Sub-Division, Dhalli was transferred within a radius of 10 Kms as Assistant Engineer

(QC&D), o/o Engineer-in-Chief (QC&)D, Hp, pwD, Shimla vide this departments,

notification No.PBW-A-P,(6)-l12016 dated 5th April, 2016. The Officer had relinquished

the charge of the post of Assistant Engineer (Civil), HPPWD NH Sub-Division, Dhalli on

llth April. 2016 andjoined duties as AE (QC&D) o/o E-in-C (eC&D). HppwD Shimta

on 25'h May.2016.

Whereas, now Sh.Vijay Chauhan, Assistant Engineer has submitted

medical certificate alongwith fitness w.e.f.8.4.2016 to 24.5.2016 issued by Professor &Head, Neuro Surgery Department, IGMC Shimla for sanction of medical leave for the

said period.

And whereas, after going through the record, it has found that although

Sh.Vijay Chauhan, Assistant Engineer was transferred on 5th April, 2016 within Shimla

town that too within a radius of 10 Kms. but he relinquished the charge after 06 days i.e,

on 11'n April. 2016. Fufiher, record also reveals that the officer has applied medical

leave w.e.f. 8.4.2016 but he has relinquished the charge on 11 .4.2016 i.e. during the

medical leave. Further, record also transpire that during the medical leave, the officer has

also put political pressure to get his transfer cancelled which is clear violation of CCS

(Conduct) Rules, 1964. From these facts, it appears that the officer was not unwell and

has procured/submitted the medical certificate only to regularize his absence period.

Hence, medir:al leave cannot be sanctioned in his favour.

Now, therefore, in the light of findings recorded above, it is ordered to

treat the period w.e.f. 8.4.2016 to 24.5.2016 in respect of Sh.Vijay Chauhan, Assistant

Engineer (Civil), HPPWD as dies non which shall neither be couhted as service nor
