GENERIC PRIVATE YACHTS REGISTRATION REQUIREMENTS

Requirements for Provisional Registration Application Forms - The Application Forms for Private Yachts is available through our Office . The application form must be submitted along with the required supporting documents. Contact us via email or phone in order to begin the process of registration,

Completed application form usually is accompanied (as applicable) by the following: 1. Proof of ownership - Original or duly validated copy of Bill of Sale / Builders Certificate (if new construction). 2. All vessel's current certificates issued by current flag state and classification society 3. Schedule of interested shareholders 4. Power of Attorney or Particulars of Directors and Secretaries 5. Copy of passport of owner(s)

Subject to have all documents needed, and upon payment of the registration fees, a Provisional Certificate of Registry will be issued. This certificate is effective from the date of issue and valid normally for a period of 3 or 6 months depending the flag. This can be extended, subject to the payment of an extended registration fee. During this time the requirements for permanent registration should be completed.




Requirements for Permanent Registration (as applicable)

1. An Application Form must be submitted to our office. The Form must be duly executed and witnessed as specified in the Application Form. The verification can be provided by our office.

2. Deletion Certificate from yacht's previous Registry. 3. Copy of confirmation (letter or email) from Radio Accounting Authority agreeing to act as Accounting Authority while vessel is under

the chosen Flag . 4. Schedule of interested shareholders 5. Power of Attorney or Particulars of Directors and Secretaries 6. Current photo of vessel 7. EPIRB hexadecimal and serial numbers for all vessels on international voyage and proof of registration of the EPIRB 8. Photographs of the vessel indicating the new Flag and the name of the vessel. All Documents attached to the application can be verified by us in case we acting as by Deputy Registrar also.




Period of Registration

Owner can opt to register the yacht for 1 year, 3 years or 5 years. The owner of the yacht may register for a one (1) year, where the owner must renew his/her yacht registration on an annual basis. Alternatively a three (3) year or five (5) year registration can be paid in advance, freeing the owner from annual filings.




Size and Age Limitation We propose flags where there is no size or age limitation for yachts.

Insurance Normally is not required for private yachts, however we recommend that owners manage their risks through insurance and other measures. We can provide support to find the most convenient Insurance Company Our Office can provide insurance services upon request

PRIVATE YACHT SURVEY AND CERTIFICATION REQUIREMENTS

Safety Certification 1. Most yachts are required to carry a Yacht Safety Certificate. Note that this rule maybe deviated depending the flag requirements. 2. The Yacht Safety Certificate can only be issued on completion of a survey or inspection. 3. For private yachts less than 24m the survey form can be completed by a competent person, which can include the owner or master, provided the form

is returned with photographs confirming the condition of the items inspected. 4. Private yachts less than 24m and registered for 3 years do not need annual surveys. Private yachts under 24 m and registered for 5 years must have an

intermediate inspection between the second and third anniversary of the issue of the Yacht Safety Certificate. 5. All yachts over 24m needs to be surveyed by an authorized surveyor before a Yacht Safety Certificate can be issued. Yachts over 24 m need to have

usually annual or intermediate survey (depending the flag requirements) inspections and the Yacht Safety Certificate endorsed by a surveyor. 6. Classification society may also perform such surveys

International Tonnage Measurement Tonnage measurement is not required for private yachts less than 24 meters. Yachts over 24m must comply with the International Tonnage Convention 1969. Classification society may perform such measurements. Normally the proposed Flags will accept previous International Tonnage Certificates by Class.

MARPOL – Applies in general For private yachts 400 GT and over.

International Oil Pollution Prevention Certificate Issued to indicate compliance with Annex I of the International Convention for Prevention of Pollution from Ships, MARPOL 1973 as amended. Annex I introduces measure to control the risk of environmental damage specifically caused by oil. The Annex provides for the retention, filtering and controlled discharge of oil and oil contaminated water on-board ships approved reception facilities rather than world's oceans.




SOLAS - Applies to vessels over 500 GT. Not required for Private yachts.

International Sewage Pollution Prevention Certificate Issued to indicate compliance with Annex IV of the International Convention for Prevention of Pollution from Ships MARPOL 1973, as amended. Annex IV introduces measures to reduce damage to the environment caused by the discharge of sewage produced on board ships and by introducing strict controls on the discharge of treated and untreatable sewage.

Garbage Management All yachts over 400GT or more are required to comply with MARPOL Annex V: Regulations for Prevention by Garbage from Ships. A Garbage Record Book must be maintained. All yachts over 100GT or above are required to have a Garbage Management Plan.

International Air Pollution Prevention Certificate All yachts over 400GT or more are required to comply with MARPOL Annex VI: Regulations for the Prevention of Air Pollution from Ships. They will need to be surveyed and be in compliance with the following documents

a. International Air Pollution Prevention Certificate & Supplement b. Ozone Depleting Substances Record Book c. Ship Energy Efficiency Management Plan (SEEMP) d. Under regulation 13 of Annex VI shall have a technical file and an Engine AIPPC

for each marine diesel engine over 130 kW

Antifouling - applies to private yachts over 24 m (declaration) > 400 GT - Certificate.

All vessel's present certificates including Minimum Safe Manning, issued by current flag state and classification society. 4. Application for crew endorsement for all officers that require to have their certificates of competency endorsed. 5. Schedule of interested shareholders. 6. Power of Attorney or Particulars of Directors and) Secretaries Copy of passport.

Subject to final document review , and upon payment of the registration fee, the Permanent Certificate of Registry will be issued.

Radio Accounting Authority The purpose of Maritime Radio Accounting Authorities is to facilitate the effective collection and distribution of telecommunications charges for non-emergency radio telephone and telex call from ships into the international subscriber networks. A vessels Accounting Authority must be recognised by the Flag. Any Accounting Authority that appears on the ITU list of member AAICs will be recognised by the flag s we will propose.

COMMERCIAL YACHT SURVEY AND CERTIFICATION REQUIREMENTS

Commercial yachts can be certified with our support.

Annual Safety Inspections & Surveys Commercial yachts are subject to inspections [in accordance with the IMO Harmonized Survey System,] by a Flag Appointed surveyor or classification society. A recognized classification society or surveyor may carry out such inspections

Safety Certification In most cases the yachts are required to carry a Yacht Safety Certificate. The Yacht Safety Certificate can only be issued on completion of a survey or inspection.

International Tonnage Measurement Vessels over 24m must comply with the International Tonnage Convention 1969. A classification society may perform such measurements. We accept previous International Tonnage Certificates by Class or State recognized by the Flag.

Load Line Yachts over 24m in load line length must be surveyed in accordance with International Load Line Convention. An appointed Flag surveyor or classification society may perform such measurements. We accept previous International Load Line Certificates by Class or State recognized by the Flag.




MARPOL Requirements

International Oil Pollution Prevention Certificate All yachts over 400GT are required to comply with the requirements set out in MARPOL Annex I "Regulations for the Prevention of Pollution by Oil" Classification Societies recognized by the Administration or an Authorized Surveyor will survey these yachts.

International Sewage Pollution Prevention Certificate of Compliance All yachts over 400GT or are certified to carry more than 15 persons on-board are required to comply with the requirements set out in MARPOL Annex IV, Regulation 2. A recognized Classification Society surveyor or an Authorized Surveyor appointed by the Administration will undertake the survey of yachts.

Garbage Management All yachts over 400GT or more are required to comply with MARPOL Annex V: Regulations for Prevention by Garbage from Ships. A Garbage Record Book must be maintained. All yachts over 100GT or above are required to have a Garbage Management Plan.

International Anti Fouling System Certificate All Yachts over 24m and over 400GT must comply with the "International Convention on the Control of Harmful Anti-fouling Systems on Ships"

International Anti Fouling System Declaration All yachts over 24m and under 400GT engaged in International voyages shall carry an Anti-Fouling Declaration signed by the owner or their representative. The declaration is to have a paint receipt or contactor invoice attached to the Declaration.

Bunkers Certificate All yachts over 1000GT and above are required to be insured and certified under the "International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001" You may apply to our office for a Bunker or Wreck Removal Certificate




Safety of Life at Sea (SOLAS) Requirements

Cargo Safety Construction Certificate All commercial yachts from 500GT and over are required to be surveyed and comply with requirements of SOLAS Chapter 11-1 " Construcion - structure, subdivision and stability, machinery, and electrical installation" & Chapter II-2 " Construction - Fire protection, detection and extinction" Classification Societies recognized by the Administration or an Authorized Surveyor will survey these yachts

Cargo Ship Safety Equipment Certificate & Record All commercial yachts of 500GT and above are required to be surveyed and comply with requirements of Chapter III "Life Saving appliances and arrangements" Classification Societies recognized by the Administration or an Authorized Surveyor will survey these yachts

Cargo Ship Safety Radio Certificate and Record All yachts of 300GT and above are to be surveyed and comply with the requirements of Chapter IV "Radio Communication" Classification Society surveyor or an Authorized Surveyor considered by the Administration to be appropriate in relation to radio installations.

International Safety Management (ISM) All commercial yachts from 500GT and over are required to comply with SOLAS Chapter IX and the ISM Code.

International Ship and Port Facility Security (ISPS) All commercial yachts of 500GT and over are to comply with SOLAS Chapter XI-2 and the ISPS Code




Long Range Identification & Tracking - (LRIT) Applies to all commercial yachts over 300GT engaged in international voyages. Yachts need compliant INMARSAT terminals that need to be programmed and tested by an approved Application Service Provider. The test report needs to be kept on board and a copy sent to the Flag.

Emergency Position Indicating Radio beacon (EPIRB) Distress beacons are designed to locate the vessels position and identify and call for help should you run into trouble. Ensure the EPIRB is a 406 MHz beacon. The hexadecimal number may be re-programmed to reflect the Flag number- prefix- followed by the beacon serial number. This hexadecimal number must also be displayed on the outside of the EPIRB. If the EPIRB is reprogrammed to reflect Flag identifiers then the EPIRB must be registered with Maritime New Zealand (Flag SAR provider). If the EPIRB is not re-programmed then it must be registered with the SAR co-ordination center in the country or region that it was purchased or in which the yacht operates. Your EPIRB hexadecimal ID number/s must be advised to the Flag of the yacht.

Minimum Safe Manning Minimum safe manning levels are established for every commercial yacht. Levels are determined based on by the Gross Tonnage and propulsion power of the vessel and the nature of its operations. Ask our office for further details.

STCW Crew Endorsements An Endorsement Certificate is required for seafarers employed on registered vessels as set out in STCW 78 as amended. All watch keepers on yachts of 500 GT and above require Endorsement Certificates. Watchkeepers on smaller vessels may also require Endorsement Certificates depending on the Minimum Safe Manning Certificate.




Maritime Labour Convention Ships of 500 GT or over, engaged on international voyage, and operating commercially must be certified as in compliance. Certification under MLC is not mandatory for vessels under 500 GT. Notwithstanding this, all commercial under 500GT yachts engaged on international voyages and operating commercially must be surveyed and found to be in compliance with MLC 2006. Owners / managers are encouraged to request certification under MLC to avoid problems with Port State Control.

Insurance It is a requirement of a number of conventions that vessels carry insurance against certain risks. Vessels are required to have current insurance policies to cover crew and third party liabilities. 1. Bunker Insurance vessels over 1,000 GT 2. Maritime Labour Convention Insurance (all commercial vessels) 3. Hull and Machinery Insurance 4. Nairobi Wreck Removal Convention Insurance (all vessels 300T and over)
