent will either cancel the Contract or take the works wholly or partly out of the Contractor's control and complete the works by any means he so decides.

21. Should the Superintendent take action under Clause 21 any increased costs of completing the works and any remaining costs charges and expenses incurred or sustained by the City of Casey in completing the works may be deducted from moneys held by Council and the difference forwarded to the Contractor or deemed a debt due to the City of Casey by the Contractor whichever is the case.

22. The Contractor shall comply with the requirements of the Occupational Health and Safety Act 1985 and any subsequent amendments.

23. The Contractor will prepare information indicating the colour, materials, texture and other pertinent information in connection with proposed artwork.

24. The Contractor will submit colour samples for items having colour unless otherwise directed or approved by Superintendent.

25. The Contractor will ensure that no patent is infringed and that unless otherwise specified, amounts payable and conditions imposed in respect of the manufacture, use or exercise of patented invention are paid and complied with and shall indemnify the Principal against claims, damages, costs, charges and expenses in any way whatsoever arising out of the manufacture, use or exercise by the Contractor of patented invention.
