the undersigned Assistant Attorney General, hereby sues the Defendants, COASTAL

as Managers, Owners, Officers and/or Directors of COASTAL ENVIRONMENTAL LLC, d/b/a

VACUVENT, VACUVENT FRANCHISING, INC, HOME RESTORATIONS AND

REFURBISHMENT, INC., d/b/a V ACA VENT, and/or V ACUVENT, INC. ("hereafter

corporately referred to as the "Defendants").

JURISDICTION AND VENUE

1. This is an action for injunctive and declaratory relief, costs, restitution, attorneys'

fees, penalties and any other statutory relief available, pursuant to the Florida

Deceptive and Unfair Trade Practices Act, Chapter 501 , Part II, Fla. Stat.

2. This Court has subject-matter jurisdiction, pursuant to the provisions of Chapter 501,

Part II, Fla. Stat.

3. All actions material to the Complaint have occurred within four ( 4) years of the filing

of this lawsuit.

4. Venue is proper in Indian River County, Florida as the statutory violations alleged

herein occurred in, or affected, more than one judicial circuit in the State of Florida,

including Indian River County, and elsewhere in the United States.

5. Venue is further proper in the Nineteenth Judicial Circuit as the Defendants

conducted business in Indian River County, Florida.

THE PLAINTIFF'

6. The Plaintiff is an "enforcing authority" of the Florida Deceptive and Unlawful Trade

Practices Act ("FDUTPA"), Chapter 501, Part II, Fla. Stat. and is authorized to bring

this action and to seek injunctive relief and all other available statutory relief.

7. The Plaintiff has conducted an investigation of the matters alleged herein, and

Attorney General Pamela Jo Bondi has determined that this enforcement action serves

the public interest, as required by Section 501.207(2), Fla. Stat. See Attached

Plaintiffs Exhibit A (The Determination of Public Interest)

8. The Defendants, at all material times hereto, provided goods or services as defined by

Section 501.203(8), Fla. Stat. within Indian River County and elsewhere in the United

States.

9. The Defendants, at all material times hereto, solicited consumers within the definition

of Section 501.203 (7), Fla. Stat.

10. The Defendants, at all material times hereto, were engaged in a trade or commerce

within the defmition of Section 501.203(8), Fla. Stat.

THE DEFENDANTS

COASTAL ENVIRONMENTAL LLC, d/b/a V ACUVENT

11. The defendant, COASTAL ENVIRONMENTAL LLC, d/b/a V ACUVENT, is an

active State of Florida corporation established in or around 2007, with its principal

office located in Sebastian, Indian River County, Florida.

12. COASTAL ENVIRONMENTAL LLC, d/b/a VACUCENT, markets indoor air

quality and air duct cleaning services to consumers in Florida and throughout the

United States and is engaged in trade or commerce as defined in Section 501.203(8)

of the Florida Statutes.

VACUVENT FRANCHISING, INC.

13. The defendant, VACUVENT FRANCHISING, INC., is an active State of Florida

corporation established in or around 2004, with its principal office located in

Sebastian, Indian River County, Florida.

14. VACUVENT FRANCHISING, INC. markets indoor air quality and air duct cleaning

services to consumers in Florida and throughout the United States and is engaged in

trade or commerce as defined in Section 50 1.203(8) of the Florida Statutes.

HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a VACA VENT

15. The defendant, HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a

V ACA VENT, is an active State of Florida corporation established in or around 2005,

with its principal office located in Sebastian, Indian River County, Florida.

16. HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a VACAVENT,

markets indoor air quality and air duct cleaning services to consumers in Florida and

throughout the United States and is engaged in trade or commerce as defined in

Section 501.203 (8) of the Florida Statutes

VACUVENT, INC.

17. The defendant, VACUVENT, INC., is a dissolved State of Florida corporation

established in or around 2003, with its principal office located in Sebastian, Indian

River County, Florida.

18. VACUVENT, INC. marketed indoor air quality and air duct cleaning services to

consumers in Florida and throughout the United States and was engaged in trade or

commerce as defined in Section 501.203(8) ofthe Florida Statutes.

DEFENDANT DANIEL A. MCCUSKER

19. The defendant, DANIEL A. MCCUSKER, is a natural person and was registered with

the Florida Department of State, Division of Corporations, as one of the Managers,

Owners, Officers and/or Directors of COASTAL ENVIRONMENTAL LLC, d/b/a

VACUVENT, VACUVENT FRANCHISING, INC, HOME RESTORATIONS AND

REFURBISHMENT, INC., d/b/a V ACA VENT, and/or V ACUVENT, INC.

20. As a as one of the Managers, Owners, Officers and/or Directors of COASTAL

ENVIRONMENTAL LLC, d/b/a VACUVENT, VACUVENT FRANCHISING, INC,

HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a V ACA VENT,

and/or V ACUVENT, INC., the defendant, DANIEL A. MCCUSKER, at all times

material to the allegations in this Complaint, participated in, controlled and/or

possessed the authority to control the acts and practices of COASTAL

ENVIRONMENTAL LLC, d/b/a V ACUVENT, V ACUVENT FRANCHISING, INC,

HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a V ACA VENT,

and/or VACUVENT, INC., and possessed actual and/or constructive knowledge of all

material acts and practices complained of herein.

21. Upon information and belief, the defendant, DANIEL A. MCCUSKER, is an adult

individual residing in Indian River County, Florida.

DEFENDANT WILLIAM G. BROGNA

22. The defendant, WILLIAM G. BROGNA, is a natural person and was registered with

the Florida Department of State, Division of Corporations, as one of the Managers,

Owners, Officers and/or Directors of COASTAL ENVIRONMENTAL LLC, d/b/a

Office of the Attorney General. Department of Legal Affairs v. Coastal Environmental LLC, et. al. Page 6 of 14

23. As a as one of the Managers, Owners, Officers and/or Directors of COASTAL

ENVIRONMENTAL LLC, d/b/a V ACUVENT, V ACUVENT FRANCHISING, INC,

HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a V ACA VENT,

and/or V ACUVENT, INC., the defendant, WILLIAM G. BROGNA, at all times

material to the allegations in this Complaint, participated in, controlled and/or

possessed the authority to control the acts and practices of COASTAL

ENVIRONMENTAL LLC, d/b/a V ACUVENT, V ACUVENT FRANCHISING, INC,

HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a VACAVENT,

and/or V ACUVENT, INC., and possessed actual and/or constructive knowledge of all

material acts and practices complained of herein.

24. Upon information and belief, the defendant, WILLIAM G. BROGNA, is an adult

individual residing in Indian River County, Florida.

DEFENDANT CALVIN M. CAMBRIDGE

25. The defendant, CALVIN M. CAMBRIDGE, is a natural person and was registered

with the Florida Department of State, Division of Corporations, as one of the

Managers, Owners, Officers and/or Directors of COASTAL ENVIRONMENTAL

LLC, d/b/a V ACUVENT, V ACUVENT FRANCHISING, INC, HOME

RESTORATIONS AND REFURBISHMENT, INC., d/b/a VACAVENT, and/or

V ACUVENT, INC.

26. As a as one of the Managers, Owners, Officers and/or Directors of COASTAL

ENVIRONMENTAL LLC, d/b/a V ACUVENT, V ACUVENT FRANCHISING, INC,

HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a VACAVENT,

and/or V ACUVENT, INC., the defendant, CALVIN M. CAMBRIDGE, at all times

material to the allegations in this Complaint, participated in, controlled and/or

possessed the authority to control the acts and practices of COASTAL

ENVIRONMENTAL LLC, d/b/a V ACUVENT, V ACUVENT FRANCHISING, INC,

HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a V ACA VENT,

and/or VACUVENT, INC., and possessed actual and/or constructive knowledge of all

material acts and practices complained of herein.

27. Upon information and belief, the defendant, CALVIN M. CAMBRIDGE, is an adult

individual residing in Indian River County, Florida.

STATEMENT OF FACTS AND DEFENDANTS' COURSE OF CONDUCT

28. Beginning in or around at least 2008, the Office of the Attorney General for the State

of Florida began receiving complaints from consumers that the Defendants used bait-

and-switch tactics in marketing their indoor air quality and air duct cleaning services.

29. Beginning in or around at least 2008, the Office of the Attorney General for the State

of Florida began receiving complaints from consumers that the Defendants failed to

provide indoor air quality and air duct cleaning services and/or related products and

services, such as treatments, inhibitors, electrostatic filters and ultra violet lights

and/or that the indoor air quality and air duct cleaning services and/or related

products were defective and/or sub-standard.

30. Beginning in or around at least 2008, the Office of the Attorney General for the State

of Florida began receiving complaints from consumers that the Defendants did not

honor their advertised 10-day refund policy.

31. Beginning in or around at least 2008, the Office of the Attorney General for the State

of Florida began receiving complaints from consumers that the Defendants failed to

appear for agreed-to appointments with consumers to repair and/or correct improperly

performed service calls.

32. Technicians subcontracted by the Defendants were encouraged by the Defendants to

use high-pressure sales tactics to induce consumers to purchase services and products

in addition to those offered in the companies' advertisements upon their arrival to an

appointment, and in some instances the additional indoor air quality and air duct

cleaning services and/or related products and services offered by the technicians were

unnecessary.

33. The Defendants routinely failed to provide various products ordered by consumers,

and some consumers had to wait months for the products to be delivered to them

which were initially promised to be delivered in 4 to 6 weeks.

34. Despite the unavailability of the promised, contracted-for and/or paid-for products,

the Defendants did not provide consumers with refunds when the products were not

delivered.

35. The Defendants maintained a call center with numerous employees who contacted

consumers not only to schedule appointments in response to advertisements

distributed by the Defendants to the public, but to additionally conduct outbound

sales solicitations for its indoor air quality and air duct cleaning services.

36. None of the Defendants were licensed telemarketers as required by Section 501.605

(a) Florida Statutes.

3 7. Furthermore none of the salespersons who were making outbound sales calls on

behalf of the Defendants were licensed telemarketing salespersons as required by

Section 501.607 Florida Statutes.

38. The number of consumers impacted by the Defendant's unfair and deceptive business

practices of which the Office of the Attorney General is currently aware is 108, and

the amount of restitution to which these 1 08 consumers are believed to be entitled is

$48,103.47.

39. One consumer, Harold Person, received a telephone call from a representative of the

defendant, Vacuvent, Inc., informing him of a vent-cleaning special in his area for a

nominal amount. When the Vacuvent, Inc. technician arrived at his home, the

technician advised Mr. Pearson that he needed additional services in the amount of

approximately $6,000.00, which included the replacement of all of his air

conditioning ducts and the purchase of an electrostatic filter.

40. Mr. Person subsequently filed an insurance claim seeking reimbursement for the costs

associated with the replacement of all of his air conditioning ducts due to significant

mold in the air conditioning ducts as alleged by the Vacuvent, Inc. technician;

however, his claim was denied because the insurance adjuster advised that be found

no evidence of mold in Mr. Person's air conditioning ducts.

41. Mr. Person is a Florida citizen over the age of 55. See Attached Plaintiff's Exhibit B

(Affidavit and supporting documents of Harold Person with bank account and/or

driver's license information redacted)

42. Another consumer, Betty Jo Wilson, contacted Vacuvent, Inc. in response to an

advertisement in the Lakeland Ledger Newspaper which offered to clean the air ducts

of an entire house for a total of$25.00 (i.e., up to five (5) vents).

43. Mrs. Wilson made an appointment with Vacuvent, Inc. for the advertised special;

however, when the technician arrived Mrs. Wilson was told that she needed

additional air conditioning services well in excess of the advertised special.

44. Although Mrs. Wilson declined most of the suggested additional services, she

nonetheless ended up agreeing to services in excess of the advertised special which

totaled approximately $2,500.00.

45. Moreover, Mrs. Wilson's subsequent itemized review of the charges on the invoice

for the additional charges invoice revealed that she had been charged for an

electrostatic filter which she specifically declined and that the itemized services

totaled less than the $2,500.00 cited under the total column in the invoice.

46. The Defendants failed to reimburse Mrs. Wilson for the charges on her contract for

services and/or products that she never ordered from the Defendants, after repeated

requests.

47. Mrs. Wilson is a Florida citizen over the age of 55. See Attached Plaintiffs Exhibit

C (Affidavit and supporting documents of Betty Jo Wilson with bank account and/or

driver' s license information redacted)

COUNT I

DECEPTIVE AND UNFAIR TRADE PRACTICES CHAPTER 501, PART II FLORIDA STATUTES

48. The Plaintiff adopts, incorporates herein and re-alleges paragraphs 1 through 44 as if

fully set forth hereinafter.

49. Chapter 50 1.204( 1 ), Florida Statutes, declares that unfair or deceptive acts or

practices in the conduct of any trade or commerce are unlawful.

50. The Florida Deceptive and Unfair Trade Practices Act, Chapter 501, Part II, Florida

Statutes, provides that "unfair methods of competition, unconscionable acts or

practices, and unfair or deceptive acts or practices in the conduct of any trade or

commerce are hereby declared unlawful."

51. The Defendants have violated, and/or will continue to violate, the Florida Deceptive

and Unfair Trade Practices Act, §501.201, Florida Statutes, by using deceptive and

unfair practices in the markets and sale of indoor air quality and air duct cleaning

services.

52. These above-described acts and practices of Defendants have injured and will likely

continue to injure and prejudice the public.

53. Unless the Defendants are permanently enjoined from engaging further in the acts and

practices complained of herein, the continued activities of the Defendants will result

in irreparable injury to the public for which there is no adequate remedy at law.

COUNT II

VIOLATIONS OF CHAPTER 501, PART IV, FLORIDA STATUTES (FLORIDA TELEMARKETING ACT)

51. The Plaintiff realleges, reavers, adopts and incorporates herein Paragraphs 1 through

50 above, as if fully set forth hereinafter, and further alleges, as follows:

52. Pursuant to Section 501.605 Fla. Stat., prior to doing business in the State of Florida,

commercial telephone sellers must obtain a license from the Florida Department of

Agriculture and Consumer Services. Doing business in this state includes either

b. Violating Section 501.605(1), Florida Statues;

c. Violating Section 501.607(1), Florida Statutes;

d. Engaging in any business activity or operation involving or related to the

marketing and/or sale of markets indoor air quality and air duct cleaning

services;

e. Engaging in any business activity or operation involving telemarketing

without the required licenses for both commercial telephone sellers and

commercial telephone salespersons;

2. Award restitution in the amount of $48,103 .4 7 to all consumers who are shown to

have been injured in this action, pursuant to Section 501.206 (1) (c), Florida

Statutes.

3. Assess against the Defendants herein civil penalties in the amount of $10,000 for

each violation of Chapter 501 , Part II, Florida Statutes and $15,000.00 for each

act or practice found to be in violation of Section 501.13 77, Florida Statutes.

4. Order the permanent dissolution of COASTAL ENVIRONMENTAL LLC, d/b/a

V ACUVENT, V ACUVENT FRANCHISING, INC, HOME RESTORATIONS

AND REFURBISHMENT, INC., d/b/a V ACA VENT, and/or V ACUVENT, INC,

and any fictitious names registered and/or owned by COASTAL

ENVIRONMENTAL LLC, d/b/a V ACUVENT, V ACUVENT FRANCHISING,

INC, HOME RESTORATIONS AND REFURBISHMENT, INC., d/b/a

V ACA VENT, and/or V ACUVENT, INC.

5. Award reasonable attorneys' fees pursuant to F.S. 501 .2075.

6. Grant temporary relief pursuant to F.S. 501.207.
