Trees are blooming and warmer weather is finally upon us. Patio weather has arrived! April has been a busy month for OCAPL and it has been a welcomed change of pace. Earlier this month on April 5th, we held our first in person meeting in over 12 months and we had a great turnout. It was a special one as we were finally able to present the 2020 OCAPL awards. BRRRRRR it’s cold outside! When is February going to be over? We have currently been dealing with temperatures below freezing for over a week and have set the 2nd coldest temperature in Oklahoma City on record at -14 degrees without a windchill. We have all been dealing with slick roads, power outages, freezing pipes and rolling blackouts. I would have never imagined that we would experience a rolling blackout, but here we are. I know for me, spring can’t come fast enough! Normally, February is a month for Land Professionals to gather at the George R. Brown convention center in Houston for the NAPE Summit but due to the ongoing challenges presented by COVID-19 the 2021 NAPE Summit has been postponed to August 18-20, 2021.

Earlier this month, on February 1st, we held our first webinar speaker of the year. The topic was “Solar vs. Oil & Gas” presented by Phillip Guerra, J.D., CPL, Land Acquisition Manager with ForeFront Power. Let me say, this was OCAPL’s first webinar and I really enjoyed it. Our Education Chairs, Clarke Richards and Chase Payton did a fantastic job, along with Phillip Guerra J.D., CPL. Job well done, gentlemen! If you missed the webinar you are in luck, we have a copy of the presentation and it can be found on our website under the “Past Events”. I highly recommend you check it out.

WASHINGTON (Bloomberg) --Chief executives of some of the largest U.S. oil companies promised to collaborate with the Biden administration in its campaign against climate change during a meeting Monday with White House National Climate Adviser Gina McCarthy.The oil industry leaders pledged support for federal regulations explicitly limiting emissions of methane from wells and other oilfield equipment -- a declaration that dovetails with President Joe Biden’s vow to clamp down on leaks of the potent greenhouse gas.They also cheered the U.S. return to the Paris climate agreement and urged greater government support of carbon-capture and hydrogen technology that can help the country fulfill new carbon-cutting pledges set to be unveiled next month, according to two people familiar with the session that was conducted

over Zoom.McCarthy underscored how Biden’s “plans

to tackle the climate crisis are centered around propelling our equitable economic recovery, positioning America to win the 21st century and creating millions of good-paying, union jobs directly in American communities,” the White House said in a statement after the session. “She made clear that the administration is not fighting the oil and gas sector, but fighting to create union jobs, deploy emission reduction technologies, strengthen American manufacturing and fuel the American economy.”The meeting, which included executives from three industry trade groups and 10 oil companies -- including Exxon Mobil Corp., BP Plc, ConocoPhillips, Royal Dutch Shell Plc, Chevron Corp. and Devon Energy Corp. -- was the first of its kind since Biden’s inauguration in January. The format did not allow for a deep, back-and-forth dialogue. Instead, McCarthy opened the meeting, followed by remarks from Laura Daniel-Davis, the Interior Department’s principal deputy assistant secretary for land and minerals management, and each of the industry participants. Dave Lawler, the chairman of BP America Inc., kicked off their comments.Almost of all of the executives in the virtual session made a pitch for putting a price on carbon dioxide emissions -- a policy shift they said could trigger greater investment in

emission-reducing technology while fostering more certainty for energy companies. The American Petroleum Institute is considering endorsing a carbon price, which could take the form of an emissions-trading program or a tax on heat-trapping greenhouse gases.“Our industry regularly engages with all levels of government and wants to ensure that policy makers in Washington understand that we can achieve our shared goal for a low-carbon future while strengthening American energy leadership and supporting the nation’s economic recovery,’ said API President Mike Sommers in an emailed statement. “We are committed to working with the White House to develop effective government policies that help meet the ambitions of the Paris agreement and support a cleaner future.”

(Bloomberg) --Texas moved to stop the city of Austin and others from imposing a California-style ban on natural gas in new homes and buildings, the latest salvo in the gas industry’s bid to protect itself from local climate regulations.The Texas House of Representatives passed a bill Tuesday that would bar cities and towns from restricting natural gas hookups in new construction or utility services. The measure passed along with a series of bills designed to prevent a repeat of last month’s catastrophic blackouts that left millions in the dark for days and killed more than 100.The move comes after Austin weighed a proposal to phase out use of the fossil fuel as part of the city’s climate plan. More than 40 cities in California including San Francisco have passed measures designed to end gas

connections into homes amid concerns over the fuel’s contribution to global warming.The gas industry has started pushing back against the local restrictions, which are starting to pop up outside of California. Big gas producing states including Louisiana and Oklahoma have passed legislation prohibiting local bans and several other states are considering similar measures.Natural gas is used to heat about 35% of homes in Texas with electricity used for home heating for 61% of residences, according to the U.S. Energy Information Administration. However, most modern furnaces require electricity to function.The bill in Texas will now move to the state Senate, which has expressed support for the gas industry.

Q: I’m trying to secure leases from a family. One of the siblings has been missing for more than ten years. They actually believe he is probably dead, but do not have any direct proof of that. As he has been missing for more than seven years, can we presume that he is deceased? For someone who has been missing, is a court proceeding necessary for the per-son to be declared dead? – T.H.

A: In the movie Cast Away, the Helen Hunt char-acter (Kelly) tells the Tom Hanks character (Chuck) that as he had been missing and presumed dead af-ter a plane crash, a court declared him to be legally dead.

In almost all states, in the absence of a death certificate, to be declared “legally” dead, a court proceeding is necessary. In essence, there are two types of events where this comes up. First, if a per-son has been missing and unaccounted for more than seven years under Oklahoma law, he may be declared to be legally dead. Second, if a person is missing after an accident or exposed to “imminent peril” and fail to return, then the person can be de-clared dead without waiting the requisite amount of time. In other words, if a person goes down in an airplane crash in the ocean, such as Chuck, then it is not necessary to wait the requisite seven years.

In the United States, it is estimated that there are between 60,000 to 100,000 people who are missing, but have not been declared legally dead. Missing people can be a result of many things, in-cluding mental health issues, financial problems, or even, possibly, alien abduction.

There are a few occasions where people were declared legally dead, but subsequently reap-peared such as the Tom Hanks character. In 1994, an Ohio Court declared Donald Miller dead several years after he mysteriously disappeared, so that his wife Robin Miller could apply for Social Secu-rity benefits for their two daughters. Nineteen years later, Mr. Miller reappeared wanting to apply for a drivers license and reactivate his Social Security number. To do that, he had to petition the court to reverse its declaration of death. In the interim, Mrs. Miller remarried (to another man named Miller). The

lawyer for Ms. Miller Miller opposed the petition on the grounds that she might have to return the ben-efit payments received from Social Security, but did not have the ability to do so. Further, there is a pre-sumption under most states that once a judgment has been rendered, it becomes final and it cannot be attacked several years after the finality. The Ohio Court ruled that the Ohio law does not allow a decla-ration of death to be reversed after three years. The court told Mr. Miller that he was still deceased as far as the law was concerned. The movie Cast Away was accurate as it appears that Chuck had been exposed to “imminent peril” and did not return. However, Chuck could, perhaps, petition a Tennessee court to be declared alive as he reappeared.

Editor’s Note: Each month this column will be devoted to answering oil and gas title questions.

Q: I examined an Oil and Gas Lease dated July 1, 1984, covering tracts in Sections 1, 2, 3, 4, 5 and 6. I have also examined copies of Oklahoma Corporation Commission Completion Reports (Form 1002) for the Smith 1-1 Well drilled in the SE/4 and the Smith No. 2 Well located in the NE/4 of Section 1.

During the primary term of the lease, two wells were drilled on the lands in Section 1. The first well, which is denoted as the Smith 1-1 Well, was commenced on October 13, 1984 and drilled in the S/2 SE/4 (which is not part of the leased tract). The Smith 1-1 was completed in a formation, which was established as a 160-acre drilling and spacing unit for the SE/4.

A second well, denoted as the Smith No. 2 Well, was drilled in the NE/4 of Section 1 (part of the leased tract) on April 24, 1986, and completed in the Hartshorne formation. The Hartshorne formation has not been established as a drilling and spacing unit for the NE/4 of Section 1.

Does the drilling of the Smith 1-1 Well in a drilling and spacing unit of 160-acres cause the lease to terminate outside the SE/4? What is the impact of the Smith No. 2 Well Well on the extension of the Smith 1-1 lease?

A: Title 52 O.S. 87.1(b) recites: "In case of a spacing unit of one hundred and sixty (160) acres or more, no oil and/or gas leasehold interest outside the spacing unit involved may be held by production from the spacing unit not more than ninety (90) days beyond expiration of the primary term of the lease." (This statute is frequently described as the “Statutory Pugh Clause”).

Unfortunately, there is no case law and only one law review article that construes this statute and its impact on wells drilled. The only guidance is the wording of the statute. In this situation the oil and gas lease would not have been extended solely by virtue of production from the spacing unit and the well drilled in the SE/4, but the lease was

If this is the case, you will be notified the morning of the tournament. TOURNAMENT INFORMATION (1) Goal of this event is to network, enjoy the outdoors, and have fun! (2) No motorized boats will be allowed this year. Members/Guests will be allowed to use kayaks, canoes,

tubes, and small boats; however, no boat ramp is available, so please plan on using only watercraft that can be carried to/from the water. Additionally, there are numerous spots available for bank fishing.

(3) Information regarding the weighing of fish will be provided the day of the tournament. (4) Only members whose dues are current will be eligible for a Member Prize. Committee members will

verify membership status prior to the tournament, so please make sure dues are current if signing up as a member. Parties wishing to receive prizes must check in the morning of the tournament and be present at the time of the drawing to receive a prize.

(4) Due to COVID-19 concerns, we ask that members & guests use discretion and discernment with

2021 OCAPL FISHING TOURNAMENT ENTRY FORM

The 35th Annual OCAPL Fishing Tournament will be held at 11001 E Forrest Hills Road, Guthrie, OK, on Friday, June 11th, 2021. The tournament will include lunch, from 11:30 AM – 1:00 PM and Awards/Prize Drawing will begin promptly at 3:00 PM (membership dues must be current to win MEMBER prize, and all parties must be present to receive a prize).

Due to circumstances beyond the control of OCAPL, a venue change was required. While this year’s event will no doubt look different than previous years, the OCAPL Fishing Tournament Committee is committed to providing a safe, fun event for its members & guests, and should offer an opportunity to fish, network, and enjoy some good food with industry counterparts. Entries will be limited to the first 125 members/guests, so sign up today!

AMERICAN ASSOCIATION OF PROFESSOINAL LANDMEN QUARTERLY BOARD of DIRECTORS MEETING, HYBRID MEETING, VIRTUAL & FORT WORTH, TX

March 14, 2021 The Hybrid AAPL Quarterly Board Meeting was held on March 14th, 2021 in the Omni Fort Worth and simulcast virtually through Zoom. Lester Zitkus, AAPL President, called the meeting to order. The invocation was given by Jay Beavers, followed by the introduction of guests and roll call of the Executive Committee, Directors and Committee Chairs. New Directors/Temporary and Sub-Directors were seated. Upon adoption of the agenda, the minutes from the last board meeting on December 12th, 2020 were adopted by acclamation. Treasurer’s Report: Kyle Reynolds, Treasurer, provided a report on AAPL and its affiliates for the period ending December 31, 2020 as follows:

AAPL, Inc.’s total assets are $42,753,477, while total liabilities are $1,390,906. Revenues (exclusive of investment revenue) totaled $1,083,266 as of December 31, 2020. This is a decrease of

41% from December 31, 2019. The decrease in revenue was primarily due to decreases in NAPE Expo distributions, educational seminar fees, and membership dues.

Expenses through December 31, 2020 totaled $2,619,899. This is a decrease of 20%. The decrease in expenses is mostly comprised of education (decrease of $332,252 or 80.1%), board meeting (decrease of $155,960 or 98.8%), and G&A expenses (decrease of $116,549 or 6%)

Investments as of December 31, 2020 are $36,280,153 which is an increase of $4,448,422 or 14% as compared to the same period last year. The change has been the result of unrealized and realized gains due to market activity in the AAPL investment account.

As of December 31, 2020, the Education Foundation, Inc.’s balance sheet reflects $5,150,620, which is an increase of $529,072 as compared to the same period last year. The Statement of Investment Accounts reflects $4,911,534 total monies invested which is an increase of $531,119 as compared to the same period last year.

As of December 31, 2020, the Landman Scholarship Trust’s balance sheet reflects $9,116,226 which is an increase of $1,026,641 as compared to the same period last year. The Statement of Investment Accounts reflects $8,220,525 total monies invested, which is an increase of $606,026 as compared to the same period last year.

AAPL General Report: This was the first in-person meeting since March of 2020. It was also simulcast virtually through zoom. To benefit membership and in response to Covid-19, a schedule of 10 complimentary one-hour webinars was

developed and began in March 2020. This is in addition to the free monthly streaming videos that can be found on the AAPL website.

Wind and Solar focused webinars are coming soon. 2020 AAPL membership totaled 12,357 members, this is a -19.63% change from 2019 AAPL Membership dues were set to automatically rise from $125 to $150, however because of the state of the

industry the board voted to delay the increase for another year. The change to AAPL’s definition of “Landwork” was approved to go to membership vote. The goal of said

change is to make AAPL more inclusive of alternative energy sources including but not limited to wind and solar.

NAPE Summit

2021 NAPE Summit moves to August The new NAPE Summit dates are:

In Person: Aug. 18-20, 2021 Virtual: Aug. 9-Sept. 3, 2021

New Hybrid event including in-person and virtual registration options on the NAPE network. Nape Expo Charities fund event featuring General Mattis as keynote speaker. The NAPE committee is working with and meeting weekly with the City of Houston (Houston First reps) and the

GRB staff to ensure we will have the most up-to-date and effective safety protocols in place. New this year will be the Renewable Energy Pavilion. This pavilion will host sponsors, exhibitors and attendees

who are working in or are interested in learning more about this sector of the industry.

The 67th Annual meeting has been moved to Arlington, TX June 23-26, 2021. Host hotel is Live! By Lowes The keynote speaker is Jimmie Cho, Chief Operating Officer, of Southern California Gas Company There is a diverse educational lineup with the opportunity to earn up to 16 CE Credits. Recordings of the

educational sessions will be available so that no member misses the chance to learn and earn credits. Sponsorships are available.

Professional Development Assistance Program – reduces the registration fee up to $300 for AAPL operated events including the Annual Meeting, the NAPE Business Conference, and educational workshops and seminars. The program provides a platform for experienced land professionals to mentor new members of our profession or those who may desire to enhance their skills in a certain area of focus.
