Sir, Please refer to the above cif.rec. subject c.nc letters seeking prior approval of the

Central Government for diversion of [c,rest land for non-fo:-estry ::;mrpose in accordance with section 2 of the Forest (Consen aticn) Act, 1980.

2. After careful examination of tae proposcl of the State Gcrernment, approval is hereby conveyed for diversion of 0.2545 hectc.res of forest land f~lr the above mentioned project subject to the following cond=.-:ions:

i. Legal status of the forest land ~rill remain "..mchanged: ii. Minimum number of trees and il11IDy case no: more than 35 crees will be removed; iii. Compensatory afforestation wID be carried out over 0.509 hectares of degraded

forest land on Bhattu Ramsara Road KNr 2-12 Lis as per £.roposed scheme, at a cost of Rs. 295067/- provid!ed by the user agency. Plantation will be done within one year from the date!>;: issue u'ff" this letter;

iv. The forest land vvill not be usr::d ::or any o:her purpos= than that mentioned in the proposal;

v. The forest land proposed to be diverted shall under 0.0 circumstances be transferred to any other agency:. depart::nent, or person-without approval of the Central Government;

VI. The layout plan of the proposal shill not be changed. without the prior approval of the Central Gove:rr:ment;

Xl. The maximum width of "Right of Way' fa:- be pro!='o3ed transmission line on the forest land shall be not more 1:ba. 26 meters;

Xli. Below each conductor, width clearance of 3.00 metres wouW':Je permitted for taking the tension stringing equipmer-t. The trees tOn such stri?S wodd have to be felled but after stringing work is complet~, the natur2J regeneratic,n v,rill be allowed to come up.

Felling/pollarding/ pruning of trees will b~ done with the permission of the local forest officers, whe:1ever necessary, to mair_tain the electric clearance. One outer strip shall be left clear to permit maintenance of the transmission line;

Xlll. The minimum clearance betwe~n conciucto:-s and trees shall be maintained 4.0 meters for preventing electric hazards; The sag and S\ving of the conductors are to be kept in view while working out the minirLum clearance maintained as above

XlV. The user agency shall install crcuit breakers at suitable places besides maintain necessar:y ground clearance to :r::-event electrccution of\Vild animals;

x·v. User agency in cO:1sultation vrith the Stat~ Forest Department, shall prepare a detailed scheme for creation and maint,:;nance of plantation of dwarf species {preferably medicinal plants} in the Right of Way under the transmission line, and provide funds for execution of the said sche:ne to the State Forest Department;

XVI. In case the portion of the transmission lin=: to be constructed is located in hilly areas, where adequate clearance is already a\"ailable, trees shall not be cut;

XVil. The user agency shall carry out muck disposal at pre-designated sites in such a manner so as to avoid its rolling down and should be taken up as per the scheme approved by the Forest Department::;

xviii. The required soil conservation measures should be taken up by the user agency for which fund should be provided 8S per the current rate of works;

XlX. The User Agency shall provide fIrewood pre:erably alternate fuels to the labourers and the staff working at the si..:::e so as to cvoid any damage and pressure on the nearby forest areas;

xx. The boundary of the forest land being diverte::l. shall be demarcated on ground at the project cost, using four feet high RCC pillars, each pillar inscribed with the serial number, DGPS coordinates, forward and backward bearings and distance from pillar to pillar etc.;

XXl. The User Agency shall ensure that because of this project, no damage is caused to the flora and the wildlife availab~e in the are~

xxii. The user agency will assis: the Sta::e Government in conservation and preservation of flora and fe.una of the area in accordance with the plan prepared by the Chief Wildlife Warden of the State.

xxiii. Any other conditior_ that this RegionaJI Office may stipulate, from time to time, in the interest of conservation, protection and devebpment of forests & wildlife;

xxiv. The User agency shall submit the annual self compliance report in respect of the above conditions to the State Government c..nd to the concerned Regional Office of the Ministry regularly; and

xxv. It will be the responsibility of the State Government/User Agency to obtain all other prior approvals/clearances onder all other relevant Acts/Rules/ Court's Rulings/instructions, etc., incllI:.ding environmental clearance, as applicable to this proposal.

3. The Ministry may revoke/suspend the clearance if implementation of any of the above conditions is not satisfactory. State Gove:nment will ensure fulfillment of these conditions through forest department.
