Paul, I am sending a link that contains OSWER directives on manycontaminants cleanup. I think third or fourth item in the list is onPCS, if you look over the quick reference guide (fact sheet on theguidance) for PCB, you will find on the third page of the fact sheet,under the Develop Remedial Alternatives box (at the bottom of the page)it talks about principal threat under the heading Primary Alternatives.Under that heading it says for the industrial sites primary threat dueto PCB is at the level above 500 ppm. • CEC received comments from EPA and DEP on the draft RemedialInvestigation Report that was submitted to the Agencies on March 18, 2003.EPA comments were received on October 10, 2003. DEP comments werereceived on October 22, 2003.

• CEC and members of the Breslube Penn Joint Steering Committeeparticipated in a conference call on October 30, 2003 with EPArepresentatives to discuss the EPA comments and appropriate revisions forthe Remedial Investigation Report.

• CEC submitted a request to extend the schedule for the submittal of the finalRemedial Investigation Report until November 26, 2003. This extension wasauthorized by the EPA Remedial Project Manager on October 21, 2003.During the October 30th conference call with EPA representatives, CEC andEPA discussed the likely need for an additional schedule extension to allowtime for receipt of the Phase 5 validated data and for incorporating Agencycomments into the risk assessment and Remedial Investigation Report.

• CEC awaited comments from EPA and DEP on the Draft Feasibility Studythat was submitted to EPA on June 11, 2003.

Bothlandowners have indicated that they are willing to work with the Group andCEC for implementing the deed restrictions. The property deed restrictionlanguage is currently being prepared by legal counsel.

Subject Question about PCB/Dioxin Disposal Options

Bhupi,

As we discussed earlier, my understanding about dioxin disposal options is that there are very few placescan take dioxin containing materials for disposal. I think that low levels of dioxins can be disposed of atcertain permitted landfills (e.g., facilities already permitted for PCS disposal) such as EQ in Wayne,Michigan and the Chemical Waste Management facility in Model City, New York. I think these disposalfacilities can only take soils containing low levels of dioxins (the other individual that you are working withshould probably contact these disposal facilities to see whether the levels are low enough to allow theirplacement in those landfills).

I also spoke with a representative (Trina Castro) of Clean Harbors at their Cleveland Ohio office(800-645-8265) and they can take low levels of dioxins and PCBs into their landfill in Sarnia (OntarioProvince) Canada. Trina indicated that the landfill facility's contact person is Mike Forward at phonenumber is 1-519-964-3910.Let me know if you need any further information on this matter and I will do what I can to help out.

• CEC awaited Agency comments and/or approval of the Revised Remedial InvestigationReport that was submitted to EPA on January 30, 2004. Revisions for Sections 5, 6 and7 of the Rl report were made and forwarded to the EPA RPM and EPA toxicologist forapproval. CEC understands that Sections 4 and 5 of the Rl report have been approvedby EPA's toxicologist and RPM. Sections 6 and 7 of the Rl report (pertaining to the RiskAssessment) were provided to EPA electronically on November 30, 2004 for final reviewand approval prior to issuing paper copies of the Rl Report.

• CEC personnel and Breslube-Penn Joint Steering Committee legal personnelcommunicated with property owners and finalized the language for the implementation ofthe property deed restrictions. During late December, the Group received a call from theproperty owners requesting a minor change to the deed restriction language.

• CEC awaited comments from EPA and DEP on the Draft Feasibility Study that wassubmitted to EPA on June 11, 2003.

Property deedrestrictions that will restrict potential future residential use of the site and adjacent parcelwill be implemented upon resolution of the minor change requested by the CoraopolisDistrict Sportsmen's Association.

• The Remedial Investigation (Rl) Report (dated January 30, 2004) was revised inaccordance with comments submitted by the EPA RPM by letter dated February 16,2005 The revised Rl Report (Revision 2) was submitted to EPA and the PennsylvaniaDEP on March 2, 2005

• The Committee issued a "Notification of Objections" letter to the EPA on March 2, 2005in response to EPA's direction that the Breslube-Penn Joint Steenng Committee(Committee) shall include a risk summary table prepared by Jennifer Hubbard (EPA'stoxicologist) in the revised Feasibility Study (FS) The letter summarized theCommittee's concerns regarding the use of EPA's nsk table in the FS and requested thatEPA contact the Committee to discuss resolution of these concerns

• On March 1 8, 2005, CEC responded to an EPA email message from Bhupi Khona datedMarch 3, 2005 which asked what additional information the Committee needed to verifyEPA's risk values CEC provided a list of the desired supporting materials andrequested that EPA send copies for the Committee to review

• The Committee received EPA's response to the Committee's alternative approach tocompleting the Remedial Investigation (Rl) and Feasibility Study (FS) documents viaemail and facsimile dated April 27, 2005. EPA's email message concludes that "...theCommittee does not need to incorporate the quantitative estimates contained in EPA'smemo of December 15, 2004 in the Rl report...[but] shall, however, insert statements inthe Rl that the residential risks would exceed 1E-4 for cancer and would exceed aHazard Index of 1. EPA's message also outlined how background issues associatedwith the FS should be adjusted. A copy of EPA's April 27, 2005 email message isattached.

• As requested by EPA, the Committee's objections were withdrawn by an email messagedated May 11, 2005 which stated the following: "the objections are'withdrawnconsistent with the course of correspondence between both parties0.

Civil & Environmental Consultants, Inc. (CEC) received comments from the United StatesEnvironmental Protection Agency (EPA) Region III via email dated April 27, 2005, regardingtheir review of the March 2, 2005 Remedial Investigation (Rl) Report for the Breslube-PennSuperfund Site. Per EPA's request, and in response to those comments, CEC revised pages 6-7 and 6-8 of the Rl Report and submitted them to EPA on June 17, 2005. It was ourunderstanding that the Rl Report would be approved following EPA's receipt of these revisedpages. However, EPA issued a final set of comments via facsimile and letter dated July 19,2005, regarding the text revisions in the Rl Report. In response to those comments, CECresubmitted the revised pages of the Final Rl Report to EPA on August 17, 2005.

In accordance with our updated project schedule, submitted via email on June 10, 2005, -weinitially targeting the delivery of the revised Feasibility Study (FS) for August 12, 2005. Thisassumption was based on EPA's approval of the text in the Rl Report (June 17, 2005 version).Portions of the Rl Report, including the text revisions submitted on August 17, 2005 will beincluded in the revised FS. Consequently, this letter requests authorization to postpone thedeadline for the submittal of the revised FS to August 31, 2005 (rather than August 12,2005). Ifthis requested schedule modification is acceptable to EPA, I understand that you can sign thesignature line provided below and return a copy to me via facsimile.

• CEC awaited Agency comments and/or approval of the Revised RemedialInvestigation Report that was submitted to EPA on January 30, 2004.

• CEC personnel and Breslube-Penn Joint Steering Committee legal personnelcommunicated with property owners and made efforts to reach agreement for theproperty deed restrictions.

• CEC visited the site on various dates in late September to inspect damage fromflooding of Montour Run, and solicit quotations for fence repairs. CEC also met withrepresentatives of the Coraopolis District Sportsmen's Association on September 21,2004 to discuss the flooding extent and progress on deed restriction negotiations.CEC was informed that monetary compensation for implementation of the deedrestrictions was not going to be required based on discussions between CEC's projectManager (Mr. Paul Tomiczek) and Mr. Keith McElrath of the Coraopolis DistrictSportsmen's Association on September 21, 2004.

• CEC awaited comments from EPA and DEP on the Draft Feasibility Study that wassubmitted to EPA on June 11, 2003.

SUMMARY OF RESULTS OF SAMPLING, TESTS, ANALYTICAL DATA, ANDOTHER INFORMATION

• Various photographs of flooding impacts to the site were forwarded electronically tothe EPA Remedial Project Manager (RPM) and Breslube-Penn Group members.

DESCRIPTION OF DATA ANTICIPATED AND ACTIVITIES SCHEDULED FORNEXT 30-DAY PERIOD

• Appropriate revisions to the risk assessment will be finalized, consistent with theprevious agreements reached during discussions between the Breslube-Penn Groupand the EPA's Remedial Project Manager and Toxicologist. Property deedrestrictions that will restrict potential future residential use of the site and adjacentparcel will be implemented (assuming final agreements are reached with theproperty owners).

• CEC will await receipt of additional formal EPA comments and/or EPA approval ofthe January 30, 2004 Remedial Investigation Report. Consistent with the EPA RPMrecommendations, CEC will submit the revised sections of the Risk Assessment andRemedial Investigation Report to incorporate the above-described revisions for finalapproval.

• CEC anticipates possible receipt of EPA and DEP comments on the Draft FeasibilityStudy Report submitted on June 11, 2003.

• Western Pennsylvania experienced two separate record rainfall events during themonth of September 2004. On September 8, 2004 a record high one-day rainfalloccurred, with a 3.60 inch total rainfall (resulting from remnants of HurricaneFrances - that eclipsed the previous one-day record of 3.57 inches set in August 1888).Subsequently, on September 17, 2004, this new rainfall record was again exceededwith a 5.95 inch rainfall (resulting from remnants of Hurricane Ivan). The rainfall,particularly from Hurricane Ivan, caused extensive flooding throughout westernPennsylvania. The Breslube Perm site also experienced some flooding, and the sitefence was damaged. Monitoring well MW-19B was also destroyed by the floodingand by the subsequent road repair activities that were performed.

ACTIONS TAKEN TO REMEDY OR MITIGATE PROBLEMS AND PROPOSEDSCHEDULE

• A price quotation was obtained for the necessary fence repairs, and the repairs areexpected to be made during the next three to four weeks. Monitoring well MW-19Bmay be replaced at a later date, if applicable, for use in the groundwater monitoringnetwork.
