APPLICATION INSTRUCTIONS

If you are an Ohio based producer, and would like to sell your product(s) at the Keller Market House, you will need to review the attached documents. It might at first glance look like there is only one, but there are in fact four documents you should be aware of. They are:

1. Rules, Procedures & Guidelines, 2. Producer Application, 3. Artisan Guidelines and 4. Artisan Application.

1. No matter what kind of product(s) you would like to sell, all Producers and Artisans must read and abide by the Keller Market House RULES, PROCEDURES & GUIDELINES. These are our rules for participation in the market.

2. Identify if the product(s) you want to sell is considered “Artisan.” You can do this by reading the section entitled Product Categories and Guidelines in the Rules, Procedures & Guidelines document. If it is, skip to step #4.

3. All Producers (Except for Artisans) must fill out and submit, either by mail, email or in person, a PRODUCER APPLICATION.

4. If the product you want to sell is classified as “Artisan” you must also read and abide by the Keller Market House ARTISAN GUIDELINES. These establish the criteria for the products that artisans are allowed to sell at the market.

5. Finally, fill out and submit by mail, email or in person, the ARTISAN APPLICATION. 6. All applications must include a check for $50 made payable to Lancaster Fresh Market, Inc. If for some reason

your products are not accepted into the market your check will be returned.

Once you have submitted the appropriate application we will review it and notify you of acceptance into the market. Please be patient with us, each application will be thoroughly reviewed and be done in a timely manner.

RULES, PROCEDURES & GUIDELINES

The mission of Lancaster Fresh Market, Inc. (dba Keller Market House) is: “To provide a market, a micro-business incubation center, and a public gathering place where locally grown and

produced foods and products may be prepared, aggregated and sold.”

Anyone interested in selling through the Lancaster Fresh Market, Inc. dba Keller Market House (hereafter KMH) should read, understand these Rules, Procedures & Guidelines prior to applying to be a producer. If your product does not meet our guidelines, but you feel it still supports the mission of KMH, you may petition the market manager for a waiver. These requests will be reviewed and decided on a case by case basis. The KMH board and market manager reserve the right to review these producer guidelines on a regular basis and to make changes as needed. Revised guidelines will be announced and made available to producers. Producers are expected to remain current with the revised guidelines. The market management reserves the right to make exceptions to these rules and guidelines at its discretion. Entry of new products is dependent on the needs of the market and is up to the discretion of the market manager.

General Producer Rules

Membership: Anyone wishing to sell at the KMH is required to be a member of Lancaster Fresh Market, Inc. Membership dues must be current in order for a producer’s product to continue to be sold. Members must submit a written statement of any changes in practices or products each year. Locally Sourced: Producers of all products sold though KMH must be based in Ohio. No Reselling: Producers may only sell products they themselves have grown or processed. No one can buy wholesale from someone else and then retail through KMH. Value must be added to processed food products by the producer; simply repackaging the ingredients is not adding value. Compliance with Health, Safety and Related Laws: All products must comply with federal, state, and local health regulations, licensing, and labeling requirements. Producers are expected to inform themselves on issues governing the production, display, distribution, sampling and sale of their products. Anyone wishing to sell through KMH should research the rules and regulations regarding the products they are wishing to sell prior to applying as a producer member.

Product Categories and Guidelines

Animal Products including locally raised meat, poultry, dairy (milk, butter, cheese), and eggs may be sold through the KMH.

Meat (beef, pork, lamb, goat, and fish) ● Feeder cattle must be raised and finished by the seller. ● Meat must be raised in Ohio and processed in a State of Ohio inspected and certified facility. ● Products from concentrated animal feeding operations (CAFO) as defined by the Ohio Department of

Agriculture and products from animals treated with growth hormones, such as rBGH, may not be sold through the market.

● Meat from grass fed animals will be given preference in the market. If grain is to be fed when grass is unavailable, the feed should be non-GMO or organic.

● The routine use of antibiotics on livestock is discouraged. ● Freshwater fish and shellfish must be grown in tanks or ponds located in the State of Ohio. If fish are

commercially harvested, they should be obtained in a way that does not deplete or endanger the species collected and that insures a sustainable harvest for future generations. If applicable a commercial fishing license must be provided to KMH.

● Organic certification is welcome, but we will not exclude producers without this certification. ● All products must be delivered in a good, frozen condition. ● All products must be labeled with net weight.

Meat (poultry)

● Poultry may be ordered from any source, but it must be raised in Ohio and processed in a State of Ohio inspected and certified facility.

● Meat from pasture raised poultry will be given preference in the market. If grain is to be fed when pasture is unavailable, the feed should be non-GMO or organic.

● The routine use of antibiotics on livestock is discouraged. ● Organic certification is welcome, but we will not exclude producers without this certification. ● All products must be delivered in a good, frozen condition. ● All products must be labeled with net weight.

Eggs (all poultry)

● Growers must own and raise egg layers. ● Eggs from pasture raised poultry will be given preference in the market. If grain is to be fed when

pasture is unavailable, the feed should be non-GMO or organic. ● Producers must follow all state and local regulations. This shall include permits, facilities, etc.

○ Producers may reuse cartons provided they are in a good, clean condition. All other labels that do not identify the product inside (store labels, grades, etc) must be removed or obliterated.

● Eggs must be marked as “ungraded”. Producers may not use descriptions like “large, extra-large, jumbo” unless they have a certified grading machine.

● Organic certification is welcome, but we will not exclude producers without this certification. Produce including vegetables and fruits from Ohio farms and gardens may be sold through the KMH.

● Produce grown from genetically modified (GM) seed may not be sold at the market. ● The routine use of chemical sprays and/or synthetic chemicals or fertilizers is discouraged. ● Organic growing practices are encouraged. Organic certification is welcome, but we will not exclude

producers without this certification. ● Producers following the USDA Good Agricultural Practices and Good Handling Practices Audit

Verification Program (GAP&GHP) are encouraged but not required. GAP & GHP producers and products will be given preference in the market.

Value-Added Products are processed or prepared products that the seller has cooked, canned, dried, baked, or preserved themselves and may be sold through the KMH. These include baked goods, spreads, condiments, viticulture, dried fruits and vegetables, juices, syrups, honey, and jellies/jams. Cottage foods are considered value-added products.

● Products using local ingredients (either sourced from a KMH producer or directly from another Ohio source) will be given preference in the market.

● Use of local ingredients is encouraged and all ingredients originating in Ohio should be noted on the label by use of an asterisk *.

● The use of commercial baking mixes, prepackaged cookies, crackers, and pretzels, and canned fillings, soups, or mixes is discouraged. Products which are made with basic, raw materials as ingredients will be given preference in the market.

● Mixing store bought ingredients is not considered adding value and will be considered repackaging. Repackaged items may not be sold through the KMH.

● Meat products used as ingredients should be sourced locally when possible and the origin (farm name) identified on the producer’s application and label.

● Producers of value-added products where dairy is the primary ingredient (such as ice cream, cheese, cheesecakes) should be sourced from Ohio based dairies when possible and the origin (such as Smith’s or Hartzler’s) identified on the producer’s application and label.

● The use of highly processed ingredients such as high fructose corn syrup (HFCS), hydrogenated oils, artificial flavors/colors/preservatives, and MSG is discouraged. Products that do not include these ingredients will be given preference in the market.

● All bakery goods must have a “baked-on” date. Please refer to the Producer Application for additional information.

Wild-crafted/Foraged Products such as wild berries, ramps, fiddlehead ferns, and wildflowers gathered by the seller may be sold through the KMH. No wild mushrooms may be sold at the KMH. These should be obtained in a way that does not deplete or endanger the species collected and that ensures a sustainable harvest for future generations. Non-Food Agricultural Products which the member has grown/produced that are not edible, have been altered from their raw state, and are handcrafted or processed by the member may be sold through the KMH. These items may include milk based soaps, beeswax candles, pelts, and fiber. Nursery Products including cut and potted flowers, bedding plants, seeds, perennials, annuals, trees, or shrubs that are propagated from seed, cuttings, bulbs, plugs or plant divisions may be sold through the KMH. Please note that it is the producer’s responsibility to water and maintain the quality of their live potted plants while being sold at the KMH. Producers are required, on the Producer Application, to state the growing practices for these products. Artisan Products that the member has made themselves may be sold through the KMH. Please refer to the Artisan Guidelines for additional information regarding rules and accepted practices.

In-Market Prioritization

In-market retail space is limited. The amount of space given to each producer is at the discretion of the market staff, will be based on a product mix and will be set up to provide the best overall experience for the customer. If at any time the market becomes too crowded (overall or with any one type of product) the market staff may assign in-market priority to certain producers based on the followed criteria:

1. Geographical proximity 2. Local content of processed products (homegrown or otherwise sourced locally). 3. Additional sustainable practices, including but not limited to: Small-scale family operations, limited use

of chemical inputs (pesticides, fertilizers), and use of pasture production when seasonally available. 4. Years as a producer.

These criteria will be applied objectively, based on the information provided in the Producer/Artisan Application, and priority will be assigned without compromising quality or safety of products. Food will have priority over non-food products. While KMH does not offer exclusive rights to any one producer to sell any one product, if the market manager believes the number of producers offering the same or similar products within the physical market is excessive, duplicate products may be denied entry.

Payments and Fees

Anyone wishing to sell products is required to pay an annual membership fee of $50. After the first year, the fee can be automatically deducted by the KMH in the appropriate month from the producer sales. Other arrangements for payment may be made with the prior consent of the market manager. Note, it is not the market’s responsibility to notify producers of their membership “anniversary” date and non-payment of the membership fee may result in the removal of a producer’s product from the sales floor. KMH will retain a percentage of all consignment sales for all products listed in the General Product Guidelines above. The consignment percentage rates are as follows:

Highly Perishable items including all Produce, Nursery, Wild-crafted/Foraged, and bakery goods as Value-added products: 15%

Animal Products, Non-Food Agricultural, and Value-added products except bakery goods: 25%

Artisan: 30% Producers will be paid for the items sold (minus the appropriate consignment sales percentage) by the 15th of each month after sales. The sales period runs from the 1st to the last day of the month. Direct deposit is available and encouraged. Check payments are also available. All producers are required to set the price of their product(s) being sold in the KMH.

Inventory

KMH works to track and protect all products while they are at the market. However, ultimately products are left in the market at the producer’s own risk. Discrepancies in inventory may be taken up with market management and will be handled on a case by case basis. Producers will be expected to provide KMH with inventory on a regular schedule, or on an as needed basis, as determined by the market manager. KMH reserves the right to accept or refuse any product. KMH reserves the right to remove any product from the store at any time Inventory displays will be provided by KMH. Any producer provided inventory displays must receive prior approval from the market manager before being placed. If a producer provided inventory display is placed in the store, KMH reserves the right to remove it at any time. If a producer provided inventory display is removed by KMH, the producer will be notified of a deadline to retrieve it. If it is not retrieved it will be discarded. All producers are required to complete the inventory form included in the Producer Application. The form must be completed entirely and signed by the Producer. Any new products must be approved by the market manager and additional copies of the form may be requested. Inventory forms are used to enter a producer’s product data into the point of sales system, where it will be tracked.

Product Labeling and Barcodes

KMH tracks producer sales through the use of a point of sale management system, cash register, and product labels. To ensure producers are paid for their sales, each item must be properly labeled. KMH provides barcode labels which must be used if the product does not already have a UPC/barcode. The producer is responsible for:

● Providing basic product labels that meet all county, state, and federal rules. ● Applying the KMH barcode labels to all products. The producer may choose to apply the barcode labels

to a wand, which will then be placed in the same basket as the product. ● Making sure the item is properly labeled before placing the product on display, or storing in back stock

as agreed upon by the market manager. ● Requesting labels 24 hours in advance to dropping off product.

Items that are not properly labeled and barcoded will not be put on the sales floor. Producers must email barcode label requests 24 hours in advance to [email protected], or may call the store directly. Labels will be filed in the producer’s individual file for pickup upon arrival. KMH may also mail barcode labels to the producer if prior arrangements have been made.

Signage

KMH encourages all producers to create and display information about their operation and products. Producers should take care to not block other producer’s displays or items. Offensive or distracting displays, as determined by the Market Manager, as determined in his/her sole discretion, may be removed. Producers are encouraged to post a personal biography with their products, including details about their operation and production practices. Keep in mind that shoppers may not have a lot of time to read a lengthy full page to get the information they need. Producers who wish to use their own display equipment should contact the market management. Use of display equipment will be decided on a case by case basis.

Product Delivery and Packaging

Producers are welcome to deliver products to the market during store hours; however, producers should recognize that the first priority of the market staff and volunteers is the customer. Producers needing special assistance should not come during “rush times” or should schedule an appointment with the manager. Producers may leave additional products at the market for the staff and volunteers to periodically restock, with approval from the market manager. All products should be clearly labeled and put in the stock area/cooler. Producers may package products at their discretion; however, KMH recommends against using units that can be easily altered or misconstrued at the register and suggests selling items individually or by weight. KMH provides plastic produce bags and scales for items to be sold in bulk (by the pound). Barcode labels for the item to be sold should be clearly displayed with the product for the customer to take with them to the register.

Customer Satisfaction

KMH strives to maintain fresh, appealing products for the customer. Any unsuitable, spoiled or damaged product will be immediately removed from the market and disposed of. Materials used for displaying product, transporting product or

product packaging itself, must be clean and sanitary. Failure to do so will result in product being pulled from the sales floor. KMH strives for customer satisfaction; therefore, we will accept customer returns on food and non-food items for refund or replacement. Producers will be notified of nature of customer complaint. KMH will accept returns on non-food (artisan) items within 30 days with tag or receipt. The returned amount will be deducted from producer’s future sales. Customer complaints about specific products will be forwarded to the producer and kept on file. Customer complaints may result in removal of a Producer and/or Producer’s product(s) from the market.

Sales Tax

KMH will collect and pay the sales tax on all taxable items. The tax amount will be automatically added at the cash register. The producer does not need to include this amount in the selling price.

Wholesale Producer

At the discretion of the board, KMH will purchase items from producers at wholesale for the overall good of the market, and to fill gaps in product availability. Priority will always be given to producers operating on consignment with KMH. KMH will pay the published wholesale price with a minimum of 30 days net terms. Wholesale producers must meet the following criteria:

● They have an established wholesale business. ● They can show proven availability of products.

The use of a distributor is allowed upon producer request. KMH’s primary relationship is with the producer. Distributors must offer a minimum of 30 day net terms.

Other KMH Policies

Application: Prospective producers and artisans wishing to sell should confirm that their product is legal and compliant with all market guidelines before applying, and then must submit a completed Producer Application or Artisan Application for review by market management to ensure that their products are eligible for sale. Producers and Artisans will be notified of acceptance. Documentation: All producers must provide the market manager with copies of all relevant documents, such as licenses, certifications, permits, etc. Some examples are nursery licenses for bedding plants, organic certification, mobile retail food establishment licenses, and home bakery licenses. Producers wishing to use the term “organic” must submit a copy of their certification with their application. Disclosure: Full disclosure of all production practices is required for all producers. Buying local gives shoppers the benefit of knowing where their food comes from, and how it was grown. KMH’s disclosure practice sets it apart from other food grocers, giving local producers a marketing edge. All products, including wild-crafted or foraged products should be obtained in a way that does not deplete or endanger the species collected and that insures a sustainable harvest for future generations. To help shoppers and volunteers, the market will keep on file the Producer Application to refer to when shoppers have questions that floor display information does not cover. If a shopper has questions that are not answered by the information in the store, the manager will request further information from the producer. KMH reserves the right to visit and inspect the farm or business of any producer. Visits will be made with prior notification, and inspections will only be conducted with the producer present. Failure to allow farm visits could result in

termination or suspension of the Producer Contract. We will consider false statements on a producer’s application about the origin or production standards of products listed to constitute fraud. To protect the integrity of our marketing system, the Keller Market House reserves the right to verify the claims of everything sold through our marketplace. Insurance: KMH is not responsible for any loss, theft, or damage incurred by producer’s products in the market. In the event of a lawsuit, the market’s insurance will cover the market. Producers and their agents and/or employees are not covered under this policy. It is up to each producer to insure themselves to the level they feel appropriate. KMH strongly encourages producers to obtain their own personal liability insurance and product liability insurance. If a producer is incorporated, or is an LLC, they must provide a certificate of insurance. Grievance & Complaints: Complaints or problems should be directed to the market management in a timely manner that is not disruptive to the market. Producers who have concerns regarding product representation should inform market management. Additional concerns may be submitted in writing. Each submission will be reviewed by the market manager and/or KMH board when appropriate. A producer may appeal any decision of the market manager within 30 days. An appeal must be presented in writing to KMH board. A decision by the board shall be issued within 30 days of receipt and constitute a final and binding decision with respect to the matter. Any instance of physical violence will result in immediate suspension from the market.

4. Bakery producers must include a “baked on date” on all items. Producers are responsible for knowing the shelf life of their own products. Producers can either make plans to check and maintain their inventory, or may submit a clear, weekly schedule to the market manager and volunteers to follow (Example: deliver Wednesday am, reduce 20% Friday night, pull Saturday night). Producers may arrange with market manager to hold expired products for pick up or allow the market to donate to local charities.

PRODUCER CONTRACT

Producer Acknowledgements:

By signing this document, I, the producer, have read and understand the Keller Market House Market Rules, Procedures & Guidelines. I agree to comply with the Keller Market House Market Rules, Procedures & Guidelines I understand that I may only bring in approved products and that if I wish to bring in additional products I must have them approved by the market manager prior to placement within the store. I understand that products must comply with all applicable federal, state and local health regulations, licensing and labeling requirements. I agree to provide all required and/or requested documentation in a timely manner. The Keller Market House may choose to not place my products for sale until all documentation is provided. By providing my email address, I am giving my permission to be added to the Keller Market House email listing for weekly newsletters, producer’s notices and Artisan’s notices and special store notices. I affirm that all information in this application is complete and accurate.

Failure to comply by these standards may result in the termination of the contract between me (the producer) and the Keller Market House.

This Producer Contract may be terminated at any time by either the Producer or the Keller Market House.

Artisan Products

Keller Market House (hereinafter KMH) seeks to support the use of original designs incorporating agricultural products. We also welcome products made from materials found in nature (stone, wood, glass, natural fibers, clay, beads from natural minerals, dried or live plant materials) and reclaimed/recycled functional products.

Artisan products: must be hand-made crafts or original works of art.

Artisan categories: Work exhibited and/or sold at the KMH should fall within one of the following categories: ● Art from agricultural products. ● Art from recycled/reclaimed materials ● 2 dimensional art, cards, clothing, decorative art, fiber, functional items, jewelry, plant/natural art, and seasonal

art. The Keller Market House will not accept:

● Crafts made from kits ● Crafts that appear as if they are made from kits ● Arrangements of mass-produced dried or silk flowers

Artisan eligibility: For an artisan to be eligible to exhibit and/or sell creations at KMH, the following guidelines must be met:

● The work must support the mission of the Keller Market House: “To provide a market, a micro-business incubation center, and a public gathering place where locally grown and

produced foods and products may be prepared, aggregated and sold.” ● Each art/craft product must be of locally produced agricultural products, local origin and/or hand-made by the

applicant. Joint projects must be identified as such. ● Each artist or artisan group must be a current member of the Keller Market House.

Exhibiting

All artisans selected to exhibit and/or sell at the KMH must abide by the following regulations: 1. Each artisan must be evaluated and accepted by the market manager and/or KMH board. 2. Each artisan must pay the appropriate fees (see below). 3. Exhibition and/or sale of artisan products, and the length of time products will be exhibited will be decided on a

case by case basis based upon the specific needs of the market, season, and space availability. 4. If an existing Artisan would like to bring in new items to sell, those items must also be evaluated by the market

manager.

Artisan Evaluation Process

All applications and products will be evaluated by the market manager for eligibility and acceptance will be determined by the following.

1. The product must comply with the Artisan Guidelines listed above. 2. The number of individuals selected for display will be based on the space availability, which may be limited. 3. The “mix” of products for sale in the artisan area.

Displays

Space will vary by season. Artisans will not have a specific permanent display space or area. An Artisan’s spot may be changed, and these changes will be based on the needs of the market, fluctuations with other artisans/producers and may reflect the desire to maintain a fluid look of the store as determined by the market manager in his/her sole discretion. Products from producer displays may be rotated throughout the market for special promotions or seasonal displays.

Exhibition of artisan products, the length of time products will be exhibited will be decided on a case by case basis based upon the specific needs of the market, season, and space availability as determined by the market manager in his/her sole discretion.

All products will be displayed for a minimum of 3 months. At the end of the 3 months, KMH and the Artisan will evaluate and make changes as needed based on the needs of the market (season/space), the artisan’s preference, and sales history.

Products may be taken to sell or be included in offsite special displays showcasing samples of products from the market. The Artisan will be contacted if products are removed from the market.

Set up and maintenance of each display will be the responsibility of the artisan.

Each Artisan is required to display a short bio with their exhibit.

Artisans are responsible for delivery/removal of pieces to KMH.

Each item for sale at KMH must be marked with a securely attached label and include a KMH barcode/price label. KMH encourages tags to also include information such as the Artisan’s name, name of business, and town/city where Artisan resides when applicable.

Fees

Anyone wishing to sell products is required to pay an annual membership fee of $50. After the first year, the fee will be automatically deducted by the KMH in the appropriate month from the producer sales. KMH will retain 30% of all artisan consignment sales. Producers will be paid for the items sold (minus the consignment sales percentage) monthly. The sales period runs from the 1st of the month to the last day of the month. Direct deposit is available and encouraged. Check payments are also available. Artisans will not receive a check until monthly consignment sales are $15 or more. All Artisans are required to set the price of their product(s) being sold in the KMH.

Sales Tax

KMH will collect and pay the sales tax on all taxable items. The tax amount will be automatically added at the cash register. The Artisan does not need to include this amount in the selling price.

Customer Satisfaction

The goal of KMH is customer satisfaction; therefore, we will accept customer returns on artisan items within 30 days with tag and receipt. Artisan’s will be notified of the nature of customer complaint. The returned amount will be deducted from the Artisan’s future sales.

Insurance

KMH is not responsible for any loss, theft, or damage incurred by Artisan or his/her product in the market. In the event of a lawsuit, the market’s insurance will cover the market. Artisan’s and their agents and/or employees are not covered under this policy. It is up to each Artisan to insure themselves to the level they feel appropriate. KMH strongly encourages Artisan’s to obtain their own personal liability insurance and product liability insurance. If an Artisan is incorporated, or is an LLC, they must provide a certificate of insurance. Grievance & Complaints: Complaints or problems should be directed to the market management in a timely manner that is not disruptive to the market. Artisan’s who have concerns regarding product representation should inform market management. Additional concerns may be submitted in writing. Each submission will be reviewed by the market manager and/or KMH board when appropriate. An Artisan may appeal any decision of the market manager within 30 days. An appeal must be presented in writing to KMH board. A decision by the board shall be issued within 30 days of receipt and constitute a final and binding decision with respect to the matter. Any instance of physical violence will result in immediate suspension from the market.
