Sir, This has reference to your application No. Nil dated 04.10.2014 and subsequent letter dated 31.12.2014 seeking prior Environmental Clearance on the above-mentioned project. 2. The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of Environmental Clearance for Redevelopment of 'Amrutwadi' project at C.S. No. 585, 588 & 589 of Girgaum Division, Amrutwadi, V.P. Road, Khotachiwadi, Mumbai, Maharashtra by MI s. Rohan Developers Pvt. Ltd. The proposal was considered in the 141 st EAC meeting held on 26 th - 28 th November, 2014. The proponent has informed that: 1. The proposal involves redevelopment of 'Amrutwadi' project at C.S. No. 585, 588 & 589 of Girgaum Division, Amrutwadi, V.P. Road, Khotachiwadi, Mumbai, Maharashtra. 11. Proposal is under modified DC regulation 33(7) for redevelopment of 'A' category cessed structures. Municipal Commissioner has granted approval to the project. 111. The project site is occupied by 9 old residential buildings with shops, which will be demolished & site will be developed into residential development with shops. IV. The project will rehabilitate 336 number of residential tenants and 25 non residential in a new building with hygienic conditions of modern living. v. The total plot area of proposed site is 5272.61 sqm, total built up area as per FSI is 25,183.96 sqm. and total construction built up area is 40,272.99 sqm. This has reference to your application No. Nil dated 04.10.2014 andsubsequent letter dated 31.12.2014 seeking prior Environmental Clearance onthe above-mentioned project.

2. The Ministry of Environment, Forests & Climate Change has consideredthe application. It is noted that the proposal is for grant of EnvironmentalClearance for Redevelopment of 'Amrutwadi' project at C.S. No. 585, 588 &589 of Girgaum Division, Amrutwadi, V.P. Road, Khotachiwadi, Mumbai,Maharashtra by MI s. Rohan Developers Pvt. Ltd. The proposal wasconsidered in the 141st EAC meeting held on 26th - 28th November, 2014. Theproponent has informed that:

1. The proposal involves redevelopment of 'Amrutwadi' project at C.S. No.585, 588 & 589 of Girgaum Division, Amrutwadi, V.P. Road, Khotachiwadi,Mumbai, Maharashtra.

11. Proposal is under modified DC regulation 33(7) for redevelopment of 'A'category cessed structures. Municipal Commissioner has granted approvalto the project.

111. The project site is occupied by 9 old residential buildings with shops,which will be demolished & site will be developed into residentialdevelopment with shops.

IV. The project will rehabilitate 336 number of residential tenants and 25 nonresidential in a new building with hygienic conditions of modern living.

v. Vll. Total water requirement during construction phase is 296 KLD, treatedsewage available for recycling is 229 KLDand after recycled treated sewage102 KLDwater will be used for gardening (3 KLD)and flushing (99 KLD),hence net water requirement is 194 KLDwhich will be met through MCGM.Total water requirement during operational phase is 293 KLD, treatedsewage available for recycling is 229 KLDand after recycled treated sewage102 KLDwater will be used for gardening (3 KLD)and flushing (99 KLD),hence net water requirement is 194 KLDwhich will be met through MCGM.Excess treatment sewage i.e. 127 KLD during operational phase and 130KLDduring construction phase will be disposed to existing sewer line. V111. The total quantities of solid waste that will be generated from projectexpected at 971 kgj day. Out of which, Non biodegradable is 295 kgj dayand biodegradable garbage is 676 kgj day. Segeregation of nonbiodegradable and biodegradable garbage on site. Total STP sludge is 38kgjday.

IX. The total power demand is estimated to be 550 KW for redevelopment and662 KWfor sale building which will be sourced by local authority.

x. 2 DG sets of 380 kVA and 500 kVA capacity for power back up areproposed.

Xl. 2 nos. of rainwater harvesting tanks of capacity 72 KLD & 48 KLD forharvesting after filtration.

Xll. Parking facility for 238 nos. proposed to be provided against therequirement of 225 numbers (according to local norms).

X111. Energy conservation measures with 24 % of power saving are proposed.XIV. Wildlife issues: There are no National Parks, Wildlife Sanctuary, Biosphere

Reserves found in the 10 km buffer zone.xv. Forest land: No forest land involved in the project.

XVI. There is no court cases/violation pending with the project proponent.XVll. The Project Proponent vide letter no. Nil dated 31.12.2014 has given

undertaking that he is in possession of all necessary and valid buildingand town planning permission for the entire project.

3. The proposal was considered by the Expert Appraisal Committee (EAC)andrecommended in its 141st EAC meeting held on 26th - 28th November, 2014 forgranting Environmental Clearance. The Ministry of Environment, Forests &Climate Change hereby accords Environmental Clearance for the above-mentioned Redevelopment of 'Amrutwadi' project at C.S. No. 585, 588 & 589of Girgaum Division, Amrutwadi, V.P. Road, Khotachiwadi, Mumbai,Maharashtra by M/s. Rohan Developers Pvt. Ltd. under the provisions of theEnvironment Impact Assessment Notification, 2006 and amendments thereto andCirculars issued thereon and subject to the compliance of the following specificconditions, in addition to the general conditions mentioned below:

PARTA - SPECIFICCONDITIONS

I. Construction Phase

(i) The Project Proponent shall obtainpermission from all relevant agenciesauthority before com~encement of work.

(ii) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air (Prevention and Control of Pollution) Act,1981 and Water (Prevention and Control of Pollution) Act, 1974.

(iii) The total plot area of proposed site is 5272.61 sqm, total built up areaas per FSI shall be 25,183.96 sqm. and total construction built uparea shall be 40,272.99 sqm.

(iv) The project will comprise of three building, two for rehabilitation andone for sale. Redevelopment Building No. 1 with 2 Wings A & B:Ground (Part Stilt) + 22nd upper floors, Height - 69.84 m. BuildingNo.2: Ground floor structure, Total flats: 336 nos and Shops: 25 nos.Sale Building with Wing C & D: Basement + Ground (Part Stilt) + 1stto 4th Parking floor + 5th to 20th upper floors. The total height shallbe 69.80 mt. Total 92 flats shall be developed.

(v) Total water requirement during construction phase is 296 KLD,treated sewage available for recycling is 229 KLD and after recycledtreated sewage 102 KLD water shall be used for gardening (3 KLD)and flushing (99 KLD), hence net water requirement is 194 KLDwhich shall be met through MCGM.

(vi) Total water requirement during operational phase is 293 KLD, treatedsewage available for recycling is 229 KLD and after recycled treatedsewage 102 KLD water shall be used for gardening (3 KLD) andflushing (99 KLD), hence net water requirement is 194 KLD whichshall be met through MCGM. Excess treatment sewage i.e. 127 KLDduring operational phase and 130 KLD during construction phaseshall be disposed to existing sewer line. STP of capacity 280 KLDshall be provided.

(vii) The total quantities of solid waste that will be generated from projectis 971 kg/day. Out of which, Non biodegradable shall be 295 kg/ dayand biodegradable garbage shall be 676 kg/ day. Segeregation of nonbiodegradable and biodegradable garbage on site. Total STP sludgeshall be 38 kg/ day.

(viii) The total power demand is 550 KWfor redevelopment and 662 KWforsale building which shall be sourced by local authority.

(ix) Two DG sets of 380 kVA and 500 kVA capacity for power back upshall be provided. D.G sets shall be at least 6 m away from theboundary.

(x) Two nos. of rainwater harvesting tanks of capacity 72 KLD& 48 KLDfor harvesting after filtration shall be provided.

(xi) Parking facility for 238 nos. shall be provided against the requirementof 225 numbers (according to local norms).

(xii) The Project Proponent shall comply with the conditions ofNOC/ Clearance obtained from fire department.

(xiii) All the construction shall be in accordance with the local buildingbyelaws. Project Proponent shall obtain all necessary clearances.

(xiv) The Project Proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures with itsallottees, in perpetuity.

(xv) Suitable toilet fixtures for water conservation shall be provided.

(xvi) Proponent shall obtain permission for ground water withdrawal fromState Ground Water Authority, if applicable.

(xvii) The rainwater harvesting plan should be incorporated by the CGWA.

(xviii)Provision shall be made for the housing of construction labour withinthe site with all necessary infrastructure and facilities such as fuel forcooking, mobile toilets, mobile STP, safe drinking water, medicalhealth care, creche etc. The housing may be in the form of temporarystructures to be removed after the completion of the project.

(xix) A First Aid Room will be provided in the project both duringconstruction and operation of the project.

(xx) All the topsoil excavated during construction activities should bestored for use in horticulture/landscape development within theproject site.

(xxi) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposedtaking the necessary precautions for general safety and healthaspects of people, only in approved sites with the approval ofcompetent authority.

(xxii) Soil and ground water samples will be tested to ascertain that there isno threat to ground water quality by leaching of heavy metals andother toxic contaminants.

(xxiii)Construction spoils, including bituminous material and otherhazardous materials, must not be allowed to contaminatewatercourses and the dump sites for such material must be securedso that they should not leach into the ground water.

(xxiv)Any hazardous waste generated during construction phase, should bedisposed off as per applicable rules and norms with necessaryapprovals of the State Pollution Control Board.

(xxv) The diesel generator sets to be used during construction phaseshould be low sulphur diesel type and should conform toEnvironment (Protection) Rules prescribed for air and noise emissionstandards.

(xxvi)The diesel required for operating DG sets shall be stored inunderground tanks and clearance from Chief Controller of Explosivesshall be taken, as applicable.

(xxvii)Vehicles hired for bringing construction material to the site should bein good condition and should have a pollution check certificate andshould conform to applicable air and noise emission standards andshould be operated ~y during non-peak hours.

(xxviii)Ambient noise levels should conform to residential standards bothduring day and night as per Noise Pollution (Control and Regulation)Rules, 2000. Incremental pollution loads on the ambient air andnoise quality should be closely monitored during construction phase.Adequate measures should be made to reduce ambient air and noiselevel during construction phase, so as to conform to the stipulatedstandards by CPCB/ SPCB.

(xxix)Fly ash should be used as building material in the construction asper the provisions of Fly Ash Notification of September, 1999 andamended as on 27th August, 2003.

(xxx) Ready mixed concrete must be used in building construction.

(xxxi)Storm water control and its re-use as per CGWB and BIS standardsfor various applications.

(xxxii) Water demand during construction should be reduced by use of pre-mixed concrete, curing agents and other best practices referred.

(xxxiii) Permission to draw ground water shall be obtained from thecompetent Authority prior to construction/ operation of the project.

(xxxiv) Separation of grey and black water should be done by the use of dualplumbing line for separation of grey and black water.

(xxxv)Fixtures for showers, toilet flushing and drinking should be of lowflow either by use of aerators or pressure reducing devices or sensorbased control.

(xxxvi) Use of glass may be reduced by up-to 40% to reduce the electricityconsumption and load on air-conditioning. If necessary, use highquality double glass with special reflective coating in windows.

(xxxvii)Regular supervision of the above and other measures for monitoringshould be in place all through the construction phase, so as to avoiddisturbance to the surroundings.

(xxxviii)Under the provisions of Environment (Protection) Act, 1986, legalaction shall be initiated against the project proponent if it was foundthat construction of the project has been started without obtainingenvironmental clearance.

II. Operation Phase

(i) The treated wastewater shall be recycled and reused for flushing oftoilets, horticulture to reduce the demand of fresh water, ascommitted.

(ii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management &Handling) Rules, 2000. No municipal waste should be disposed offoutside the premises.

(iii) The Operation and Maintenance of STP shall be made in the MoUwith STP supplier. Project Proponent shall ensure regular operationand maintenance of the STP.:

(iv) Parking facility with 6 m driveway shall be provided as committed.

(v) The installation of the Sewage Treatment Plant (STP) should becertified by an independent expert and a report in this regard shouldbe submitted to the Ministry before the project is commissioned foroperation. Treated affluent emanating from STP shall be recycled/reused to the maximum extent possible. Treatment of 100% greywater by decentralized treatment should be done. Discharge ofunused treated affluent shall conform to the norms and standards ofthe State Pollution Control Board. Necessary measures should bemade to mitigate the odour problem from STP.

(vi) The solid waste generated should be properly collected andsegregated. Wet garbage should be composted and dry/inert solidwaste should be disposed off to the approved sites for land fillingafter recovering recyclable material.

(vii) Diesel power generating sets proposed as source of back-up powerfor elevators and common area illumination during operation phaseshould be of enclosed type and conform to rules made under theEnvironment (Protection) Act, 1986. The height of stack of DG setsshould be equal to the height needed for the combined capacity of allproposed DG sets. Use low sulphur diesel. The location of the DGsets may be decided with in consultation with State Pollution ControlBoard.

(viii) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measured atthe boundary of the building shall be restricted to the permissiblelevels to comply with the prevalent regulations.

(ix) The green belt of the adequate width and density preferably withlocal species along the periphery of the plot shall be raised so as toprovide protection against particulates and noise.

(x) Rain water harvesting for roof run- off and surface run- off, as plansubmitted should be implemented. Before recharging the surface runoff, pre-treatment must be done to remove suspended matter, oil andgrease. The borewell for rainwater recharging should be kept at least5 mts. above the highest ground water table.

(xi) Energy conservation measures like installation of CFLs/TFLs for thelighting the areas outside the building should be integral part of theproject design and should be in place before project commissioning.Use CFLs and TFLs should be properly collected and disposed off/sent for recycling as per the prevailing guidelines/ rules of theregulatory authority to avoid mercury contamination. Use of solarpanels may be done to the extent possible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayedon the website of t~ concerned State Pollutio.n Control Board. The

EC letter shall also be displayed at the Regional Office, DistrictIndustries centre and Collector's Office/ Tehsildar's office for 30 days.

(ii) The funds earmarked for environmental protection measures shall bekept in separate account and shall not be diverted for other purpose.Year-wise expenditure shall be reported to this Ministry and itsconcerned Regional Office.

4. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be given fullcooperation, facilities and documents/ data by the project proponents during theirinspection. A complete set of all the documents submitted to MoEF&CCshould beforwarded to the CCF, Regional office of MoEF&CC,Nagpur.

5. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

6. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection) Act,1986, to ensure effective implementation of the suggested safeguard measures ina time bound and satisfactory manner.

7. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil Aviation Department,Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall beobtained, as applicable by project proponents from the respective competentauthorities.

8. These stipulations would be enforced among others under the provisions ofWater (Prevention and Control of Pollution) Act, 1974, the Air (Prevention andcontrol of Pollution) act 1981, the Environment (Protection) Act, 1986, the PublicLiability (Insurance) Act, 1991 and EIANotification, 2006.

9. The project proponent should advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded Environmental Clearance and copiesof clearance letters are available with the State Pollution Control Board and mayalso be seen on the website of the Ministry of Environment, Forests & ClimateChange at http://www.envfor.nic.in. The advertisement should be made withinSeven days from the date of receipt of the Clearance letter and a copy of the sameshould be forwarded to the Regional Office of this Ministry at Nagpur.

10. This Clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation v/ s. Union of India in Writ Petition (Civil)No.460 of 2004 as may be applicable to this project.

11. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section 16of the National Green Tribunal Act, 2010.

12. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and the LocalNGO, if any, from whom suggestions/ representations, if any, were received while

processing the proposal. The clearance letter shall also be put on the website ofthe company by the proponent.

13. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall updatethe same periodically. It shall simultaneously be sent to the Regional Office ofMoEF&CC, the respective Zonal Office of CPCB and the SPCB. The criteriapollutant levels namely; SPM, RSPM, S02, NOx (ambient levels as well as stackemissions) or critical sectoral parameters, indicated for the project shall bemonitored and displayed at a convenient location near the main gate of thecompany in the public domain.

14. The environmental statement for each financial year ending 31st March inForm-V as is mandated to be submitted by the project proponent to the concernedState Pollution Control Board as prescribed under the Environment (Protection)Rules, 1986, as amended subsequently, shall also be put on the website of thecompany along with the status of compliance of EC conditions and shall also besent to the respective Regional Offices of MoEF&CCbye-mail.
