New Jersey law requires you to take a breath test if you are arrested for a DWI. New Jerseys implied consent law says that if you are lawfully arrested by an officer who has probable cause to believe that you have been driving while intoxicated, then you consent to taking a chemical test of your breath for the purpose of determining your blood alcohol content (BAC). The test must be taken at the time of your arrest. If you refuse to take a test, however, then the officer cannot force you to take one. (Drivinglaws.org) Refusal to take the breath or blood test following a DUI arrest is admissible in court and can have severe driver license consequences in addition to the standard penalties.

There are special DUI laws for those under 21. It is illegal for someone under 21 to drive with a BAC of.01 or greater. Violation of this law will result in a license suspension for 30-90 days.
