These rules, addressed below, are without technical basis and fail to consider the benefits of clean energy to all citizens of Pennsylvania. We urge that you withdraw changes to §75.13(k) giving the Commission authority to approve utility company requests to charge net metered customers special fees. When homeowners and small businesses spend their own money to build clean energy sources, we all benefit. Please do not open the door for utilities to discourage and penalize clean energy system owners. We urge that you withdraw changes to §75.13(a)(3) adding a new 110% generation limit on system size. Consumers spend their own money to install a clean energy system. Deciding how much to spend and how big the system needs to be is a private matter. This rule would require every homeowner and small business owner to convince his or her utility company (somehow) that the system they want to purchase will generate less than 110% of the electricity they use. This is impractical, intrusive and expensive to administer. It is also unneeded. Pennsylvania already has a rule for maximum size—50 kW for a residence and 3 (or 5) MW for a business, period. There is no legitimate, practical reason to charge individuals with PV systems a fee to generate electricity for their own use ... any more than they should get a surcharge from the water company for having a well. This is just a transparent political tactic that is promoted by the fossil fuel industry to prevent development of distributed clean energy production in the name of corporate profit. In addition, the limitations and rules are extremely vague, and consumers do not have ANY options to switch their energy supplier. Thus, the suppliers effectively make the rules, and there is no incentive at all for suppliers to provide a competitive product (e.g. $0 PV or net metering fees). That is what is known as a monopoly, and it is clearly disadvantageous to the welfare of the general public. Expect a legal battle...

Go MAREA. Rules proposals §75.13(k) and §75.13(a)(3) smacks of regulatory capture by the utilities. It's an imperative that the citizens and it government adopt policies and take actions that benefit all of us and coming generations by supporting renewables, not inhibiting them. The proposals are just so wrong-headed. Where is PUC's leadership in the renewable area? When enough energy from sunlight falls on the earth in approximately one day to power all of humanity for a year! The utilities have checks in place to ensure the quality of electricity moving back onto the grid is at the required level. This is an additional cost to the consumer during installation. In addition, the payment to the generator is much less than the cost of generation by any other supplier, allowing the utility to capitalize on the resale.

While I do support some limits to Solar PV system abuses, I do believe that imposing fees for Solar PV owners (existing or new) is a deterrent to any future system installations or enhancements.

One way to fluctuate the Solar PV system deployment is to limit the rebates available. If someone wants to install a larger system, they would be paying for it up-front without tapping into rebates that the state has to manage and pay for (ie. taxpayer funds). Instead of paying customers the rebate fees, the State of PA can use such funds for more PUC study into why systems such as the very expensive Smart Meter program at PECO is not really doing anything for the hundreds of millions of dollars that the federal government has given to PECO to implement. No new custom rate plans exist, no electric rate plans to help smooth out the demand curve by load-shifting to off hours, no new support for electric vehicles to charge at night during the low demand cycle. I suppose a jobs program like this is acceptable but independent power generators are a problem for the state.

The small sector of Solar PV customers being imposed a fee for generating electricity flies in the face of conservation and intelligent energy usage. It just makes them "pay more" in order to participate and many will choose not to participate.

I am discouraged and disheartened that Pennsylvania's utilities and the PUC would consider taking a step which would discourage residents from doing their part to help curb carbon emissions and supply clean energy to their local utility with a solar installation. We paid for our solar system out of our own money. The Sunshine Rebate Program was out of funds but we decided to move ahead with our installation anyway. Not only are we helping to reduce carbon emissions but we provide power beyond our needs, on sunny days, to help our utility. We invested in the system, we are doing our part to help deal with climate change and now we are to be penalized for this. How does this move encourage others to want to live, invest, or do their part in helping with overall climate issues in PA? Pennsylvania is continuing to disappoint and be behind other more progressive states. And that's a real shame.

This is a plan that A.L.E.C contrived on behalf of one of its founders the Koch Brothers. ALEC is the legislative arm of the Tea Party Right Wing and the policies created are geared to financially benefit those powerful members of the 1% right wing ;a wealthy and powerful small portion of society .In this case the coal burning electricity plants that fires Koch Coal will benefit . This anti solar legislation makes it more difficult to get off the grid by punishing those that reduce or eliminate their energy footprint when they should be rewarded. dawning of a cleaner America and world. This legislation sucks and is a contrivance by a group of oligarchs to maintain their pot of gold and screw the rest of the nation and world. Please do the right thing and vote it down.

Is it unfair to change the economic benefits of an existing installation after the purchaser has decided to pay for it. We should be encouraging solar by raising fossil fuel derived electric rates, not by adding fees for solar or general connection charges.

i can see that the utilities do need some money so i can use them as back up power when the sun does not shine or whenever my system is not big enough to provide all my needs. they need to maintain the lines and power sources. that needed feature is not free and homes with solar PV should pay for those services.

we must recongnize that as solar users - we do use the power lines from the utility and rely on them for power when the sun does not shine or when our systems are too small. so i expect to pay a service charge to PECO along with any electrons i use. we can not expect a free ride. - bill
